1 This memo is to recommend that the City of Chanhassen enter into a
contract with the Carver County Sheriff's Department for 32 hours
per day of contract police hours for 1993. The '93 contract is
1 being brought before the Council at this time because the Sheriff
requires time to respond to the needs we will require for next
year.
1 Attached please find my August 5, 1992, memo to the Public Safety
Commission, outlining my reasons for making this recommendation,
which represents a four hour per day increase over the number of
1 hours contracted for during the past two years.
The City of Chanhassen continues to enjoy a low crime rate and
1 professional, prompt police service. This should not, however,
lead to the conclusion that contract police hours should not be
increased. As the City continues to grow, so do the public safety
needs. Since the time that Chanhassen entered into the contract
' for 28 hours of patrol coverage per day, two years ago, our
population has increased and building permits also reflect the
rapid growth rate our City is experiencing. It goes without
1 saying that Chanhassen is growing rapidly. The system is now
stressed, and to maintain a level of service that Chanhassen
desires, an additional four hours is an appropriate recommendation.
1 What an addition of four hours of police coverage per day means for
Chanhassen is that we will be assured of having two deputies on
each shift for eight hours of the day, which is important for
' officer safety reasons, as well as making sure there is time for
such matters as traffic safety assignments and the other varied
increasing public safety demands of our residents. By comparison,

proposed for 1993, plus the salaries for Bob Zydowsky and the
Public Safety Director, the cost of our two CSOs and a secretary,
and our participation in the Drug Task Force, our police coverage
remains some $400,000.00 below a neighboring community with a
similar population.
This is so incredible that our reputation for meeting our public
safety needs on such a low budget has spread even beyond our State.
The City of Grants, New Mexico, has been so impressed with the
'Chanhassen Model' that they have asked my assistance in helping
' them create a similar public safety department to replace their 42
officer department! In this day of seeking cost effective
solutions to meet a city's needs, Chanhassen can be truly proud of
' our system.
In order to limit the increased number of hours to only four, other
factors have to be put in place. These have been outlined in the
' attached memo, but include making sure that we continue to receive
excellent supervision of the deputies and Chanhassen by the
Sheriff's Department; having Bob Zydowsky return with increased
' duties; and, making an increased use of the volunteer /reserve
components of the Sheriff's Department.
At the August 13, 1992, Public Safety Commission meeting, the
' Commission unanimously endorsed the recommendation made by Sheriff
Al Wallin and myself that the 1993 police contract be submitted to
the Chanhassen City Council with an addition of four hours of
patrol time included for 1993.
RECOMMENDATION:
It is the recommendation of Carver County Sheriff Al Wallin, the
Chanhassen Public Safety Commission and the Director of Public
' Safety that the City of Chanhassen agree to enter into the 1993
police contract with the Carver County Sheriff's Department for 32
hours of police coverage per day.
i Manager's Comments (9- 9 -92): It should be noted that approving the
1993 contract is occurring prior to the dates that the Council will
' consider the 1993 budget. In approving the form of this contract,
it should be noted that we may not be able to increase the total
hours as currently desired. Additionally, this office would like
to use the increase in the local hours as a basis to approach the
' county to similarly increase base level service. One of the
problems with the contract system has continuously been that the
county has not reached full funding for base level service and, at
least in the western portion of the county, base level vehicles and

contract vehicles are literally one in the same. The Sheriff
supports the above comments, and if approved, I will make this
presentation to the County Board. I will make the above comments
as a part of a presentation to the Carver County Board.

information regarding my recommendation for the 1993 Police
II Contract with the Carver County Sheriff's Department.

