By now it is well known that the Chaska sewage treatment facility has a capacity problem
I for which a study on long -term solutions is being conducted. The Metropolitan Council and
the Metropolitan Waste Control Commission (MWCC) have recently commissioned a
consultant to study three potential options to remedy this situation. The fast option involves
I expansion at the existing treatment plant, the second involves locating a new site for the
treatment plant, and the third and final alternative involves the elimination of the Chaska
plant and the construction of an interceptor system which would follow the new Trunk
I Highway 101 alignment south of Shakopee and route flow back to the Blue Lake treatment
facility. The latter is the most probable option to result, however, the MWCC, Metropolitan
Council and the City of Chaska need to find some interim solutions to serve Chaska for at
least five years to allow time for the planning, design and construction of a permanent
solution. -
' The recently approved Upper Bluff Creek trunk utility program in Chanhassen will site a
major lift station near the intersection of Audubon Road and Lyman Boulevard. The City .
of Chaska is very much interested in being able to construct a sewer trunk line to this lift
I station and acquire interim flow capacity through Chanhassen's new trunk line to the Lake
Ann Interceptor. The concept of the MWCC and municipalities sharing intercommunity
I flow is not new. The City currently has cooperative agreements which allow for portions of
Chanhassen's sewer flow to be directed to Excelsior and Eden Prairie. Studies have shown
that the unit costs of construction to provide for a million gallons of capacity is substantially
less in the cost sharing of an interceptor versus the individual community building a local

trunk system. With these lower unit costs of capacity, both the MWCC and local
communities served benefit.

A potentially similar situation exists between the MWCC, Chaska and Chanhassen for the
Upper Bluff Creek system whereby an annual rental fee based on the capital cost and the
design life of the system and an annual operation and maintenance share of the system
' would be paid by the MWCC to Chanhassen. The proposed Upper Bluff Creek trunk
system could provide approximately 5 years of flow capacity for Chaska until the year 1999.
A system oversizing could also be implemented to provide this interim capacity through the
1 year 2002.
While the benefit to the MWCC and Chaska in providing and interim solution is obvious,
' the benefits to Chanhassen may not be. With a joint powers agreement such as this,
Chanhassen would be reimbursed for a share of the cost of construction, system depreciation
and annual operation maintenance expenses; however, an underlying benefit involves a
' cooperative effort which will likely result in a more cost - effective solution to serve the lower
Bluff Creek area in Chanhassen. Regardless of which alternative the MWCC and the City
of Chaska select to solve the long -term capacity problem for the City of Chaska, it is the
Chanhassen's request that the solution provide design capacity for the lower Bluff Creek
area which could be served from the south by gravity lines. This would eliminate the need
for some future lift stations and forcemains and reduce the ultimate size and design capacity
' of lift stations currently being proposed within the MUSA area which would otherwise need
to carry future flow from the lower Bluff Creek area. In effect, this overall effort is likely
to be a win /win situation for all parties involved.
The attached joint powers agreement is consistent with the methodology implemented on
the Red Rock -Lake Ann Interceptor Joint Powers Agreement. It is therefore recommended
1 that the Joint Powers Agreement between the MWCC, Chaska and Chanhassen for
intercommunity flow be approved.

This office has been involved in each of the meetings leading to the agreement presented in this

packet. Charles has done an excellent job of reducing the myriad of paper work that has been
generated into a salient report. I agree with Charles' conclusion, and would recommend approval
of the Joint Powers Agreement between Chaska, Chanhassen, MWCC, and the Metropolitan
Council. However, I would see such being contingent upon:
Reinforcing Interim Status: The Metropolitan Council has not had a good track record
of aggressively seeking long term solutions to sewer problems. The best example is the
Lake Ann Interceptor which was continuously delayed by the Metropolitan Council from
the mid -1960s until its final construction in the mid- 1980s. Chanhassen cannot allow
Chaska to use our capacity for a similar 20 year period. We need to reinforce, through
whatever means necessary, that this is an interim solution, and that the
MWCC/Metropolitan Council will aggressively pursue any of the three long term
solutions outlined in the City Engineer's report. '
This office would propose to reinforce the above points via cover letters to the MWCC,
Metropolitan Council, and our Metropolitan Council/MWCC representatives which
reinforces Chanhassen's two primary concerns: 1) that this is an interim agreement
whereby using Chanhassen's current excess sewer capacity is solely a temporary condition
which will cease within a five to ten year period; and 2) that Chanhassen is entering into 1
this agreement believing that MWCC/Metropolitan Council/Chaska will aggressively seek
a long term solution for both Chaska's long term sanitary sewer needs as well as the long
term needs of southern Chanhassen. I would further reinforce these points through a joint
powers agreement with the City of Chaska (next section).
Joint Powers Agreement, Sanitary Sewer Services, Chanhassen/Chaska: The Joint Powers 1
Agreement between the MWCC, Chaska and Chanhassen addresses more of the metro -
wide or "big picture" issues; however, this is an opportunity for Chanhassen to address

