The property owners on both the east and west sides of vacated Balder Avenue are requesting the vacation of remaining portion of Balder Avenue as well as a portion of Horseshoe Curve ' right -of -way. In 1990, when the applicants first applied for the vacation of Balder Avenue, staff recommended that the northerly portion of the road remain as public right -of -way. The reason for this was should Lot 2, Block 1, Sathre's Addition be subdivided, it would have adequate street frontage as the zoning ordinance requires 90 feet of street frontage per single family lot. However, since that time, the city adopted an ordinance allowing up to four parcels to be served by a private driveway. This eliminates the need of retaining the public street frontage on Balder Avenue as the existing driveway serving Lot 2, Block 1 could be utilized to service any newly created parcels. The portion of Horseshoe Curve and Balder Avenue proposed to be vacated does not serve any real public function as it dead -ends at Lotus Lake. It does not serve any real home sites and is too steep and heavily wooded to accommodate a public street. The applicants own the property on both sides of the street and utilize the portion of Balder Avenue that has not been vacated to access their property. is tO PRINTED ON RECYCLED PAPER 1 Don Ashworth July 22, 1992 Page 2 A sewer line runs through the southerly portion of Balder Avenue along the lake. An easement 1 does exist over the sanitary sewer line. The city will use Balder Avenue as an access to the existing sewer line should any maintenance in this area be necessary. The natural drainage way occurs along the area proposed for vacation. Staff recommends that a drainage and utility 1 easement be retained over the area proposed for vacation. ' The applicants wish to vacate the remaining portion of Balder Avenue and that portion of Horseshoe Curve as shown on Attachment #1 for preservation purposes by minimizing public use of the strip. 1 The street alignment for Horseshoe Curve will maintain a 30 foot width from the center line of the road. Staff is in support of the requested vacation. 1 RECOMMENDATION ' Staff recommends the City Council adopt the following motion: "The City Council approves Vacation Request #92 -5 to vacate a portion of Horseshoe Curve and 1 Balder Avenue as shown on the survey dated June 24, 1992„ with the following condition: 1. A drainage and utility easement shall be reserved over the vacated portion of Balder Avenue and Horseshoe Curve. 2. No clear cutting shall be permitted on Balder Avenue. 3. The City Attorney brought up the issue that the DNR should review the vacation before it is approved. There are no laws stating that the DNR should review a vacation before it is approved, but the City has always contacted the DNR as a matter of courtesy. After speaking to Jim Bloomingdale from the DNR, staff found out that the DNR has no interest in Baldur Avenue and the City can proceed with the vacation. It is our understanding that the City of Chanhassen is considering transferring the ownership of a drainage swale (that outlets to Lotus Lake) to you. We would have no ' objection to this transaction. DNR jurisdiction remains the same regardless of who owns the swale; the swale itself is not under DNR jurisdiction, but any activity below the Lotus Lake ordinary high water elevation (OHW) of 896.3' (NGVD, 1929) is under DNR 1 jurisdiction and may require a permit. We would recommend that the swale be left in a natural, vegetated 1 condition or riprapped, if necessary, to prevent erosion. It was a building gutted by fire that to the citizen it appeared to be a safety hazard. It was an unboarded up building and abandoned building and he was asking the City to do something about it and the right action has now been taken. Is there anyone else wishing to make a presentation? , PUBLIC HEARING: VACATION OF BALDUR AVENUE, LOCATED SOUTH OF PLEASANT VIEW ROAD , „,JUST EAST OF 6607 HORSESHOE CURVE, JOHN AND ANN DANIELSON. Paul Krauss: The applicant is requesting vacation of Baldur Avenue south of Horseshoe Curve. The street's a 15 foot wide undeveloped right -of -way. It serve no real public function as it deadends at Lake Lucy. It serves no real honesites and is basically too steep to accoRmmodate a public street in any case. We only need to retain an easement to protect the sanitary sewer which runs down by the lake. The applicant for the vacation owns the property located west of the street and presumably would try to get title to it. Issues concerning the street were recently raised during the proposed subdivision for Sathre and that's the property, Robert Sathre, one lot to the east. That lot is quite unusual in that there's actually a finger of that lot that wraps down around Baidur Avenue and this area over here over which we have a permanent easement. While the items were discussed with the Sathre subdivision, the Sathre subdivision is currently on hold at the applicant's request. We see no reason to withhold action however on the vacation request. The City Attorney tonight though raised an