As for the development, it is very similar to the lot layout across Chaska Road. See the attached map
Access for each lot is in compliance with City Code. Chaska Road is a local street. Three new homes will not increase
traffic on this road significantly.
The City's Comprehensive Plan guides this area for residential — low density uses. This means residential densities of 1.2
— 4.0 units per acre. The proposed density for this project is 1.83 units per acre, which is on the low side of the
permissible density range.
The property is zoned Single - Family Residential District. This zoning requires a minimum lot size of 15,000 square feet.

Hi Mr. Generouos,
I was unable to make the public meeting this evening to hear more about the proposed development at 6300
Chaska Rd but would like to pass on some thoughts and ask a couple questions as a neighbor. I took a look at
the plans on -line and was surprised to see the proposed density on the awkward site. Even if the proposed
number and size of lots is allowable by code, the layout presents a stark contrast to the current situation. Today
this first lot of the neighborhood presents a woodsy natural feel that provides an excellent buffer to two
increasingly more busy roadways (hwys 41 and 7). This sets the tone for the rest of the neighborhood. The
new proposed development contrasts this sharply with much smaller lots and minimal treescape and buffer. In
addition, the western lot seems crammed into the west corner presenting an access challenge off of chaska road
and a potential traffic issue with accessing the intersection of US hwy 41. The two other middle lots appear
large at — 0.5 acres each but not spacious as they are long and narrow which winds up presenting a more dense
setting. The most eastern lot is right up against a wetland that needs to be protected for not only its natural
water /stormwater benefit but also because it is home to a lot of wildlife including many deer and a flock of 15+
turkeys. The driveway entry on these three additional lots also presents a traffic challenge on Chaska Rd due to
the increased number and the close proximity to each other and the intersection of Hwy 41. These thoughts lead
me to not look favorably on this development as it seems to be out of place with the neighborhood and have a
negative impact on the quality and feel of the surroundings.
I have a few questions that I am hoping that you may be able to help answer:
1) Does this developer have any previous history in the City or surrounding cities? Do they have a good or bad
track record? The developer has not done another subdivision project in the City. However, they may have
built individual homes.
2) Are these home intended for sale or lease? What is the price point of the homes? I believe that the homes
are intended for sale. They will be market rate. You may want to contact the developer directly about this and
the price.
3) Is the development in need of any variances? If so, what are they? "I'here are no variances required.
4) Will the developer be responsible for road damage caused by construction traffic? Currently, there is a full
size dump truck on site daily. In the development contract which is approved at the final plat, the developer's
responsibilities are spelled out.
5) How will these comments and others be considered at the City? I will attach these comments to the City
Council packet.
6) What is the City's opinion on the development's affect on the surrounding neighborhood and its ability to "fit
in "? The proposed development complies with City ordinances and plans. Those standards represents the
City's determination of what "fits in ".
7) What is the next step for the developer and for public comment? This item goes to the City Council on
Monday, February 25, 2013. They will have copies of the Planning Commission minutes, where the public
hearing was held. Any written material regarding this project will be forwarded to City Council.

wraps around the northern edge of the site. The proposed development meets the minimum
standards of the zoning ordinance.

SUBDIVISION REVIEW
The applicant is proposing a four -lot subdivision.
The existing house on the property is proposed to
be relocated to Lot 4. This house would need to
comply with all building and zoning code
requirements. Due to the wetland on the
property, Lot 1 has a very constrained buildable
area located near the back of the lot.
Additionally, there are constraints due to the
driveway grade and the sewer elevation serving
this lot which may require the use of an ejector
pump for sanitary sewer. The applicant has
provided a building plan which appears to fit
within the building envelope of Lot 1.

There is no curb and gutter or public storm sewer on Chaska Road; ditches and driveway culverts
convey the runoff. Due to developed conditions in the area there is little opportunity to install curb
and gutter on Chaska Road; therefore, no improvements to Chaska Road are required with this
subdivision.
The City's proposed 2013 Street Improvement Project, City Project 13 -01 includes resurfacing
Chaska Road. The City's standard practice is to assess 40% of the street improvement costs to the
benefitting properties on a unit basis, meaning each property would be assessed the same amount
regardless of the area or frontage of the property. If the Fretham 15th Addition final plat is
approved prior to the assessment hearing for City Project 13 -01, each lot within the plat shall be
included in the assessment calculation.
UTILITIES
Eight -inch public sanitary sewer and 10 -inch public watermain are within Chaska Road. The
existing service to the existing home will be used to serve Lot 2. New sewer and water services
are required for Lots 1, 3 and 4. City Project 13 -01 includes some utility repair and replacement
in this area. Staff and the developer have discussed the option of adding these sewer and water
services to the City contract and assessing the cost back to the developer. Should the developer
install these services, the installation must occur prior to the street resurfacing project, as noted
on Sheet 4 of the preliminary plans.
Based on the elevation of the existing sanitary sewer and the proposed home elevation on Lot 1,
this home cannot be serviced by gravity sanitary sewer. Staff requests that the developer
disclose this information to prospective buyers.
Lots 1, 3 and 4 will be subject to the City sewer and water hook -up charges and the Metropolitan
Council Sanitary Access Charge. These fees shall be collected in accordance with the City Code
at the rate in effect at the time.
GRADING, DRAINAGE AND EROSION CONTROL
The developer proposes to mass grade the site to provide the proposed
building pads and to construct the stormwater basin on the north side
of the site. The rear yards of Lots 2 and 3 will not be graded to
preserve the existing vegetation in the area.
Currently the southern one -third acre of the property drains to the
south, ultimately to a storm sewer owned and maintained by the
Minnesota Department of Transportation (MnDOT). The remainder
of the property currently drains to the wetland to the north. This
wetland outlets to the west into the MnDOT storm sewer. The
proposed drainage patterns are very similar to the existing condition.

