One of these traffic signals is proposed to be located at the intersection of West 78th Street and County Road 17 (Powers Boulevard). Therefore, a traffic control signal agreement between Carver 1 County and the City of Chanhassen is necessary. The specific language for this agreement has followed the format used for the traffic signal agreements between the Minnesota Department of Transportation and the City of Chanhassen for the traffic signals along Trunk 1 Highway 5. The only difference in this case is that the City of Chanhassen will be installing and paying for the cost of the signal. Long -term maintenance of this intersection signal system and lighting including relamping, painting, and providing electrical power will be the 1 responsibility of the City of Chanhassen similar to those signals along Trunk Highway 5. The remaining signals to be installed along West 78th Street as a part of this project will all involve local road intersections; therefore, no other joint agency agreements will be 1 needed. ' It is therefore recommended that the City Council approve the traffic control signal agreement between Carver County and the City of Chanhassen for the proposed traffic control signal installation at the intersection of West 78th Street and County Road 17 1 (Powers Boulevard), Project No. 92 -3. ktm 1 Attachments: 1. The City shall prepare the necessary plan, specifications and proposal which shall constitute "Preliminary Engineering ". The City shall perform the construction 1 inspection required to complete the items of work hereinafter set forth, which shall constitute "Engineering and Inspection" and shall be so referred to hereinafter. I 2. The contract cost of the work or, if the work is not contracted, the cost of all labor, materials and equipment rental required to complete the work, including the cost of providing the power supply to the service poles or pads, shall constitute the actual I "Construction Cost" and shall be so referred to hereinafter. 3. The City with its own forces and equipment or by contract shall perform the traffic I control signal work provided for under State Aid Project No. 10- 617 -10 with all Construction Costs to be the sole responsibility of the City. I 4. The City shall install or cause the installation of overhead signing and shall maintain said signing all at no cost to the County. I 5. The City shall perpetuate and adequate electrical power supply to the service pads or poles, and upon completion of said traffic control signals with street lights installations shall continue to provide necessary electrical power for their operation at the cost and expense of the City. 6. Upon completion of the work contemplated in Paragraph 3 hereof, it shall be the 1 City's responsibility, at its cost and expense, to: (1) maintain the luminaires; (2) relamp the traffic control signals and street lights; and (3) clean and paint the traffic control signals, cabinets and luminaire mast arm extensions. Further, it shall be the I City's responsibility, at its cost and expense, to maintain the interconnect and to perform all other traffic control signal and street light maintenance. 1 1 7. Any and all persons engaged in the aforesaid work to be performed by the City shall not be considered employees of the County and any and all claims that may or might arise under the Worker's Compensation Act of this State on behalf of said employees I while so engaged, andy any and all claims made by any fourth party as a consequence of any act or omission on the part of said employees while so engaged on any of the work contemplated herein shall not be the obligation and responsibility of the I County. The City shall not be responsibility under the Worker's Compensation Act for any employees of the County 8. Timing of the traffic control signals provided for herein shall be determined by the 1 City and approved by the County, through its County Engineer, and no changes shall be made therein except with the approval of the County. 1 1 1 1 1 1 1 1 1 1 1 1 1 COUNTY OF CARVER APPROVED AS TO FORM: By County Attorney Chairman of the Board Dated (County Seal) RECOMMENDED FOR APPROVAL: By County Highway Engineer County Auditor f RESOLUTION BE IT RESOLVED that the City of Chanhassen enter into an agreement with the City of Chanhassen for the following purposes, to wit: To install traffic control signals with street lights, interconnect and signing on County State Aid Highway No. 17 (Powers Boulevard) at 78th Street in accordance with the terms and conditions set forth and contained in the agreement, made a part hereof. BE IT FURTHER RESOLVED that the proper City Officers be and hereby are authorized to execute such agreement, and thereby assume for and on behalf of the City all of the contractual obligations contained therein.