1 BACKGROUND
The City of Chanhassen has contracted with the Carver County
Sheriff's Department for 28 hours of police patrol service a day
I for the last two years. This provides:us with one deputy in town
24 hours a day, and the assurance that we will have at least a 4
hour period each day where two deputies are present. The issue
1 before us is how many hours we wish to contract for in 1993.
I ANALYSIS
The fact that although the population and the number of businesses
have continued to increase in our City, we have been able to hold
I the number of contract police hou --at 28 - per day for . the past two
years speaks to.-7-the truly cooperative relationship that exists
between Chanhassen Safety and the Carver County Sheriff's
I Department. While I could point out contributions that numerous
individuals have made to this, thefact - is that everyone involved
with the program (including Sheriff Wallin, Mayor Chmiel, City
II Manager Don Ashworth, the Deputies and Community Service Officers,
and all of the other personnel involved...) make the system work -
and work extraordinary well. Police calls are being handled on a
timely and professional basis. Crime Prevention programs are being
I provided to the community, and service calls continue to be handled
well.

While public safety services have been handled well during 1992, we
cannot ignore the continued growth and development of this City.
Houses continue to be built, and people continue to move here.
Market Square will be operational shortly, and the possible opening
of another major retail facility in 1993 will stress the system
that is in place right now.
I am exceptionally proud of the 'team effort' that makes the
contract system work in Chanhassen. In a recent interview
conducted by a newspaper in New Mexico (the city there was
considering switching from a local police department to a contract
system for their city with a population of 8500), I was told that
they could hardly believe that contract policing would work for a
city our size. It does, as I explained to them, because of the
relationships between all of the parties involved. This includes
but is not limited to, the fact that the Minnesota State Patrol has
their district station office at Chanhassen City Hall; that Carol
Dunsmore continues to work closely with the Southwest Metro Drug
Task Force, so that they are frequently in our area; that we have
made an effort to encourage the Department of Natural Resources
Conservation Officers to work from our office; that the Waconia
paramedic station and advanced life support ambulance are located
at our west fire station; and, we have a Fire Marshal and Fire
Department that have an exceptionally quick response time to
emergencies. But as we continue to grow, we cannot let the fact
that things have worked well to this point lull us into a false
sense of security. We do need to look to the future as Chanhassen
continues to grow. ,
The hourly contract fee charged by Sheriff Wallin continues to be
an excellent value. The 1992 hourly fee was $35.10 per hour, .and
the 1993 hourly fee will be $35.33.
I have spent considerable time discussing where we are at, and
where we are going with the individuals providing public safety
services in our City. Sheriff Wallin, Chief Deputy Castleberry and
I have discussed the needs of the City at length, and Sgt. Boden
has provided substantial input as well. I have spent time with the
Carver County deputies working in our City, as well as with the
Community Service Officers providing support to the system. The
consensus is that while the job is being done, the system is under
tension as development continues in Chanhassen. The increase in
population, and surely the new large retail establishments, will
push us to the point of needing more public safety services than we
can presently provide.

' RECOMMENDATION
Recognizing that Chanhassen, like every other municipality, is
' experiencing difficult financial times, I am prepared to recommend
a system for 1993 that I an sure will meet the public safety needs
of our City, while taking full advantage of existing resources,
resulting in a minimal increase in contract dollars. The system
that I am proposing be established for 1993 is as follows:
* That 28 hours per day of contract coverage be increased
only 4 hours per day to 32 hours of police contract
coverage;
* That Sgt. Boden be requested to remain as the supervisor
for the Carver County deputies working in Chanhassen;
* That Bob Zydowsky, upon returning from skills training in
' September, assume the position of Chanhassen Public
Safety Officer (which will permit him to respond as a law
enforcement officer, being deputized by Sheriff Wallin);
1 * That the old CSO truck, which is scheduled to be replaced
in 1993, be replaced with a vehicle suitable for
traditional CSO work, and CSO Zydowsky's additional
responsibilities upon his return;
* That we arrange for the two part -time Community Service
' Officers to be able to work a full 30 hour per week shift
(rather than having personnel that will be attending
lengthy schooling or otherwise being in positions that
will not have them working their full weekly assignments,
as has been the case in the past);
* That Chanhassen Public Safety establish a stronger
working relationship with the Sheriff's Safety Patrol
(police reserve unit) and Mounted Posse, so that
additional personnel could be utilized during community
' events such as the 4th of July, Oktoberfest, etc., at
little or no cost;
* That the developers of any large retail establishment
that would noticeable affect such public safety concerns
as traffic control, be required to provide traffic
' coverage at their expense as required by the Public
Safety Director for the busy opening time period for the
facility.