The developer must obtain a MnDOT drainage permit to ensure that the proposed discharge rates
to MnDOT right -of -way will not exceed the existing condition. It appears that some
modifications will be required to meet MnDOT's permitting requirements.

The developer's engineer has submitted drainage calculations for the proposed subdivision. The
calculations must be revised to address the following:
1. Include drainage from Highway 41. The applicant is not required to treat this runoff, but the
volume for a 100 -year event needs to be incorporated into the calculations to accurately
determine the 100 -year elevation of the proposed stormwater feature.
2. The drainage calculations must be revised to model the storm depths stipulated in City Code.

3. The existing drainage area boundaries used for the runoff calculations need to be revised to
include all the area draining to the wetlands, including area outside of the proposed
development. This is necessary to accurately calculate the HWL of the wetland.
4. Ensure that the post - development discharge rates to both wetlands do not exceed the existing
condition.
5. The curve number for the wetland areas must be 78.
The required changes to the drainage calculations may impact the viability of Lot 1. The grading
plan must be modified so that the driveway grade for Lot 1 does not exceed 10 %. Spot
elevations must be shown along the driveway to Lot 1 in order to calculate the cross slope.
Note the lowest opening elevation for the home on Lot 4.
The site is 2.29 acres in area and may have at least as much as half disturbed. This means that
the site plan will likely disturb greater than one acre and will require an NPDES construction
permit. The City shall be provided confirmation of the permit and a Surface Water Pollution
Prevention Plan (SWPPP) must be prepared and submitted to the City for review and comment.
A review of the preliminary grading and erosion control plan prompted the following comments.
1. The proposed culverts shall have filtration logs, appropriate to flow conditions, at their inlets
and outlets until vegetation is established within the ditch.
2. A construction entrance shall be shown on the plan set and a detail shall be provided.
3. Silt fence or other appropriate sediment control BMP shall be installed along the frontage for
Chaska Road.
4. All silt fence shall use metal t- posts.

5. Sediment protection shall be provided for all wetland areas including those areas off -site to
which the site is tributary.
6. The buffer area disturbed for the creation of the pond and drainage shall be seeded with an
appropriate seed mix such as State Mix 36 -211: Woodland Edge South & West.
7. All drainage swales must be stabilized for the final 200 feet before exiting the property or
entering a water of the state. The method of stabilization shall be indicated on the plan.
Surface Water Management Fees
Surface water management (SWMP) fees are based upon an assessable area of 2.20 acres. The
buffer area needs to be included in the drainage and utility easement and the area provided to the
City. When this is done and a management plan submitted, the buffer area will be subtracted
from the assessable are and the SWMP fees will be reduced accordingly. Under current
conditions, the estimated SWMP fees due at final plat are $8,841.00.
LANDSCAPING/TREE PRESERVATION
The applicant has provided a tree inventory and removal plan for the subdivision. Bufferyard
plantings are required for this development along Highway 41. Tree preservation calculations
for the development are shown below.

PARKS AND RECREATION
The Fretham subdivision request for four single lots is subject to a single condition of approval
for parks and trails. The payment of park dedication fees at the rate in force upon final plat
approval for three of the four lots. The lot with the existing residence is exempt from this fee.
At today's rate the payment of a total of $17,400 in park dedication fees is required. These fees
will be deposited in the City's park and trail dedication fund for utilization on future park and
trail improvements.
One example of a recent project which will benefit the Fretham Addition is the completion of the
Highway 41 pedestrian trail and Minnewashta Park pedestrian underpass. A project funded
cooperatively with Federal, Regional and City dollars, including over $650,000 in park
dedication dollars.
MISCELLANEOUS
The applicant must apply for the appropriate permit(s) required for the demolition or moving of any
existing structures. The shed located in the northeast corner of the property must be demolished or
removed since accessory structures are not permitted without a primary structure. A final grading plan
and soils report must be submitted to the Inspections Division before building permits can be issued.
Retaining walls over four feet high require a permit and must be designed by a professional engineer.
Each lot must be provided with separate sewer and water services.

