SUBJ: Assessment Hearing for Upper Bluff Creek Trunk Utility Improvements - Phase I, Project No. 91 -17A
This project consisted of the installation of trunk sanitary sewer from the Lake Ann trunk system near County Road
17 (Powers Boulevard) and extending west along the future Lake Drive West alignment to Audubon Road, then
south along Audubon Road to a lift station located at the intersection with Lyman Boulevard. The trunk sewer line
was then extended west along Lyman Boulevard to County Road 117, then north along Bluff Creek to the crossing
of the Twin Cities & Western Railroad tracks and then again extending west through the Stone Creek development
to Galpin Boulevard. Trunk watermain was extended south along Audubon Road down to Lyman Boulevard and
also west through the proposed Chanhassen Business Center and Stone Creek First Addition, terminating at Galpin
1 Boulevard. Attached to this staff report is the project assessment roll and location map.
The area trunk sanitary sewer assessment charge of $970 and trunk watermain assessment charge of $1,275 per
residential equivalent unit (REU), as previously established for the Bluff Creek utility service area, have been
implemented in the assessment roll. Lateral assessment benefit for the trunk sanitary sewer has been established at
$26 per assessable foot. Residential lateral watermain benefit from the trunk line is $15 per assessable foot with
commercial/industrial at $22 per assessable foot. As previously discussed and agreed upon at the feasibility hearing,
the large -lot residential homesteaded properties that are not slated for development at this time would be assessed
1 unit of trunk watermain and 1 unit of trunk sanitary sewer benefit per 10 -acre increment of land initially with the
future units being collected at such time that the property would be subdivided. Two homesteaded properties in the
' assessment roll are listed under "green acre" status for 1993 and the corresponding assessments will be paid as "hook
up" charges in the future when "green acre" status is removed and/or subdivision occurs. The assessment roll also
incorporates an agreement resulting from previous easement negotiations with Mr. Charles Mattson and the Audubon
' 92 Partnership whereby the assessment levied against these properties would be deferred until 1995.
It is therefore recommended that the City Council adopt the assessment roll for the Upper Bluff Creek Trunk Utility
Improvements - Phase I, Project No. 91 -17A dated August 25, 1993 with an assessment term payback of 10 years
at an 8% interest rate.

UPPER BLUFF CREEK DISTRICT - PHASE I
CITY PROJECT NO. 91 -17A
NOTICE IS HEREBY GIVEN that the Chanhassen City Council will meet at 7:30
p.m. on Monday, September 13, 1993 at the City Hall Council Chambers to pass upon the
proposed assessment for the Upper Bluff Creek Utility District - Phase I, City Project No.
91 -17A. Abutting properties and those properties deriving benefit from this project are
proposed to be assessed. The easement area includes:
Portions of the SW of Section 14, the S1 of Section 15, and the NV2 of Section 22
described as the Phase I assessment area in previous hearings. The general area is the area
north and south of the Twin Cities & Western Railroad between Galpin Boulevard and
Powers Boulevard and the area north of Lyman Boulevard bounded by Gaipin Boulevard

and 1,000 feet east of Audubon Road. Specific properties to be assessed include the
following parcels:

The proposed assessment is on file for public inspection in the office of the City 1
Engineer. The total amount of the proposed assessment is $2,530,423. Written and oral
objections will be considered at the meeting, but the Council may consider any objections
to the amount of a proposed individual assessment at an adjourned meeting upon such
further notice to the affected property owners as it deems advisable.
An owner may appeal an assessment to the District Court pursuant to Minnesota
Statute Section 429.081 by serving notice of the appeal upon the Mayor or City Clerk of the
City of Chanhassen within thirty (30) days after the adoption of the assessment and filing
such notice with the District Count within ten (10) days after service upon the Mayor or City
Clerk. No appeal may be taken as to the amount of any assessment adopted unless a
WRITI EN NOTICE signed by the affected property owner is filed with the City Clerk prior
to the assessment hearing or presented to the presiding officer at the hearing.
Residents who are 65 years of age or older, or retired by reason of permanent and 1
total disability may apply to have payment of the assessment deferred. The application shall
be made to the City Clerk within thirty (30) days after the adoption of the assessment roll
by the City Council. 1
