1 SUBJ: Animal Control Ordinance Amendment
1 The purpose of this memo is to request an amendment to the City Code permitting animal
control personnel to euthanize animals when necessary in the line of duty.
1 BACKGROUND
On rare occasions, animal personnel find it necessary to euthanize animals. This is only
1 done when an animal is presenting a risk to the safety of an animal control officer, or
another person, or when the animal is obviously mortally wounded or injured.
1 In reviewing our City Code and State Statutes, there exists no specific provision in either
source granting us the authority to dispatch animals. A recent situation in which one of our
officers was forced to euthanize an animal raised the question.
1 ANALYSIS
1 Because of the occasional necessity to act, it is necessary that we have the legal authority
to do so. This can be accomplished by simply amending the existing code. We have
1 consulted and worked with the Chanhassen Veterinary Clinic on this issue.
RECOMMENDATION -
It is the recommendation of staff that Chanhassen City Code Section 5 -74 be amended as
drafted.

AN ORDINANCE AMENDING CHAPTER 5, SECTION 5 -73
OF THE CHANHASSEN CITY CODE CONCERNING
THE EUTHANIZING OF ANIMALS
THE CITY COUNCIL OF THE CITY OF CHANHASSEN ORDAINS: 1
Section 1. Chapter 5, Section 5 -73, of the Chanhassen City Code is amended to
include:
Notwithstandin g any other provision herein, an animal control officer may

immediately kill any dog, cat, or other animal under the following circumstances:
the animal is reasonably believed to be diseased, vicious or dangerous
1) t y erous and g
cannot be impounded without substantial risk to the safety of the officer; or
2) the animal is reasonably believed to be mortally injured or diseased.
