BOX 147 • CHANHASSEN, MINNESOTA 55317 I (612) 937 -1900 • FAX (612) 937 -5739 MEMORANDUM 1 TO: Charles Folch, City Engineer 1 FROM: Dave Hempel, Assistant City Engineer` DATE: April 29, 1993 1 SUBJ: Consider Vacation of Drainage and Utility Easements in Outlots B, C, D & E, WillowRidge - Project No. 91 -14 1 Staff has received an application and petition from Lundgren Bros., Inc. to vacate the drainage easements and drainage and utility easements in Outlots B, C, D and E, WillowRidge. This vacation request is the result of I an existing US West Communications easement that intersects the outlots in WillowRidge. Lundgren Bros. has recently received fmal plat approval for WillowRidge 2nd Addition which results in replatting of Outlots B, C, D and E, WillowRidge. The replatting of the outlots into WillowRidge 2nd Addition will restore the drainage and utility easements exactly as they were with the plat of WillowRidge Addition. I According to Lundgren Bros., the existing US West easement was recorded in 1956 which makes it superior to the street right -of -way and drainage and utility easements which were created over it when Lundgren Bros. I recorded the WillowRidge plat in 1992. Although the easement is no longer in service, US West Communications desires to retain this exclusive easement or an equivalent easement across the property. US West Communications is agreeable to having its easement removed but wishes to retain the priority that currently I exists. Lundgren Bros., Inc. has been working with US West Communications to relocate the proposed easement to an acceptable location to avoid conflicts with future house pads and drainage ponds. US West Communications has accepted the easement path shown on Attachment No. 1 and will release its old easement when Lundgren Bros. provides the replacement easement. Before the swap can occur, the existing drainage and 1 utility easements in the new easement's path must be vacated to preserve US West's priority. RECOMMENDATION 1 Staff recommends that the City Council adopt the following motion: 1 "The City Council approves vacation request No. 93-3 to vacate drainage easements and drainage and utility easements in Outlots B, C, D and E, WillowRidge." ktm I Attachments: 1. WHEREAS, a public hearing was held on said petition on May 10, 1993; and WHEREAS, said public hearing was preceded by two weeks published and posted notice as required by Section 412.851 of Minnesota Statutes; and WHEREAS, there is no public interest to be served by the continued public ownership of that portion of the above described easements.