An additional 4 hours of patrol per day is still far below what the
County recommends for a city of our population. However, by
creatively utilizing existing personnel, including our Community
Service Officers and Bob Zydowsky, Chanhassen is able to require
fewer hours of contract service. Sgt. Boden has impressed me as a
supervisor, convincing me that she is able to insure that
Chanhassen gets a great deal from the deputies working here. Also,
it makes sense that a large retail developer be responsible for
traffic control or other safety issues that directly result from
the development of such a facility.
The Public Safety Director's recommendation is to have the Public
Safety Commission endorse increasing our contract coverage by 4
hours per day.

Chairman Dave Dummer opened the meeting at 7:00 PM. Eldon Berkland
motioned, Craig Blechta seconded to approve the 7/9/92 minutes as

FIRE DEPARTMENT
Fire Marshal Mark Littfin gave a presentation on options for
traffic control for emergency vehicles responding to calls.
Concerns were addressed as to current and future problems of heavy
traffic on Hwy 5 and W. 78th Street. Littfin talked about his
research on the Opticom Priority System, available through 3M. Ee
' demonstrated what a city the size of Chanhassen would require in
equipment, and what costs are involved. Richfield Fire Chief Steve
Sutter was present to share their experiences with the Optic-cm
System. Dave Dummer motioned, Craig Blechta seconded, to have t
Commission forward their concerns (through Scott Harr) to the City
Council regarding the traffic control issues for emergency
vehicles. All voted in favor and the motioned passed.
First Assistant Fire Chief Bob Moore was present to inform the
Commission on the proposal to increase pay for Chanhassen Fire
Department positions. Statistics were displayed on the amount of
increased fire /rescue calls and a survey of salaries from
' surrounding cities. Discussion was had on the various positions
and their duties. Eldon Berkland motioned, Craig Blechta seconded,
that the recommendated raises be considered in preparing the 1993
budget.

SHERIFF'S DEPARTMENT
Sgt. Julie Boden informed the Commission that a rash of mailbox
vandalisms had been committed, and juveniles were arrested in
conjunction with these offenses. The Carver County Sheriff's
Department has made an arrest in connection with the mail thefts
that had been occurring in Chanhassen as well as other communities.
Sgt. Boden also reported that their department has conducted heavy
traffic surveys on W. 78th Street, and speeds have decreased.
BUILDING INSPECTIONS 1
Steve Kirchman reported that revenue has continued to increase. He
also informed the Commission that erosion control will be
increasingly enforced by the Inspections Department. Discussion
was had on concerns over erosion problems and the need for
enforcement. Bill Bernhjelm motioned, Eldon Berkland seconded, to
support the enforcement of erosion control by the BU±1di ::_J
Inspections Department. All voted in favor and the motioned
passed.

PUBLIC SAFETY DEPARTMENT
Scott Harr informed the Commission of the resignation of Community

Service Officer Steve Winters, who has decided to return full time
to school in order to complete his 4 year degree.
OLD BUSINESS
Senior Engineer Technician Dave Hempel was present to brief the
Commission on the status of the parking issue on Choctaw Circle.
Discussion was had on whether or not there was a need for a "no
parking" sign. Additional discussion transpired on what problems
would be created in allowing a sign to be posted. Craig Blechta
motioned, Don Chmiel seconded, to table the proposal for installing
a "no parking" sign on Choctaw Circle until all members have ha3 a
chance to review the site in question before making a referral.
Three Commission members voted in favor and the motion passed.
NEW BUSINESS

Director Scott Harr made his recommendations to the Commission on
the 1993 police contract. Sheriff Al Wallin added that the demand
for police calls for service has steadily increased in conjunction
with the growth of commercial business in Chanhassen. Discussion
was had on the need for increased coverage and costs. Craig
Blechta motioned, Bill Bernhjelm seconded, to endorse Scott Harr's
recommendation to the City Council to pass the 1993 police contract
as written with ,an additional four hours of coverage per day. All
voted in favor and the motion passed.

