This was a project made possible by cooperative funding from the Riley Purgatory Bluff Creek Watershed District. The District's contribution of up to $27,000 to pay for half of the cost of the bridge improved the quality of this public improvement project. The utilization of a bridge in lieu of a culvert crossing minimized disruption of the creek and provides a wonderful vantage point for trail users. You will be pleased to learn that the final cost of the bridge was $47,500, which includes engineering, construction, testing and inspection services. Detailed reports documenting these expenses are attached. This investment results in a cost to the District of $23,750, or $3,250 less than the maximum pledged. Please remit this amount to the City of Chanhassen, attention Todd Gerhardt, City Manager. In recognition of this cooperative effort, the Chanhassen City Council would like to host the District Managers and staff at a dedication ceremony later this fall. Please contact me to schedule a day and time that will prove convenient. We will invite community residents, our Park and Recreation Commission, staff, consultants, and the contractor for the unveiling of a dedication plaque to be affixed to the bridge foundation. In large part, the scoring is based upon information provided by your community in our recent housing surveys Part A and Part B. I am sending a copy of this letter and enclosure to both the city administrator/manager or township clerk and the person to whom the surveys were originally sent. In June, we mailed surveys asking communities to complete and return them by July 14. On July 18, we sent a follow up asking that the unreturned surveys be completed by August 1. On August 4, we began our process of determining preliminary scores from the information in the surveys. The enclosed score sheet indicates the preliminary points by criteria for your community. Points for criteria 1,2,3 and 5 are based on Council data compiled from information provided by state or county agencies, local government, HUD, MFHA and local HRAs. Scores for the remaining criteria are based on the information provided to the Council via the surveys. If we did not receive a completed survey or information was not provided for any survey question, the score for those applicable criteria will reflect this. If, after reviewing these scores you want to provide additional information in order to improve your score in any criterion, or you believe you should have received more points in any criterion given your answers, please send me the information or call me as soon as possible. Because applications for all three LCA funding accounts have been, or shortly will be, taken for this fall's funding rounds, and the housing performance scores will be a factor in those funding decisions, as well as those for TEA 21 transportation funding, I am setting a deadline of August 26, fbr receiving any additional information from which to revise your community's performance score. Itousing for special needs Municipalities are awarded up to three points for the following types of special housing within their jurisdiction: · Housing for which federal, state, county or local funds or those of a non-profit organization have been used to purchase and operate residential units or provide licensed housing that is not for the purposes of incarceration, but as a transitional placement of adult offenders or adjudicated delinquents · A publicly subsidized or non-profit group home licensed by the Department of Health or Department of Human Services which provides temporary or permanent housing for the physically handicapped, mentally ill, developmentally disabled or chemically dependent 6 cycle housing, or since 1996, has taken the initiative to revise its land use regulation and official controls to such a degree that these revisions can be shown to be permitting greater density and more frequent opportunity for reduced development costs than existed before 1996. Examples of these initiatives in the use of official controls include but are not limited to the following: · The use of a density bonus system, inclusionary housing requirements or some other innovative zoning approach · The use of variances, rezoning, special use or conditional permits or similar variations from the standards set forth in the community's zoning ordinance for the purpose of facilitating a specific affordable housing development. · A local initiative undertaken to revise local design requirements for public improvement that may reduce the cost of public services to residential properties. · Modifications in public services standards or requirements that might include streets, curbs, gutter, sewer and water hookups, street lighting and other required public improvements in order to reduce development costs to increase affordability in a new residential development. · A reduction of such standards as the required street right-of-way, or surfacing width or depth design for residential street, or the size of sewer or water service lines to new housing. Each local initiative is worth 3 points. No more than 6 points may be applicable to any one affordable or life-cycle housing development or preservation activity aided by these local regulative measures. 0 to 15 points 8. Initiatives regarding housing preservation and rehabilitation The municipality has in place and has in the previous two calendar years used and promoted locally-initiated or administered (city or county) housing preservation, home improvement and/or rehabilitation programs, or other tools available to its residents to keep their housing stock in sound condition. In addition to the conditions set forth in the agreement, the City Council is requiring that representatives of Axel's attend a "MADD Victims Impact Panel" meeting. These meetings are scheduled for every third Saturday of the month. I have enclosed a brochure explaining the panel and how to register. Additionally, the Council is also requiring that Axel's report back to them sometime in the next six to twelve months on the progress of your new policy concerning "internal monthly compliance checks." The Council would like you to provide them with the number of monthly in-store tests that are conducted using undercover decoys, along with the results, to ensure that Axel's is a carding all young people. CITY OF CHANHASSEN CARVER COUNTY, MINNESOTA IN RE: City of Chanhassen Liquor Licensing Complaint Against STIPULATION OF FACTS AND CIVIL SANCTION Charlie Rae Inc., d/b/a Axel's The City of Chanhassen, through its undersigned attorney, and Axel's, through its undersigned attorney, hereby agree and stipulate as follows: 1. Axel's Restaurant is licensed under Chanhassen City Code Chapter 10, Article II, to operate an on-sale liquor establishment at 560 West 78th Street in the City of Chanhassen, Minnesota. 2. On October 7, 2002, an employee of Axel's sold intoxicating liquor to an underage person on the licensed premises of Axel's in violation of Chanhassen City Code Section 10-47(a). The parties entered into a Stipulation of Facts and Civil Sanction concerning that violation which was approved by the Chanhassen City Council on January 13, 2003. 3. On June 6, 2003, an employee of Axel's allegedly sold intoxicating liquor to an underage person. The sheriff's report states: Whittenburg was the bartender who sold the liquor to the decoy. In Whittenburg's statement he told me that he asked the decoy for her identification, and the decoy told Whittenburg she did not have it, and would return to her car to get it. When the decoy got up to leave, Whittenburg asked the decoy how old she was and the decoy told 107464 1 Whittenburg twenty-one. Whittenburg then told the decoy it was okay to have the drink. 4. Section 10-36(b) of the Chanhassen City Code provides: Underage persons. If underage persons are used for compliance checks they shall not be guilty of unlawful possession of alcohol when such items are obtained as a part of a compliance check. No underage person used in compliance checks shall attempt to use a false identification misrepresenting the person's age, and all underage persons lawfully engaged in a compliance check shall answer all questions abut the person's age asked by the licensee or his or her employee and shall produce any identification for which he or she is asked. 5. The circumstances surrounding the June 6th sale justifies a departure from the presumptive civil penalties set forth in Section 10-40 of the Chanhassen City Code. 6. Axel's shall pay the City a civil penalty of $3,000 and shall donate $500 to MADD by September 1, 2003. 7. The penalty set forth in paragraph 6 above replaces the stayed suspension set forth in the Stipulation of Facts and Civil Sanction entered into concerning the October 7, 2002 sale. 8. For purposes of calculating possible further civil penalties the October 7, 2002 and June 6, 2003 sales shall be deemed combined and shall collectively be considered one violation. 9. Axel's waives its right to the hearing provided by Minnesota Statutes Section 340A.415 and Chanhassen City Code Section 10-39. 10. The civil sanction set forth in Section 6 is contingent upon the Chanhassen City Council's approval. If the City Council rejects the sanction agreed to in this Stipulation in favor of more severe sanctions, Axel's has the absolute right to withdraw this Stipulation and its waiver of hearing and to have a hearing before the City Council. 107464 2 /! ,2003.
