The plat included two riparian lots; Lot 9 and Lot 15. Lot 9 has been purchased by the Tidstroms and they are seeking to vacate one of the three drainage and utility easements recorded with the lot. This 1 lot is 3.86 acres in size and is vacant. I Access to this property is via a 50 easement that comes off of Chanhassen Hills Drive North and parallels Lot 10 (see Exhibit A). There are three drainage and utility easements that are recorded with this lot. One runs along the eastern property line, another runs along the I southern property line and the third splits the lot. The third easement is the one the applicant is requesting to vacate. Sewer and water are located in the easement that runs along the southern property line. Access to Lot 15 is through Lot 9, via this easement. A sewer line I is located in the easement along the eastern property line. When this subdivision was platted it was not determined where the utilities should be I located. Since the utilities have now been extended to this area of the subdivision. The vacation of the drainage and utility easement located in the center of the Lot 9, Block 1 of Chanhassen Hills 1st Addition will not adversely affect the development of this lot. The City of Chanhassen hereby vacates the following described drainage and utility 1 easement lying 10 feet on either side of the following described line. Commencing at the Northeast corner of the Northeast Quarter, Section 23, Township 116, Range 23, ' thence on an assumed bearing of South 88 degrees 11 minutes 35 seconds West, a distance of 245.00 feet; thence North 11 degrees 45 minutes 38 seconds west, a distance of 312.96 feet; thence North 88 degrees 11 minutes 35 seconds east, a distance of 10.29 1 feet to the point of beginning of said centerline to be described; thence continuing on the last described bearing, a distance of 306.83 feet and there terminating. ' WHEREAS, a public hearing was held on said petition on May 10, 1993; and WHEREAS, said public hearing was preceded by two weeks published and posted notice as required by Section 412.851 of Minnesota Statutes; and WHEREAS, there is no public interest to be served by the continued public ownership 1 of that portion of the above described easements.
