2a. Assessment Hearing for Minnewashta Pkwy CITY OF CHANHASSEN 690 COULTER DRIVE • P.O. BOX 147 • CHANHASSEN, MINNESOTA 55317 (612) 937 -1900 • FAX (612) 937 -5739 MEMORANDUM TO: Don Ashworth, City Manager ' FROM: Charles Folch, City Engineer/Director of Public Works DATE: September 7, 1993 1 SUBJ: Call Assessment Hearing Date for Minnewashta Parkway - Project No. 90 -15 ' This improvement project extended from Trunk Highway 7 south to Trunk Highway 5 and consisted of the reconstruction of the roadway to an urban section with concrete curb and gutter, storm sewer, walkway/path and street lighting. To date, all of the proposed improvements have been completed with the exception of the trail, tree planting and boulevard restoration. Much of this work has been delayed due to the unseasonably cool and wetter 1 weather this summer and coordination with changing the overhead electrical power service to underground. The latest project schedule calls for the trail paving to begin within the next 30 days. ' The project costs are currently being compiled and will include the remaining work items to be completed over the next few weeks. The lead time for calling a public hearing and providing the subsequent notification to all property owners and local newspaper take approximately 1 month between Council meetings. Therefore, in order to schedule an assessment hearing on this project at the Council's regular meeting on Monday, October 11, 1993, the City Council would need to formally call the public hearing at their regular meeting on Monday, September 13, 1993. It should be noted that all project assessments must be certified to Carver County by November 30, 1993 following a 30 -day prepayment period. Therefore, it is imperative that the assessment hearing be scheduled for the October 11, 1993 meeting. Although a formal assessment roll will not be available for distribution to the Council for a couple more weeks, preliminary indications are that the project assessable costs will be very close to the $760 per unit assessment predicted in the feasibility study. 1 Staff will provide the Council with the revised assessment roll as soon as it is available in the next few weeks prior to the assessment hearing. The project consultant engineer, Bill Engelhardt of Engelhardt & Associates, will be on ' hand the night of the assessment hearing to give a formal presentation of the assessment roll. No action is required by the City Council at this time concerning this project other than to call for an assessment hearing on the project. It is therefore recommended that the City call for the assessment hearing on the Minnewashta Parkway Improvement Project No. 90 -15 for their regular meeting on Monday, October 11, 1993. 1 ktm Attachments: 1. This time schedule yields approximately two months to complete all the remaining work, ' final the project and administrate the required assessment roll and property owner notification. Enclosed you will find a sample copy of the City's standard assessment notice. Please revise this sample notice accordingly, use a 71/2% interest rate for a term of 8 years and prepare a statement for each affected property owner. City ' Treasurer Jean Meuwissen has informed me that she has a number of changes and updates to the property list. Please contact her to get the information. The notices and assessment roll should be returned to the City by no later than September 22, 1993. City staff will then mail the notices. Also enclosed is a sample copy of.the 1 notice of public hearing on assessments to be published in the City's official newspaper. Please revise this notice accordingly and return to the City for publication by no later than September 22, 1993. We have attempted to address each property owner's questions and have attached a summary of the questions raised. In general, the questions and concerns focused on six (6) major issues. 1 1. Safety. 2. Proposed new road width. 3. Walkway. 4. Project environmental concerns /drainage. 5. Cost. 6. Funding of the project. Following is clarification of the six issues. 1. SAFETY: 1 Minnewashta Parkway is deficient in every category of design for a safe roadway. These include: 1 a. Sight distances. b. Roadway width. c. Vertical alignment. d. Horizontal alignment. e. Poor slopes and alignment of access points onto major arterial highways. 1 / - 11 City of Chanhassen July 19, 1991 Page 2 f. No shoulder areas. g. Clear zones. h. Structural strength of the roadway. • 1. No separation of pedestrian and vehicle traffic. 2. PROPOSED NEW ROADWAY WIDTH: The new width proposed as part of the reconstruction is 32 feet, back of curb to back of curb. 