SUBJ: Vacation of a Drainage Easement within the Plat of Ithilien
1 Project No. 92 -13
1 Earlier this spring, Mr. Kerry Meagher of Carver County Abstract and Title Company contacted
the City regarding an existing drainage easement that was conveyed by the previous property
owners, the Johnsons. The Johnsons now live a 1275 Lilac Lane which is immediately adjacent
1 to the plat of Ithilien. Apparently the drainage easement conveyed by the Johnsons over what
is now called the plat of Ithilien was conveyed erroneously. In an attempt to rectify the situation
and clear the title problems this easement has created, the City is proposing to vacate the
I previously dedicated easement. Staff recommends vacating this easement since the plat of
Ithilien has dedicated the appropriate drainage easement required by the City.
1 Therefore it is recommended that the City Council approve the vacation of that certain drainage
easement dated December 12, 1990, recorded at Carver County on December 28, 1990 as
I Abstract No. 120554 and legally described on the attached resolution.

of the Ithilien plat, enclosed please find resolution vacating the
drainage easement at abstract entry 91. Also enclosed for your

and 93.
' If the resolution is acceptable to the City, please have it
placed on the next City Council agenda for approval. Thereafter,
please forward a certified copy of the resolution to this office
for recording with the County.

This letter is a follow -up of our conversation of last week. Enclosed is a copy
of the plat of Ithilien, and abstract entries 90, 91, 92, 93. Entry No. 90
indicates the interest of the Johnson's, who were strangers to the record title
of the plat. It indicates the Johnson's owned the property which is immediately
to the North and East of the plat. The Johnson's erroneously granted easements
to the City of Chanhassen in some of the other abstract entries which are
enclosed. Entry No. 91 has the correct record owner of the plat of Ithilien when
the easements were granted. I believe all of the easements granted in 91, 92
and 93 were dedicated in the plat of Ithilien and can now be released.

RESOLUTION VACATING EASEMENT
' WHEREAS, pursuant to Minnesota Statutes § 412.851, the
Chanhassen City Council has conducted a public hearing preceded by
two (2) weeks published and posted notice to consider the vacation
of that certain drainage easement dated December 12, 1990, recorded
with Carver County on December 28, 1990, as Abstract Document No.
120554, and legally described as follows:
The part of the north 40 rods of the west 40.00 rods of the
Northeast Quarter of the Northwest Quarter of Section 2,
' Township 116, Range 23, described as follows:
Commencing at the northeast corner of said north 40.00 rods of
the west 40.00 rods of the Northeast Quarter of the Northwest
Quarter; thence South 0° 44' 10" West, assumed bearing, along
the east line of said West 40.00 rods of the Northeast Quarter
of the Northwest Quarter, a distance of 395.05 feet; thence
' North 89° 15' 50" West a distance of 27.00 feet to the point
of beginning of the easement to be described; thence North 81°
24' 15" West a distance of 144.84 feet; thence South 71° 45'
00" West a distance of 134.00 feet; thence South 9° 45' 00"
West a distance of 152.00 feet; thence South 79° 05' 00" East
a distance of 250.00 feet; thence North 19° 41' 59" East a
distance of 147.53 feet; thence North 00° 44' 10" East a
' distance of 78.57 feet to the point of beginning;
and
WHEREAS, it appears that it is in the public interest to
vacate the easement.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Chanhassen:
' 1. The above described easement is hereby vacated.
2. The City Clerk is directed to file a certified copy of
this Resolution with the County Auditor and County
Recorder in and for Carver County, Minnesota.
