1 This is the public hearing on the feasibility study for the Upper Bluff Creek Trunk Utility Improvement Project -
Phase II, Project No. 91 -17B. This project was petitioned by three land owners /developers (Carlson,
O'Shaughnessy and Gateway West /Opus) who either own or have secured development rights for the majority
I of the property potentially benefitting from this improvement project. An informational neighborhood meeting
concerning this project feasibility study was held on Tuesday, June 8, 1993.
I The estimated project cost including legal, administrative, engineering and interest costs is estimated to be
approximately $1.5 million. Special assessments to benefitting properties for these trunk utility improvements
have been previously established by the City Council at $970 per unit for trunk sanitary sewer and $1 275 •er
unit for trunk watermain. Lateral benefit assessments are a so proposes w ere app ca. e. onsistent with past
I pott on semi ar projects, non - developing parcels 10 acres or less in size with an existing dwelling are proposed
to be assessed for one trunk sewer and water assessment. Non - developing parcels with an existing dwelling
greater than 10 acres in size would be assessed one trunk sanitary sewer and watermain assessment for every
I 10 -acre increment in size. At such time in the future that development would occur to these properties, the
remaining trunk unit assessments would then be collected.
I At the conclusion of the public hearing, if there are no further outstanding questions or issues that need to be
addressed, it is recommended that the City Council approve the feasibility study for the Upper Bluff Creek Trunk
Utility Project No. 91 -17B and authorize the preparation of project plans and specifications.

Henry Wrase, or his representative Scott Bertas, will be present on Monday evening. Mr. Wrase
1 recognizes that at some point in time a water tower will be built in the vicinity of his property.
His property is the front side of the hill south of Highway 5 and east of Highway 41. His
position is that the feasibility study should be modified so as to recognize the construction of a
1 water tower on his property when such would occur in approximately six to ten years. As Mr.
Wrase worked for the city for approximately 20 years, I felt uncomfortable in being the one to
analyze whether the water tower should be located on the Wrase property or some other portion
of the hill, i.e. incorporated as part of the Opus plat. The following represents the city attorney's
position after considering positions presented by Mr. Wrase:
Planning Perspectives: The water tower can be located on either the Wrase or Opus
properties. Aesthetically, it probably would have less visual impact on the Opus property.
From a long term planning standpoint, there are merits to having the tower on the Wrase
1 property;
1 - Fiscal Considerations: Requiring Opus to dedicate a portion of their property for the
water tower is not an unreasonable condition. Some form of compensation may be
debatable, but such would be relatively minor if considered at all. By contrast, the Wrase
property would minimally be $150,000;
- Legal Considerations: Offering Mr. Wrase a life estate, recognizing that the water tower
1 will not be constructed for several years, at a reasonable price would probably represent
the best of all worlds. However, Mr. Wrase has stated that he will not consider that as
an alternative. An appraisal has been completed of the Wrase property and Mr. Wrase
1 currently wants approximately 50% more than the appraised value. This office would
therefore anticipate that any form of condemnation would become relatively ugly. By

contrast, the Opus requirement of us to dedicate a portion of their property for the water

tower can reasonably be upheld.
Based on the above considerations, this office would recommend that the water tower location
be selected by the engineers somewhere on the Opus property and incorporated as a part of the
platting for that property."

Manager's Comments: The Wrase property will slowly be engulfed by industrial users on all
sides. It's value as a residential lot will continue to diminish. In the short term (next 5 -10
years), bypassers will wonder who permitted a house in the middle of an industrial park. In the
long term, the property might be developed as a quasi - commercial use.
I agree with the attorney's position; however, as the platting process moves forward for Opus,
they should be encouraged to incorporate the Wrase property into their development plan.
Authorizing the Upper Bluff Creek Utility extension and authorizing plans and specifications is
recommended.

Notice is hereby given that a public hearing has been scheduled for public discussion on the
Upper Bluff Creek District - Phase II Utilities Feasibility Study at the City Council's regular
meeting on Monday, June 14, 1993 at 7:30 p.m. in the Council Chambers located at City
Hall, 690 Coulter Drive. The project deals with the construction of trunk sanitary sewer and
watermain facilities to serve part of Section 16 (south of Highway 5 and east of Highway 41)
and interconnect watermain along Galpin Boulevard. The total project cost of said
improvements is estimated to be approximately $1,457,800. Said improvements are being
financed by special assessments to benefitting properties.
A copy of the feasibility study showing the project scope and costs is available for review in
the Engineering Department Monday through Friday from 8:00 a.m. to 4:30 p.m. Residents
are also invited to attend an informal neighborhood meeting on Tuesday, June 8, 1993, at
7:00 p.m. in the Council Chambers of City Hall to discuss the feasibility study. t
All persons interested may appear and be heard at said time and place.

