BOX 147 • CHANHASSEN, MINNESOTA 55317 (612) 937 -1900 • FAX (612) 937 -5739 ' MEMORANDUM TO: Don Ashworth, City Manager 1 FROM: Todd Hoffman, Park and Recreation Director ' DATE: May 4, 1993 SUBJ: Approve Change Order No. 3, Lake Ann Park Recreation Shelter 1 The attached documents pertain to a change in the block type for one of the three Keystone ' retaining walls installed as a part of the Lake Ann Shelter project. The construction of this particular wall was unacceptable, and as such, was refused by this office. Upon recognizing our refusal of the installation, ALM Builders ordered the wall partially dismantled and reassembled. Their subcontractor obliged, but again, the final product was unacceptable. Discussions at this point to determine what corrective actions would satisfy the city's desires included representatives of ALM Builders, their assigned subcontractor, Shiely Masonry Products (the manufacturer of Keystone products), VanDoren Hazard Stallings, and myself. My position continued to be that the only action which would result in the city being satisfied would be for the wall to be completely removed and reassembled. At this point, all parties accepted this condition, but ALM 1 and their subcontractor were concerned that in using the same block, the outcome of the second installation would be the same. Therefore, it is recommended that in the interest of protecting the city, Change Order No. 3 be approved, allowing the new "zero off -set" block be purchased at a cost of $1150, approximately one -third the standard cost of this product. The city will absorb no charge for additional labor to remove and replace the wall. Contract changes reflected within this change order are summarized ' as follows: A. Substitute colored "zero offset" Keystone retaining wall as replacement to the inplace retaining wall block. ' A.L.M. Builders attached letter of April 16, 1993 indicates that they will replace the exiting inplace Keystone retaining wall block ' with "zero offset" block of the same color and texture. Further, the inplace block will become the property of the City of Chanhassen. We believe that A.L.M. Builder's price is fair and ' recommend approval. Following approval by the Chanhassen City Council, please provide the appropriate Owner signature and forward to A.L.M. Builders for ' processing. We feel there is no other way to obtain the 11 end result of the appearance that you want. Therefore, we will replace the wall with keystone straight face block. I These block are new and were not available last year Your cost for the new block will be $1150.00. There is no charge for additional labor to remove and replace the wall. Please I let Max know so he can initiate a change order. The existing block will become the City of Chanhassen's property. We will put them on pallets and set them in the parking lot.
