City Council approval requires a simple majority vote of the City Council present. A Clean Water Fund Grant was awarded to Chanhassen in the amount of $155,474.00. This grant is intended to be used to stabilize ravine #2 south of Mandan Circle and west of MN TH 101. Preliminary plans have been prepared by Wenck Associates, Inc. and have been included as an attachment to this memorandum. The design seeks to create a more stable stream channel for surface runoff by reshaping the deeply incised and entrenched channel into a more gradual, parabolic channel. The felled trees will be utilized as stabilization of the side slopes and, where suitable, in- stream ditch checks as is accepted engineering practice identified in Part 654 of the National Engineering Handbook. Rock will be used otherwise to create ditch checks. Public Works The use of these in- stream best management practices will allow for the dissipation of 7901 Park Place energy and the infiltration of surface water. This energy and volume reduction, coupled Phone: 952.227.1300 with the newly configured channel geometry will result in a stable ravine, thereby reducing Fax: 952.227.1310 erosion and sediment delivery to Bluff Creek, the Minnesota River and Lake Pepin — three impaired waters for which Chanhassen has a required sediment load reduction. This will Senior Center also offer protection to the adjoining properties and public infrastructure. Phone: 952.227.1125 Fax: 952.227.1110 As part of the City's obligation, $75,000 will be applied to the acquisition of Outlot A, Bluff Creek Highlands 2 nd Addition. Mr. Jim Sulerud, the owner of the property, has Web Site www.ci.chanhassen.mn.us agreed to this purchase price as indicated in the attached letter dated February 17, 2012. In addition to the financial commitment, the City will need to annually inspect the property. This is similar to any other storm sewer infrastructure installed and maintained by the City. It is estimated that it will take one to two hours of staff time per year. Chanhassen is a Community for Life - Providing forTodayand Planning for Tomorrow Paul Oehme Clean Water Fund Grant — Ravine #2 February 11, 2013 Page 2 Other grant requirements include annual progress reports and maintenance of a project page on our website until project completion. The grant agreement is due to BWSR by February 15, 2013. All funds must be spent by December 31, 2015 and no funds may be applied to the grant prior to the execution of the Grant Agreement by the Board of Soil and Water Resources. Anticipated completion is late winter /early spring of 2014. The city attorney has reviewed the grant and finds it acceptable. Since that date we have tried to get MnDot to provide a greater financial contribution due to their contribution to the deterioration of our property. If successful, this would have offset the City's purchase price from us. As you will see in the attached documentation, we have just concluded our negotiation and settlement with MnDot that include their refusal to take any financial responsibility for anything beyond their condemnation of approximately one acre for their right -of -way. The award of the Commissioners (notice enclosed) was appealed neither by us nor the State, so the State followed through with payment to us in late January 2012 of $22,100. Obviously the erosion needs your early attention, so I apologize for any delay that this deliberation with the state has caused. I expect that with the engineering work already completed that this project is "shovel ready." I also see that in the announcement of grants to cities, etc. the watershed district is reiterating their interest and concern for such projects. With the lack of snow cover and less than normal frost depth maybe you can get underway in the weeks ahead. We look forward to cooperating with you on this important effort.