_' Attached is the completed feasibility study for Phase II of the Upper Bluff Creek trunk
utility improvements. You may recall that this project was petitioned by three land
I owners /developers (Carlson, O'Shaughnessy and Gateway West /Opus) who either own or
have secured development rights for the majority of the property potentially benefitting from
this improvement project.
1 The Upper Bluff Creek Phase II program proposes to extend sanitary sewer north along
Galpin Boulevard from its current terminus with Phase 1 at the Stone Creek subdivision and
I extend north along Galpin Boulevard to a proposed lift station located near the City
cemetery then crossing County Road 17 (Galpin Boulevard) and extending west
northwesterly through the O'Shaughnessy and Gateway West properties. Trunk watermain
I is proposed to be extended from two locations on County Road 17 (Galpin Boulevard). The
northerly connection will be made with the trunk watermain improvement Project No. 92 -5
and extended south along Galpin Boulevard crossing Trunk Highway 5 to make a
1 connection with current Phase I trunk watermain terminus located in the Stone Creek
subdivision, thus completing the loop. This trunk watermain will also be extended west
through the O'Shaughnessy and Gateway West properties and then extended north along
1 Trunk Highway 41 to Trunk Highway 5.

At this time it is staff's recommendation that the City Council formally receive the feasibility I
report for Phase II of the Upper Bluff Creek Trunk Utility Improvement Project No. 91 -17B
and call for a public hearing on Monday, June 14, 1993. During the interim, a
neighborhood meeting will be held with the property owners potentially affected by this

improvement project.

I The City has recently received formal petitions from two property owners, Carlson and
O'Shaughnessy, and one developer, Opus Corporation, requesting the extension of trunk
utilities described as Phase II of the Upper Bluff Creek Trunk Utility Improvement Project
I No. 91 -17B. The proposed improvements would begin at the current terminus for the Phase
I improvements which are scheduled to be completed in 1993, and extend north along
Galpin Boulevard then west through the O'Shaughnessy property and extending into the
I proposed Gateway West Business Park development. The estimated cost to prepare this
feasibility is $7,200. Consistent with the City's policy on similar projects in the past, it is
proposed that the developers secure the cost of preparing this study in the form of cash
I escrow or letter of credit. Given that this project has multiple petitioners involved, it would
seem reasonable to have them share in securing the cost for the study based on a
proportionate share of land area involved. If and when the project is ordered, the secured
1 monies will be returned or applied toward project assessments accordingly.
Following discussions at the last City Council meeting concerning potential development
1 along the Trunk Highway 5 corridor, it became quite clear that the Council would prefer
to have the Trunk Highway 5 Corridor Task Force Study completed and approved prior to
committing to development proposals which would potentially affect the Trunk Highway 5
corridor. It is expected that this corridor study would not be completed for another 6 to 8
months. While it may not be appropriate to order this project until the findings of the
corridor study are known, completing the feasibility study to identify specific elements would
1 allow the preliminary work to be completed.
It is therefore recommended that the City Council authorize the preparation of the
I feasibility study for Phase II of the Upper Bluff Creek Trunk Utility Improvement Project
No. 91 -17B conditioned upon the City receiving security in the amount of $7,200 in the form

As requested, we have reviewed the necessary utility extensions to service the area West of 1
Galpin Boulevard and South of Highway 5. With the receipt (or anticipation of receipt) of
petitions from the Carlson, O'Shaughnessy, and OPUS properties, the feasibility of I
completing the next phase of the Upper Bluff Creek District Utilities becomes more
possible from a revenue standpoint.
I have taken a brief look at the utilities required to service the area and the possible 1
assessments from the improvements. The attached figures show the sewer and water
extension proposed (indicated by hatch markings). The estimated improvement costs would 1
be $450,000 for sanitary sewer and $910,000 for water main. The estimated trunk
assessments for the three properties would be approximately $1,600,000 total. Additional
lateral benefit assessments will also be appropriate. It appears at this point that the project 1
would generate a positive cash flow. However, the proposed improvements do not include
an additional well and water tower that will be required as demand increases.
Based on the above PP
scope and an approximate construction cost of $1,050,000, a feasibility 1
report could be completed for approximately $7,200. The costs for the report would be
credited towards the plans and specifications design fee if the project proceeds. The report 1
could be presented approximately 6 weeks after being ordered and the hearing could be
held approximately 10 weeks after being ordered.