approval to subdivide 2.29 acres into 4 single - family residential lots. The Planning Commission
conducted a public hearing on the proposed subdivision preceded by published and mailed
notice. The Planning Commission heard testimony from all interested persons wishing to speak
and now makes the following:
FINDINGS OF FACT
1. The property is currently zoned Single - Family Residential District (RSF).
2. The property is guided in the Land Use Plan for Residential Low Density use.
3. The legal description of the property is Lot F, Bardwell Acres Lake Minnewashta, Carver
County, Minnesota except that part lying west of State Road No. 41.
4. The Subdivision Ordinance directs the Planning Commission to consider seven possible
adverse affects of the proposed subdivision. The seven (7) affects and our findings regarding
them are:
1) The proposed subdivision is consistent with the zoning ordinance;
2) The proposed subdivision is consistent with all applicable city, county and regional
plans including but not limited to the city's comprehensive plan;
3) The physical characteristics of the site, including but not limited to topography,
soils, vegetation, susceptibility to erosion and siltation, susceptibility to flooding,
and storm water drainage are suitable for the proposed development subject to
compliance with the conditions of approval;
4) The proposed subdivision makes adequate provision for water supply, storm
drainage, sewage disposal, streets, erosion control and all other improvements
required by this chapter subject to compliance with the conditions of approval;
5) The proposed subdivision will not cause environmental damage;
6) The proposed subdivision will not conflict with easements of record; and
7) The proposed subdivision is not premature. A subdivision is premature if any of the
following exists:
a. Lack of adequate storm water drainage.
b. Lack of adequate roads.
C. Lack of adequate sanitary sewer systems.
d. Lack of adequate off -site public improvements or support systems.
5. The planning report #2013 -04, dated February 5, 2013, prepared by Robert Generous, et al, is
incorporated herein.
RECOMMENDATION
The Planning Commission recommends that the City Council approve the Preliminary
Plat creating four lots.

Project Description
Lakewest Development Co., LLC is proposing to redevelop 6300 Chaska Road,
located at the intersection Chaska Road and State Highway 41. The total site
area is approximately 2.29 acres. The property is zoned RSF and contains one
existing single - family home.
Lot Configurations
The preliminary plat will create four buildable lots. The existing house will be
relocated to lot four to accommodate the new property boundaries. The
proposed lots range in size from 21,389 square feet to 32,027 square feet. This
proposal meets minimum lot area, lot width and lot depth requirements for RSF
Zoning and requires no variances.
Utilities and Storm Water
Since utilities are already in place the new homes will not create a new burden
for the city and its taxpayers.
Individual sewer and water lines will be extended to the new lots from the existing
public service in the street to further utilize existing infrastructure.
Ponding requirements will be met as required for storm water runoff control.
Frontage
While the property has frontage on both Chaska Road and State Highway 41, all
four lots will be accessed from Chaska Road.
Environmental Impacts
Wetlands exist on the eastern portion of the site. Required buffers and setbacks
from wetlands will be adhered to.

Dear Mr. Generous:
The Minnesota Department of Transportation (MnDOT) has reviewed the above referenced plat
in compliance with Minnesota Statute 505.03, subdivision 2, Plats. Before any further
development, please address the following issues:
Water Resources
A drainage permit will be required. The proposed project includes site drainage modifications that
affect drainage to MnDOT right of way. A drainage permit will be required to ensure that current
drainage rates to MnDOT right -of -way will not be increased.
The following information must be submitted with the drainage permit application:
1) A grading plan showing existing and proposed contours,
2) Drainage area maps for the proposed project showing existing and proposed drainage areas.
Any off -site areas that drain to the project area should also be included in the drainage area
maps. The direction of flow for each drainage area must be indicated by arrows,
3) Drainage computations for pre and post construction conditions during the 2, 10, and 100 year
rain events,
4) An electronic copy of any computer modeling used for the drainage computations, and
5) Relevant construction plan sheets.

234 -7521) in MnDOT Water Resources.
Permit Required
Any use of or work within or affecting MnDOT right of way requires a permit. Permit forms are
available from MnDOT's utility website at www.dot.state.mn.us /tecsup /utility Include one I 1 x
17 plan set and one full size plan set with each permit application. Direct any questions regarding
permit requirements to Buck Craig (651- 234 -7911) in MnDOT's Metro Permits Section.
Review Submittal Options:
MnDOT's goal is to complete the review of plans within 30 days. Submittals sent in
electronically can usually be turned around faster. There are four submittal options.
1. One (1) electronic pdf version of the plans. MnDOT can accept the plans via e-mail
at metrodevreviews.dot@state.mn.us provided that each separate e-mail is less than
20 megabytes.
2. Three (3) sets of full size plans. Although submitting seven sets of full size plans will
expedite the review process. Plans can be sent to:

3. One (1) compact disk or other data storage device.
4. Plans can also be submitted to MnDOT's External FTP Site. Send files to:
