(Forcier Property) - Project No. 93 -6 -3
1 On February 22, 1993, the City Council authorized preparation of a feasibility study for
storm water improvements on Frontier Trail. Attached is a final draft of the feasibility
1 report previously authorized.
The feasibility study outlines a cost - sharing program between the City and the developer to
1 construct joint storm water improvements as a result of development on this parcel. It is
staff's intent for the City to enter into a joint construction agreement with the developer by
means of the development contract to reimburse the developer for oversizing of the storm
I drainage improvements. The agreement will be brought back before the City Council for
review and approval with the construction plans and development contract approval process.
1 The City has a unique opportunity here to essentially piggyback onto the developer's
proposed water quality and quantity improvements. This property is one of the last
I undeveloped parcels prior to discharging into Lotus Lake; therefore, it would be highly
advantageous for the City to prepare some sort of joint cooperative agreement with the
applicant to spell out cost - sharing percentages and construction and maintenance
1 responsibilities.
The feasibility study proposes both water quality and quantity improvements throughout the
I proposed subdivision. The estimated construction costs of these improvements for both the
City and developer is $32,800. On page 12 of the feasibility study is a breakdown of cost
sharing between the City and developer. The City's share for the storm water improvements
I is significantly less than what was originally anticipated by Bonestroo if the City was to go
out on its own and try and perform these same improvements as a public improvement
project.

RECOMMENDATION
It is therefore recommended that the City Council accept the feasibility report prepared by 1
Bonestroo dated April, 1993 for storm water quality and quantity improvements on Frontier
Trail (Forcier property), Project No. 93 -6 -3, and authorize preparation of a joint cooperative 1
agreement between the City and developer for the construction, maintenance and funding
of the storm water improvements as detailed in the feasibility study.