some on -going local service issues on property north of West 82nd Street and east and
1 west of Trunk Highway 41, the Holasek property located south of Lyman Boulevard and
west of Galpin Boulevard and property located along Stoughton Avenue. Therefore, it
is recommended that approval should also be contingent upon the City of Chaska entering
into a joint powers agreement with the City of Chanhassen which will: 1) Reiterate
sections of the multi- agency agreement dealing with the recognition that this is an
interim solution, and reiterating their support for cost sharing formulas and joint usage
of the proposed Hazeltine Interceptor - -such being similar to the joint powers agreement
for the construction of the Red Rock Interceptor (Eden Prairie), and Lake Ann Interceptor
' (Chanhassen); 2) Chaska's agreement to allow the Gedney Pickle processing facility in
Chanhassen to continue to utilize the Chaska Interceptor system, with a cost and use basis
similar to that which has existed for the past 20 years; 3) That the City of Chaska would
' permit a future development(s) north of West 82nd Street and east of Highway 41 which
can be served by gravity to connect to Chaska's sewer and water utilities; 4) That the
City of Chaska would permit a future development(s) north of West 82nd Street and west
' of Highway 41 to connect to Chaska's water and sewer utilities; and 5) That the City of
Chaska would permit future development of the Holasek property located south of Lyman
Boulevard and west of Galpin Boulevard which can be served by gravity to connect to
Chaska's sewer and water utilities.
This office would see the above points being addressed through a separate joint powers
agreement between Chaska and Chanhassen. However, this should be seen as an addendum to
the primary agreement between MWCC, Metropolitan Council, Chaska and Chanhassen, and as
a condition of approval of the multi- agency agreement.

THIS AGREEMENT, made and entered into this 21st day of JULY, 1
1992, by and between the Metropolitan Waste Control Commission, a
legally constituted Metropolitan Commission organized pursuant to 1
Minnesota laws, 1975 Chapter 13, Minnesota Statutes, Section
471.503, hereinafter referred to as "Commission ", the Metropolitan
Council, a political subdivision under the laws of the State of
Minnesota, hereinafter referred to as "Council ", the City of
Chanhassen, a municipal corporation organized under the laws of the 1
State of Minnesota, hereinafter referred to as "Chanhassen ", and
the City of Chaska, a municipal corporation organized under the
laws of the State of Minnesota, hereinafter referred to as
"Chaska "; WITNESSETH:

RECITALS 1
The Commission has assumed ownership of all interceptors and
treatment works in Minneapolis /St. Paul metropolitan area needed to
implement the Metropolitan Council's Comprehensive Plan for 1
collection, treatment and disposal of sewerage in the metropolitan 1
area as determined by the Council.

' The Commission presently provides sewerage treatment to Chaska
from the Chaska Wastewater Treatment facility which is nearing
' capacity. The Commission provides service to Chanhassen through
' the Lake Ann Interceptor which conveys flow to the Commission's
Blue Lake Treatment Facility.
The parties hereto are desirous of entering of this agreement
' to provide for a temporary diversion of up to one million gallons
' per day (mgd) of wastewater flows from the Chaska wastewater
treatment service area to the Blue Lake Treatment Plant through
' cooperative efforts of the parties and to provide for the
contamination of the provision of additional treatment capacity to
' the Chaska /Chanhassen sewer areas.
NOW, THEREFORE, in consideration of the mutual covenants and
' conditions hereinafter contained, it is agreed by and between the
parties hereto as follows:
1 Section 1. Interceptor Construction. Chaska agrees to
construct a lift station /forcemain generally consistent with the
1 Concept Plan identified in Exhibit A diverting up to 1.0 mgd
1 average flow from the Chaska sewer service territory to a lift
station located in and owned by Chanhassen. The Commission agrees
' to lease the Chaska lift station from the city for $750,000 that

will be paid in five yearly installments. The Commission will also
reimburse Chaska on December 1st of each calendar year for the 1
operation and maintenance costs of the interim lift station/
forcemain until the lift station is no longer necessary. Chaska
shall submit to the Commission, by November lst of each year, the
costs for operation and maintenance of the lift station.

