CC SUM 2012 10 08 CHANHASSEN CITY COUNCIL REGULAR MEETING SUMMARY MINUTES OCTOBER 8, 2012 Mayor Furlong called the meeting to order at 7:05 p.m. The meeting was opened with the Pledge to the Flag. Approval of Minutes: -City Council Work Session Minutes dated September 24, 2012 -City Council Verbatim and Summary Minutes dated September 24, 2012 Receive Commission Minutes: -Planning Commission Verbatim and Summary Minutes dated September 18, 2012 b. Lakeside Outlot D: Approve Agreement with R.E.C., Inc. for Grading. All voted in favor and the motion carried unanimously with a vote of 5 to 0. VISITOR PRESENTATIONS. John Siegfried introduced himself as a county commissioner candidate in Precincts 4 and 5 of Chanhassen. Greg Fletcher, 7616 South Shore Drive, representing the Lotus Lake Conservation Alliance, made a public service announcement regarding their Don’t Move a Mussel flyers being distributed at area lakes. PUBLIC HEARING: CONSIDER RENAMING THE HILLTOP PARK SHELTER AT LAKE ANN PARK THE AL KLINGELHUTZ MEMORIAL PAVILION. Todd Hoffman reviewed the staff report and City’s policy statement regarding the naming or renaming of public facilities and infrastructure. Mayor Furlong opened the public hearing. Ron Roeser, 222 Chan View, speaking for the Chanhassen Historical Society and explaining he has been a life long friend, reviewed the tremendous contributions made by Al Klingelhutz in combining the city and township, acquisition of Lake Ann Park property, and serving on the City Council and County Commission. Al’s City Council Summary – October 8, 2012 daughter Claire Robling explained that their family would be very honored to have the pavilion named in their dad’s memory. Conrad Fiskness, 8033 Cheyenne Avenue explained his interaction with Al Klingelhutz while being on the Park and Recreation Commission during the acquisition and development of Lake Ann Park. Wendy Peterson-Biorn, Executive Director of the Carver County Historical Society and on behalf of the Carver County Historical Society, shared their support for the renaming of the Hilltop shelter to the Al Klingelhutz Memorial Pavilion. Councilwoman Ernst asked staff to explain the process and associated finances. Councilman Laufenburger moved, Councilwoman Ernst seconded that in recognition of Al Klingelhutz’s lifelong commitment to the betterment of Chanhassen and Carver County, and in recognition of the prominent role that he played in the acquisition and development of Lake Ann Park, the Chanhassen City Council approves the re-naming of the Lake Ann Park Hilltop Picnic Shelter to the Al Klingelhutz Memorial Pavilion.All voted in favor and the motion carried unanimously with a vote of 5 to 0. TH 620 WEST 96 STREET VARIANCE: REQUEST FOR VARIANCE FROM SECTION 20-904 OF THE CHANHASSEN CITY CODE TO ALLOW AN ACCESSORY STRUCTURE IN EXCESS OF 1,000 SQUARE FEET ON PROPERTY ZONED AGRICULTURAL ESTATE TH DISTRICT (A2); LOCATED AT 620 WEST 96 STREET; APPLICANT/OWNER: ANDREW & SHANNON RIEGERT. Kate Aanenson presented the staff report and Planning Commission update on this item. Councilman Laufenburger asked for clarification of the Planning Commission needing a super majority vote versus the City Council requiring a simple majority. Councilman McDonald asked about the size of accessory structures in the neighborhood, feedback from neighbors and enforcement in the future if a business is run out of this building. Mayor Furlong asked about the wetland, square foot requirement of accessory structures in different zoning districts, and enforcement before asking the applicant to speak. Andy Riegert reiterated that it is not his intention to run a business out of his home. After comments from council members and discussion on whether the 1,000 square foot accessory structure limitation should be revisited by staff and council, the following motion was made. Councilman McDonald moved, Councilwoman Ernst seconded that the Chanhassen City Council approves Planning Case #2012-10 for a 1,560 square foot accessory structure variance from the 1,000 square foot accessory structure limitation to allow for a 2,560 square foot accessory structure, subject to the following conditions and adoption of the attached Planning Commission Findings of Fact, revising the numbers accordingly: 1. The accessory structure will require a building permit. 2. The accessory structure must comply with Minnesota State Building Code. 3. Outdoor storage must comply with City Code. 4. The accessory structure may not be used for the purpose of a home occupation as defined in the Chanhassen City Code. All voted in favor and the motion carried unanimously with a vote of 5 to 0.
