The Minnesota Pollution Control Agency has approved the
Findings of Fact for the Environmental Assessment Worksheet on 1
the proposed Upper Bluff Creek District Sanitary Sewer and
Water Main Improvements, which conclude that this project does
not have the potential for significant environmental effects. 1
The decision for a Negative Declaration concludes the state
environmental review process under the revised Environmental
Quality Board rules, Minn. Rules pt. 4410.1700, subp. 7. This
project can now proceed to permitting. 1

Enclosed is a copy of a letter we received from the Chanhassen '
City Attorney regarding your property. This letter was written
after viewing the site in the field. The letter is self-
explanatory with regard to the usage and construction of the '
parkway.
As we discussed, the attorney's letter indicates a need by the
city to acquire an easement for the walkway portion of the
project. As the project stands, we feel the trees, both on the
east and west side of the road, will be retained. The walkway
may have to be narrowed slightly to get around one of the maples. '
We are in the process of preparing an easement description for
the walkway. It is anticipated to be an 8 -foot easement to
accommodate the construction.
As soon as this description is prepared we will be in contact
with you regarding compensation for the acquisition. The storm
sewer and road construction will be proceeding with the walkway
construction to take place next spring. Hopefully we can come to
an agreement on this matter. We thank you for your patience; I
know this has been a difficult situation for both of you.

y this past week were disheartening is an understatement. I sincerely
' believe that all parties have thought that they have approached the table attempting to present
their position as accurately and honestly as possible, and each feels distraught by believing that
they have not been similarly treated.
1 I agree with your position that we need to take soine:time to see whether we can bring this deal
back to a point being acceptable ,to,all parties. Additionally, we need to ensure that each
' party, contractually, Cnows exactly what their role is and what commitments fey are making.
It is almost ironic in that I had an opportunity to talk with John Dean of Holmes and Graven
earlier this morning on another matter. John acted, as a representative for the city in helping to
' close the Market Square development project within our downtown- -such being the primary
reason for the call. What I was not aware iiinf ,vas the fact that John and Gary Winter have
worked extensively with Target in helping o' close similar development proposals in other
' communities.
It is my belief that if there is an opportunity to bring this project back to a reality position, a
player such as John or Gary is needed. I can assure you that John Dean has maintained a high

respect position with both my City Council as well as Housing and Redevelopment Authority,
and did resurrect two developments which had been pronounced dead. 1

this decision will in fact resurrect the project from its current stalemate position.

I have tentatively scheduled a meeting for 2 p.m. on Friday,
' September 25, in the Public Safety Conference Room, to begin safety
planning for the upcoming snowmobiling season. I think we will be
in a little better position than in the past, for reasons including
the fact that the Sheriff's Office has new snowmobiles that may be
accessible; our positive relationship with the DNR; and, some
_preliminary information I received indicating that the Sheriff's
Office Water Patrol Division may be more involved with snowmobile
1 patrolling than in the past.
At this time, I would like this meeting to involve Chanhassen
Public Safety, the DNR, the Sheriff's Office, as well as Chanhassen
Park & Rec, to see what resources will be available and where we
would like to direct safety patrols and enforcement activity.
If this time will not work for you, please let me know. Thanks.

for serving on the regional forecast review group. You and other members of the group
' made a number of suggestions and offered alternative ideas which really improved the
forecast mailings and the review process. Your assistance also helped to assure that the
forecast materials we sent out were more understandable to local officials.
1 As you are aware, the Council mailed the revised forecasts and the Traffic Analysis Zone
(TAZ) allocation package on August 28, 1992. We are now in the final process where local
government units, with Council staff advice and assistance, assign these municipal forecast
allocations to local TAZs. We expect to complete this process by the end of October.