Chaska agrees not to proceed with design or construction of the
interim lift station /forcemain until directed in writing to do so
by the Commission's Chief Administrator. 1
Section 2. Use Permitted and Cost of Treatment,. Chanhassen
agrees that during the period from October 1, 1992, through 1
December 31, 2000, and during any period for which this contract is
renewed as provided in Section 7, the Commission may cause sewerage 1
of up to 1.0 mgd average flows originating in the Chaska sewage
treatment area to be discharged into and through the lift 1
station /forcemain owned and operated by Chanhassen. Chanhassen 1
shall continue to own its lift station /forcemain facility. The
sewerage flow discharged through the lift station /interceptor and
originating in Chaska sewer service area shall not be included in
Chanhassen's annual flow allocation nor shall Chanhassen be charged 1
by the Commission for said flows. The Commission will meter the
actual flows diverted from the Chaska territory and shall charge
the sewerage treatment costs to the City of Chaska in its normal 1

manner and shall v' '
pro ide both Chanhassen and Chaska with annual
reports thereof.
' Section 3. Commission Payment. In compensation to Chanhassen
' for the use of its lift station /forcemain the Commission agrees to
pay a prorated share of the capital cost for Chanhassen's lift
' station as defined in Exhibit E. The Commission shall also pay a
share of operation and maintenance cost of the Chanhassen lift
1 station as defined below. Said payment shall be made on or before
December 1 of each calendar year during the time which the
Chanhassen lift station is being used for conveyance of Chaska
' wastewater. When the Chaska sewerage diversion is started or has
ceased, a prorated share of the yearly payment will be made for
each month that the Chanhassen lift station /forcemain was used for
the Chaska sewerage.

Section 4. Plan Review. Approval and Construction. Chaska
shall submit for review by the Commission and Chanhassen the plans ,
and specs for the Chaska /Chanhassen Interceptor. Chanhassen and
the Commission shall review and approve the plan and that approval
shall not unreasonably be withheld. If either Chanhassen or the '
Commission fails to respond after submission of the plan to them
within thirty (30) days, approval of the plans and specs will be
presumed and Chaska may proceed with construction. Chaska shall
construct same in a timely manner in order to effectuate the terms
of this Agreement. The Commission will reimburse the City of
Chaska upon completion of the lift station and forcemain for the
bid price with all change orders approved by the Commission.
Section 5. Easements. Chaska agrees to obtain all Commission
easements necessary for the lift station and forcemain. '

Section 6. Renewal of Contract. It is the intent of the '
parties of this contract that it will remain in force until
December 31, ' and could be extended on a Y
ear to year basis

Section 7. Continuation of Commission Studies. The ,
Commission and the Council agree to continue to actively pursue
completion of the Chaska Wastewater Treatment Plant project,
Commission project number 920600, and have a permanent facility ,

operational by December 31, 2000. The Council has required that
1 the Chaska project be included in the Centralization/
Decentralization Study. The Council agrees to allow the Commission
to initiate design of the permanent facilities when the Commission
submits documentation on the ultimate capabilities of the Blue Lake
service area. In addition, the Commission and the Council agree to
' amend the consultants contract to include in the Facility Plan
Study the area of Chanhassen identified in Exhibit C.
' Section 8. Hazeltine Interceptor. Upon completion by Chaska
of the Hazeltine Interceptor in the local location as shown in
Exhibit A, Chaska would permit Chanhassen to utilize the future
Hazeltine Interceptor to discharge flows from the southern portion
' of Chanhassen to the existing or a future Chaska Wastewater
' Treatment Facility. If Chanhassen elects to participate in the
Hazeltine Interceptor, Chanhassen would be required to provide
Chaska notice of its intent within sixty (60) days of receiving
notice from Chaska of its plan to proceed with construction.
' Chanhassen's cost for obtaining permanent interceptor capacity in
the Hazeltine Interceptor will be calculated based on the following
formula:
Chanhassen costs - projected ultimate Chanhassen flows/
projected total flows x actual project costs.
Total flows - Chaska's projected flows + Chanhassen's
projected flows.