issue that we had not dealt with and that is that, I believe there was a change in State law a while ago that requires that when properties axe vacated around public water bodies, public bodies, that the DNR be notified. What we'd like to recommend is that we add a condition of approval tonight that the land not be released until the DNR has been notified and we receive sane comment back from then. With that we are recacamending approval. Councilman Johnson: Or should we table it as a different alternative? , Elliott Rnetsch: I don't think that's necessary in order to comply with the statute to notify DNR. Just make the vacation contingent on notification of the DNR. If they did raise a concern, the reason behind it is so that in case they want to acquire the property or they have same use for it. If they indicate they have no use for it than the action to be carried out so it's really your option. If you want to table, you could do that or you could act tonight on notice to the DNR. 14 i II City Council Meeting - February 12, 1990 Mayor Chmmiel: I don't find any reason why we should have to table it. I was out there and looked at it on Saturday and it is just a tip as it shows there. I think we could just proceed with that as far as that's concerned. Is there anyone wishing to address this? The City Attorney has forwarded a proposed ordinance. It is in a shell format meaning that staff is assuming that the Council will either acid or subtract from the ordinance as it has been presented. We were not quite sure as to the type of controls Council is looking to and again, as first reading, the Council should feel free to instruct staff in whatever form seems appropriate. Councilman Johnson: As you know, I brought this up originally and I gave my ideas to the City Attorney and he's pretty well implemented therm. I don't know how many, I think a lot of people here in the audience are here for this issue. I don't know how many copies of this have been distributed as to what we're ' actually doing here. In your introduction you said limiting to behind the counter only. Well that's not exactly what this ordinance does. It defines what self service merchandising is as a means. Self service merchandising means open display of tobacco products that the public has access to without the I I intervention of an employee. Vending machines equipped with locking devices constitute self serving merchandising. I had actually, I said that we would t leave that part of it out but oh yeah, right. Baldur II Avenue exists as an undeveloped right -of -way. At the present time the applicant uses Baldur Avenue to access his property. The street was intended to be platted 30 feet wide, however, the easterly 15 feet of Baldur is under the ownership of Robert II Sathre (see Attachment #1) and is covered by a permanent roadway easement. This 15 foot wide easement is used by the abutting property owner, Ronald Harvieux as a driveway access to his property. It is not known how this portion of Baldur Avenue was II conveyed to Mr. Sathre but documents exist noting that this por- tion is under private ownership. The resulting lot configuration is highly unusual since Mr. Sathre's home is located some II distance to the northeast along Pleasant View Road. A sewer line runs through the southerly portion of Baldur Avenue II along the lake. An easement does exist over the privately owned portion of Baldur Avenue but not over the portion that the applicant is requesting II for vacation. Staff recommends that an easement be retained over the existing sanitary sewer line. The City has no use for Baldur Avenue other than using it as an II access to the existing sewer line. The steep slope of this area makes it impossible to drive a vehicle to the sewer line. The area is also heavily wooded. The applicant wishes to vacate II Baldur Avenue for preservation purposes by minimizing public use of the strip. The City Council should be aware that Mr. Sathre has a pending II application for a subdivision before the Planning Commission. He is seeking to divide his parcel into two lots. His application has tempoarily been withdrawn after the initial Planning II Commission review. Staff anticipates requiring the acquisition of the 15 ft. strip of land covered by the easement to avoid the creation of a remnant parcel with no legitimate use. RECOMMENDATION 1 Staff is recommending approval of a resolution for Vacation Request #90 -1 for the vacation of Baldur Avenue with the II following condition: 1. It is our understanding that the City of Chanhassen is considering transferring the ownership of a drainage swale (that outlets to Lotus Lake) to you. We would have no objection to this transaction. DNR jurisdiction remains the same regardless of who owns the swale; the swale itself is not under DNR jurisdiction, but any activity below the Lotus Lake ordinary high water elevation (OHW) of 896.3' (NGVD, 1929) is under DNR jurisdiction and may require a permit. We would recommend that the swale be left in a natural, vegetated condition or riprapped, if necessary, to prevent erosion.