'The existing right -of- way is 66 feet which allows for the new construction to take place within this area. The existing width ranges from 28 feet in most areas to 22 feet at the most southern end of the project. The new design width adds six inches (6 ") of bituminous to the present edge and 18 inches of gutter line. • In most areas the new width does not encroach on manicured lawn areas. The reduced width keeps tree clearing to a minimum. Replacement trees are included as part of the project. 1 Pedestrian separation is provided by the use of barrier curbs and boulevards wherever possible. The proposed walkway is 6 -feet in width and in conjunction the maximum • boulevard results in a total construction width of 43 feet. ' 3. WALKWAY: The proposed walkway, as aforementioned, is 6 -feet in width. Construction of a walkway alone is not recommended. Without a clear, defined separation as barrier curb, vehicles could directly access the walkway. Future reconstruction of the roadway along with drainage facilities will require removal ' of any walkway constructed alone. The cost of the walkway is estimated at 10 -20 percent less ' if bid with the overall project where State Aid funds will provide funding for any retaining walls, tree removal, and tree replacement. ' 4. DRAINAGE AND STORM SEWER FACILITIES: • ' Present drainage patterns do not provide for any erosion control or storm water treatment. Uncontrolled drainage to ditches increases erosion in heavy storms. 1 City of Chanhassen 1 July 19, 1991 Page 3 Uncontrolled drainage to ditches results in contamination throughout the entire street length from vehicles, salt and sand, snow and ice removal, and from lawn weed control or fertilizers. . Curb and gutter and storm sewer control drainage from streets and adjacent areas and convey storm water to retention ponds where heavier particles settle out and floating material can be skimmed from the storm water before the water is discharged. In addition, the rate of discharge can be regulated and controlled. The City is presently undertaking a storm water management 1 program for the entire city. This area will require work in the future, even if the street is not reconstructed. The he proposed design will require• app the watershed district, and will conform to all state and locale • regulations. 5. COST: The estimated project cost to the original study was $2,112,738. This includes a reduction of approximately $100,000 due to reducing the road width from 36 feet to 32 feet. Shifting of the walkway from the east side of the road to the west in the area between Highway 7 and Kings Point Road will result in an additional cost reduction of $95,000. Therefore, the estimated project cost is II $2,017,738. ' 6. FUNDING: 1 Funding for this project will be provided by four sources. 1. Municipal State Aid Street Funds. ' 2. General Obligation Bonds. 3. Special Assessments. 4. Trunk Water Funds. MINNESOTA STATE AID STREET FUNDS: The City of Chanhassen has an annual allotment of $274,378. This amount will increase each year and is estimated at $323,000 for future years. The annual allotment of M.S.A.S. funds depends on population and future needed road construction dollars. It should be made very clear that the money not unencumbered for M.S.A.S. projects could 1 reduce the city's construction dollar allotment. This money must be used on only municipal State Aid streets as designated by the city and approved by MnDOT. GENERAL OBLIGATION FUNDS: U DS. 1 General Obligation Funds will be used for various items of the project including storm sewer and walkway construction. This is in keeping with past policy for projects previously 1 undertaken. SPECIAL ASSESSMENTS: 1 The proposed assessment for this project is $1,230 at an interest rate of 8% over eight years. The annual cost will 1 be $256 the first year, reduced to $165 in.the last year. Raw land is calculated at 1.8 units per acre after reductions for wetlands and streets. Developers submitted 1 sketch plans for several areas where previous discussions have been held with the city by developers or property owners to determine units of assessment. 1 The City Council has requested an additional one year of M.S.A.S. funds be applied to this project. The net affect will be a reduction in the assessments to $758.53 per unit. 1 This amount meets State Statue 429 (Public Improvements Project) requirements of a minimum assessment of 20% of the total project costs. The present M.S.A.S. fund balance, including 1991 funds plus 2.5 years of encumbered funds, 1 will provide the financing of the project along with special assessments, General Obligation Bonds, and trunk water funds. TRUNK WATER FUNDS: Trunk water funds will be used for realignment of watermain to accommodate construction. 1 1 City of Chanhassen 1 July 19, 1991 Page 5 Total Project Cost $2,017,738 General Obligation <- $ 478,000 > $1,539,738 1 Trunk Water <- $ 26,000 > $1,513,738 - 1 Special Assessment at 20% Level <- $ 403,788 > $1,109,950 1 M.S.A.S.
