Additionally, Chapter 513 is passing another cost on to us. The attached directive from the Minnesota Health Department specifies that we must collect $5.21 annually from every water connection in the City. This money must then be remitted quarterly to the Minnesota Health Department. t After discussing this process with Charles Folch, City Engineer, we agreed that some administrative charge should be included to cover the additional costs incurred by the City for time spent in 1 conducting the tests as well as additional processing costs for billing, etc. We concluded that $8.00 annually ($2.00 quarterly) should be sufficient and advisable. Since Chapter 19 of the Chanhassen City Code covers all aspects of the sewer and water utility including billing, penalties for late payment, etc. 1 felt it appropriate to modify our existing Resolution (91 -116 dated December 9, 1991) Establishing Water and Sewer Rates and include this as a sub - section under the water charge. ' The attached proposed resolution re- states our existing sewer and water rates with the addition of'paragraph 1.A(4). 1 am proposing to implement the changes in our utility billing system to incorporate this charge with the next scheduled billing cycle (end of July). cc: Charles Folch, City Engineer CITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA 1 RESOLUTION ' Date: Resolution No. Motion By: Seconded By: RESOLUTION ESTABLISHING MUNICIPAL SEWER AND WATER RATES WHEREAS, this municipality maintains a public sanitary ' sewer system and public water system; and WHEREAS, Chanhassen City Code Chapter 19 provides that the City Council may from time to time establish revised rate ' schedules for usage of the public sanitary sewer system and the public water system. NOW, THEREFORE, BE IT RESOLVED, by the Chanhassen City ' Council: 1. The following water use rates are hereby established: A. Connected Structures The following charges are imposed on each ' structure connected to the municipal water system: (1) A minimum charge of $5.50 per dwelling unit ' or per billing statement generated for quarterly water usage not exceeding 5,000 gallons. ' (2) A charge of $1.10 per 1,000 gallons, or fraction thereof, for all quarterly water usage up to 25,000 gallons and, (3) A charge of $1.30 per 1,000 gallons, or fraction thereof, for all quarterly water usage in excess of 25,000 gallons. ,- (4) A charge of $8.00 per year for each connection to the municipal water system ' StGf N` C Atr to support mandated water quality testing services. Unconnected Structures A quarterly charge of $10.00 is hereby imposed on each single family attached dwelling, each single family detached dwelling, each commercial structure and each industrial structure which is not connected to the municipal water system when municipal water service is available. 2. The following sewer usage rates are hereby established: 111 A. Structures Connected to Both Sewer and Water A quarterly charge, based on winter quarter 1 municipal water usage, is hereby imposed on each single family dwelling, each commercial structure and each industrial structure, which is connected to both the municipal water system and the municipal sewer system as follows: (1) A separate billing statement shall be , generated for each water meter, and (2) A charge of $2.40 per 1,000 gallons or ' fraction thereof for all quarterly water usage provided however, that the minimum quarterly charge shall be $12.00. ' Alternate System of Billing Computation If water consumption during the winter billing "— quarter does not accurately approximate actual sewer usage throughout the entire billing year, the quarterly sewer charge shall be based upon water consumption during such other billing quarter as most accurately reflects actual sewer usage during the entire billing year. If water consumption during any particular billing quarter does not accurately approximate actual sewer usage, the quarterly sewer charge shall be based upon average quarterly water consumption during the entire billing year, or such other method as in the opinion of the City Engineer which most closely approximates actual sewer usage. 1 -2- 1 11 B. Structures Connected to Sewer But Not to Water (1) Regular Residential Rate 1 A quarterly charge is hereby imposed on each single family attached dwelling and each ' single family detached dwelling which is connected to the municipal sewer system but not to the municipal water system as follows: ' $48.00 per dwelling unit. (a) Senior Citizen Discount. Provided, however, that the quarterly charge shall ' be $24.00 per quarter if said dwelling unit is occupied by no more that two persons: 1 i) at least one of whom is at least 65 years of age, and ' ii) at least one of whom is the owner of said dwelling.unit. ' (b) Alternate System of Billing Computation The quarterly sewer charge shall be based upon actual private source water consump- tion and upon the rates set forth in Section A, above, if a water metering system acceptable to the City has been installed, through which accurate water 1 consumption records can be established. (2) Non - Residential Rates 1 A quarterly charge is hereby imposed on each commercial structure and each industrial ' structure, which is connected to the municipal sewer system but not to the municipal water system, at rates set forth in Section A, above, and on the basis of deemed sewer usage ' as estimated by the City Engineer on a case -by -case basis approximating as closely as possible actual sewer usage of similar land uses actually connected to the municipal sewer and water systems. - 3 1 1 C. Structures Not Connected to Sewer (1) A quarterly charge is hereby imposed on each single family attached dwelling and each single family detached dwelling, which is not connected to the municipal sewer system though connection is required by City ordinance as follows: $96.00 per dwelling unit, provided, however, that the quarterly charge shall be $48.00 per dwelling unit if said dwelling unit is occupied by no more than two persons, at least one of whom is at least 65 years of age, and at least one of whom is the owner of said dwelling 1 unit. (2) A quarterly charge is hereby imposed on each commercial structure and each industrial structure, which is not connected to the municipal sewer system though connection is required by City ordinances, at the rates set forth in Section A, above, on the basis of deemed sewer usage as estimated by the City Engineer on a case -by -case basis approximating as closely as possible two times actual sewer usage of similar land uses actually connected to the municipal sewer and water systems. D. Effective Date ' BE IT FURTHER RESOLVED, that these rates shall be effective in entirety commencing with billings after July 1, 1992. Marsc Commissioner Protecting the health of people consuming water from public water supplies is a responsibility that the Minnesota Department of Health (MDH) assumes from the federal I government. In Minnesota, the MDH must enforce the requirements of the federal Safe Drinking Water Act, and regulations developed by the U.S.. Environmental Protection Agency for providing safe drinking water. The federal government has determined that I the numbers of parameters monitored should increase from 23 to 83 parameters. During the 1992 state legislative session, the MDH was authorized to assess a fee of $5.21 per water service connection to cover the total state costs of the program. The fee is to I be paid by a public water supply owned or operated by a city, town or water user district. (Laws of Minnesota 1992, Chapter 513, Article 6, Section 2.) This is to notify you of the following: II 1. You must collect $5.21 annually from every service connection served by your water supply as of July 1 of that year. II 2 . You must pay the Department of Revenue one fourth of the total yearly fee each calendar quarter. The first quarterly payment is due on or before September 30, 1992. A water supply with fewer than 50 service connections may make one payment annually starting no later than June 30, 1993. 3. If you do not submit payment within 30 days of the due date, you must pay an ' additional late fee. The late fee is 5 percent of the actual amount of the fees collected on service connections. I To assist with the payment of the fee, the MDH will soon be distributing coupon booklets that will aid you in returning the fee amount to the Department of Revenue. To inform the MDH of the number of service connections served by your water supply, we II request that you return the enclosed postcard by July 15, 1992. To inform your water supply customers of the fee, we suggest a way to describe the fee is, "Fee for safe drinking water testing program mandated by federal law." II We hope to make collection of this fee as simple as possible. Public water supply staff are available to answer questions concerning the fee collection requirements at I 612/627 -5170. We would like to hear any suggestions you may have to ease this process. We are aware of some confusion regarding the effective date of this legislation. After consulting II with the Attorney General's office we have concluded that the laws support collection of this fee at this time. I Thank you for your cooperation in this effort. We know you share our concern that safe drinking water continue to be provided to the citizens of Minnesota.
