SUBJ: Legend Homes, Vacation of Utility and Drainage Easement
BACKGROUND
This item was laced on the last City Council Agenda, Jul 13, 1992. The neighbors to the west,

the Bolands, addressed the Council with the concern of erosion that was occurring on their
property. The vacation of the drainage and utility easement issue was tabled and staff was
directed to send a letter to Legend Homes informing them that erosion control measures were
needed along the west side of the home where erosion onto the neighboring property was
occurring.
1 ANALYSIS
The home builder, Legend Homes, has installed the erosion control fence as directed by the staff.
The homeowners have also indicated that they will be building a retaining wall, as well as
sodding the yard. All of these measures should eliminate the erosion onto the neighboring
property, the Bolands.
RECOMMENDATION
Staff would still recommend the partial vacation of the utility easement on 3931 County Oaks
Drive as presented in the staff report.

' Pursuant to our phone conversation on Friday, July 10, 1992, and at the City Council meeting
last night, July 13, 1992, I was asked to formally remind you that erosion control is required on
your property. As you may or may not be aware, the development contract for your subdivision
' requires all disturbed areas be seeded or sodded immediately after construction, weather
permitting.
' Dave Hempel, Sr. Engineering Technician and I myself inspected your property on Friday, July
10, 1992, and noted that there is erosion occurring on a portion of the westerly side of your
property. The erosion is settling on the neighbor's property (the Boylans).
1 Installation of a silt fence along the segment where the erosion is occurring will resolve this

' problem. This fence should be left in place until you either sod or the grass seed has been fully
re- established. A landscape escrow ($500.00) has been provided by the builder to ensure
revegetation of your lot. You may want to contact Legend Homes about utilizing these funds.
The city's deadline for lawn restoration was July 1, 1992. Therefore, your cooperation in this
matter would be greatly appreciated.

BACKGROUND '
The applicant, Legend Homes, applied for a building permit on the subject site in January 1992.
The original lot survey submitted with the building permit application showed a 10 foot side
yard and utility easement on the western side of the property. The side yard setback in this
district is 10 feet. A window well was noted by the building inspector as encroaching into the
10 foot easement.
•
The Zoning Ordinance, Section 20 -908 Yard Regulations, allows for encroachment into a side
yard for certain architectural features but prohibits an encroachment into a drainage and utility
easement. The permit was issued in error of the setback requirements. A typical side yard
easement if 5 feet, it appeared that the 10 foot line noted on the survey was for a setback.

ANALYSIS
Upon final inspection of the home the a building inspector noted that a window well encroached
into the drainage and utility easement approximately 4 feet. Normally a side yard drainage and
utility easement is 5 feet wide. Staff is uncertain as to why this easement is 10 feet, especially ,
since there are no utilities located within the easement.
This home is thus in violation of the zoning ordinance. In order to resolve this situation, staff
is recommending the vacation of the westerly 5 feet of the easterly 10 foot easement. Because
there are no utilities in this easement, and the drainage runs to the north, staff is comfortable
reducing the drainage and utility easement to 5 feet. The home would then be in compliance
with the setback requirements of the zoning ordinance.