Discussion was had on the 1993 resolution for the Southwest Metro
Drug Task Force. Bill Bernhjelm motioned, Craig Blechta seconded,
to support the 1993 resolution for the Southwest Metro Drug Task
Force. All voted in favor and the motion passed.
Community Service Officer Rob Nordlund was present to report on the
Bicycle Safety Program that he has implemented. Officer Nordlund
talked about the advantages of patrolling on a bicycle, such as
being able to communicate better with the public, and being able to
patrol areas not accessible with a CSO truck.
' Discussion was had regarding the issue of implementing year round
parking restrictions on city streets. Don Chmiel talked about
' concerns regarding vehicles left in the street for a long period of
time. Director Harr requested that Sgt. Boden talk to the deputies
for their feedback on any problems they may perceive.
' Director Harr made note to the Commission on the new uniforms for
the Building Inspectors, which Steve Kirchman was present to
model.
1 The September 10 meeting will begin with a demonstration of. the
Fire Department's aerial at 6:30, with the actual meeting beginning
' at 7 PM.
Bill Bernhjelm motioned, Don Chmiel seconded to adjourn the meeting

' "The City Council approves of the Planned unit Development Concept Plan for
113 single family lots with the following conditions:
1. Reduce the amount of tree removal currently proposed through
I DELETE reduction of grading, use of retaining walls, removal and shortening

and reconfiguration of lot sizes and locations.
' Applicant has met with staff and considered their recommendations
where possible; altering the grading plan; utilizing retaining walls
' on homesites; reconfiguring lot lines, while still keeping with
applicants design. Applicant does not wish to delete cul -de -sac H
and replace it with a private road.
' 2. Provide a detailed tree removal plan illustrating types, number and
caliper of trees over 6" caliper being removed.
Applicant submitted on 9/11/92 a tree removal tabulation chart for
the site. A more detailed plan will be developed during the final
design stage as each phase of development occurs.
3. Revise lot areas by removing wetland area from the calculations.
Applicant submitted revisions on 9/11/92.
4. Demonstrate that each lot is able to accommodate a 60' x 40'
building pad and a 12' x 12' deck without intruding into any
' required setback area or protective easement.
Applicant submitted a plan on 9/8/92 showing building pads on each
' lot and a lot tabulation chart detailing setbacks on 9/11/92.
DELETE 5. Revise lot widths so that each lot has a minimum of 90': at the
UNDERLINED building setback or provide justification that the required
buildable area can be accommodated.

7. The PUD is permitted a minimum front yard setback of 20 feet.

8. Maintain a minimum 10' side yard setback for all lots and that all
accessory buildings and structures will maintain a 10' setback, or
maintain at least a 20' separation between principal structures. It
will be the burden of the developer to verify that there is a 20'
separation between principal structures at time of building permit
application.

9. Revise the landscaping plan so that it provides the landscaping
required for a residential PUD (boulevard plantings, exterior

DELETE 11. Locate the extension .for watermain service along the past side of

Applicant has discussed this with the engineering department. They
' thought a berm was to be built along Highway 41 and they wanted to
put watermain in first. No berm will be built due to the existing
drop in topography.
12. Extend the watermain beyond "I" street to "G" street to loop the two
water systems together.

' 13. Locate fire hydrants approximately 300' apart and in accordance with
any location recommendations by the Fire Marshall.