If it is determined that the Hazeltine Interceptor meets the
Commission's definition of a regional interceptor serving two or 1
more communities, it is understood that the Commission would
construct and maintain the joint portion of the Hazeltine
Interceptor. 1
Section 9. Notices. A notice or other communication under 1
this Agreement by either party to the other shall be sufficiently
given or delivered after it is dispatched by first class mail,

Recently we discussed the potential of Chaska, Chanhassen and
Metropolitan Waste Control Commission working jointly to address
an interim solution to capacity problems at the MWCC Treatment
Facility in Chaska. One concept Chaska has explored is the Waste
Control Commission constructing an interceptor to divert a por-
tion of the flows from the Chaska service area to Chanhassen's
proposed lift station on Lyman Boulevard with these flows going
to the MWCC's Lake Interceptor and be treated at the Blue Lake
Plant. To explore this concept further I asked the Bonestroo
consulting engineering firm to analyze the concept and in re-
sponse they prepared the attached letter. Implementation of the
option would clearly require an agreement between the cities of
Chaska and Chanhassen along with the Metropolitan Waste Control
Commission.
To begin the process we recently discussed an agreement between
Chaska and Chanhassen based on the following key elements:
A. The Metropolitan Waste Control Commission would be per-
mitted
by Chanhassen to construct a lift station /force
main as outlined in Bonestroo's letter, diverting approx-
imately 1 million mgd for a period of up to 10 years.
Chanhassen would not be responsible for any additional
costs either for operation or for facility oversizing to
implement the option.

1 B. Chaska and Chanhassen would jointly request that the
MWCC expand the present study on the Chaska Waste Treat-
ment Plant to analyze the feasibility of a portion of
Chanhassen service territory discharging to the new
plant.
C. Approval of the temporary diversion would be contingent
upon Metropolitan Waste Control Commission continuing to
aggressively study and implement expanded capacity at its

D. The City of Chaska would permit the MWCC or Chanhassen
to utilize the future Hazeltine Interceptor at no charge
for a period of up to 10 years to service the area of
southern Chanhassen. Attached as Exhibit B is a map
showing the proposed location of the Hazeltine Intercep-
tor which is scheduled to be constructed with the Chaska
Flood Control Project in 1995. Chaska would not be
responsible for any facility oversizing costs to imple-
ment this option.
E. Chaska would agree to allow the Gedney pickle processing
facility in Chanhassen to continue to utilize the Chaska
interceptor system.
F. The City of Chaska would permit future development north
' of 82nd Street and east of Hwy. 41 which can be served by
gravity to connect to Chaska's water and sewer utilities.
' I recognize that this is only a general outline of an ultimate
agreement, but if it is acceptable in concept to Chanhassen our
next step should be to pursue agreement with the Metropolitan
Waste Control Commission. The City of Chaska truly looks for-
ward to continuing our close relationship with Chanhassen and
appreciates your interest to assist in addressing these issues.

Dear Dave:
As you requested, we have compiled the available information relating to the possible

sanitary sewer forcemain from Chaska to Chanhassen. A preliminary layout of the
forcemain is shown on the attached map.
The proposed lift station and forcemain would divert flows from the north portion of Chaska
to a proposed trunk lift station (Upper Bluff Creek Lift Station) and forcemain in
Chanhassen and eventually to the MWCC's Lake Ann Interceptor. The diverted flow would
include flows from Chaska's West Trunk, North Trunk, Northeast Trunk, and Jonathan
Interceptor. Specific details of the possible forcemain are discussed below. '
FLOWS
In January of this year, the MWCC allocated Chanhassen 3.0 MGD of additional capacity
in the Red Rock Interceptor. This additional capacity brings the City's total allocation to
16.1 MGD and was intended to be used to service the Upper Bluff Creek Sewer District.
Ultimate flow projections for Chanhassen indicate that the entire 16.1 MGD of capacity will
be used.
Presently, Chanhassen is planning to construct a 6.7 MGD lift station to service the City's
Upper Bluff Creek District. The proposed location for the lift station is at the intersection
of Lyman Boulevard and Audubon Road. The ultimate design flow for this lift station
includes flows from some areas that are outside of the present MUSA line.
Based on preliminary reviews, it appears that some of the future capacity from Chanhassen's
Upper Bluff Creek lift station could be temporarily used by Chaska.

Planning for the proposed lift station /forcemain could begin immediately. A realistic
' schedule could include construction in 1993. On an accelerated schedule, construction could
begin this year. The construction of Chanhassen's Upper Creek Lift Station is scheduled to
begin this summer.
As mentioned previously, the schedule for operation of the proposed lift station is largely
dependent on the projected flows and the timing for future development in Chanhassen.
1 It is anticipated that the proposed lift station could be operated for 5 -8 years.
CONCLUSION
Further investigation of this concept is warranted. The project would have the benefit of
both reducing the loads on the existing Chaska WWTP and providing some additional time
for planning the expansion /phasing out of the plant. The benefits for the City of Chanhassen
should be better defined and addressed in any project agreements that are prepared.