Dear Bob:
Attached you will find the City of Chanhassen's response to the Traffic Analysis Zonal
Allocation data that has been requested by the Metropolitan Council. As indicated in previous
correspondence from you, our employment forecasts are based upon the revised projections
provided by your staff which are somewhat larger than had been originally shown. We have left
the retail employment section blank since the data that was provided does not seem to represent
accurately what is actually in the community. Rather all our employment is forecasted in a
combined industrial/retail column.
•
Although I am of course familiar with your forecasting process, I am forwarding the information
with some amount of reservations. These stem not so much from the data itself but more from
the purposes to which it may be ultimately put by the Metropolitan Council. I wish to state that,
in my opinion, the rate at which development is projected to occur in Chanhassen is likely to be
significantly below what will actually occur. For example, the city is currently in a process of
working on a development proposal for a 178 acre industrial park located in the southwest
portion of our community. When totally developed, this park will have well over 1 million
square feet of space and could conservatively add another 2,500 employees into the community.
It is very likely that this development will be completed before the year 2000. This project alone
will greatly exceed employment that is forecasted for our city by your staff. Yet this
development would occur in a manner that is consistent with our Comprehensive Plan and on 1
areas that are located within the MUSA line. At the same time, two other industrial parks are
in the development process and our CBD can easily have 1/2 million square feet of retail space
in the same time period. By stating these concerns, I simply wish to point out that I do not want
to see a situation develop 2 or 3 years from now when the Metropolitan Council raises issues

County Road 117. Discussions with Bonestro engineers indicate that water and sewer trunk
mains are anticipated to be constructed to serve the site in the spring of 1993.
We request that the City include this parcel in the planning effort to extend servk s to this
property regarding water and sanitary sewer. Should stone sewer extensions be required for the
development of this property, we request that the City work with The Rottlund Company to ,
create the necessary public infrastructure by the spring of 1993.
At such time as our layout/plat becomes finalized, we may choose to petition the City to install ,

' I just wanted to thank you for your help in making the Backyard Composter pilot project a
success. Neither Marcus nor I had any idea as to the amount of phone calls that would be
received for reserving the composters, nor the concentration of phone calls in such a short time
period. You were able to keep on top of the phone calls and keep all of the names and pertinent
information organized. By doing this we were able to distribute the composters smoothly and
without any problems arising. There is no question that you played as important a role as the
rest of us in this project.
We will be doing the same project in the spring of 1993. I would appreciate any suggestions you

Thank you for your application for grant assistance through the Minnesota ReLeaf Program. Your
project was not selected for funding. Only 11 projects out of 39 applications received in the Metro Region
will be funded at this time.
The Steering Committee decided to hmit current funding to those projects which would be most
strategic in saving energy. Specifically:
higher priority was given to tree planting which would strategically shade the east and west sides
of buildings, trees along north -south streets, and windbreaks;
low priority was given to trees to shade parking lots, trees along east -west streets, and tree cover
near buildings; and
projects to plant trees without indication of any buildings nearby, to plant in a nursery, or to
undertake non strategic street tree trimming were not considered as eligible energy conservation
plantings.
In addition, the committee gave priority to projects which:
included public education and involvement,
- specified appropriate numbers and species of trees,
had reasonable total cost per tree,
had a high proportion of cash in their local match, and
had a well- defined maintenance plan.
In accordance with the Legislature's direction to focus on projects with the greatest energy -
conservation potential, the committee decided not to allocate all this region's monies at this time.
Information about a second round of funding with approximately $185,000 available for the Metro Region
will be distributed in October with grant applications due in January 1993. More explicit guidance will be
given about information needed in the application. 1
You are encouraged to submit a revised or new application which demonstrates how your project
meets the priorities stated above. Most likely park landscaping will not be high enough priority unless its
potential for energy saving on adjoining buildings can be demonstrated. In addition, regarding your current
application, the committee had concerns about plant selection and planting details in relation to the park's
soil and encourages you to reference MnDOTs planting specifications. We would like to offer our
assistance in making a new application to increase its likelihood of funding. If there are any questions
regarding the Minnesota ReLeaf grant program or your community's application, please contact either Ken
Holman (DNR Community Forestry Specialist at 772 -7565) or Peggy Sand (Minnesota ReLeaf technical
adviser at 772 - 7562).

SUBJ: Sale of Backyard Composters
Chanhassen served as a pilot project for the sale of backyard composters at a subsidized cost to
Chanhassen residents. This project was initiated by Carver County. The Carver County Board
approved the funding of 150 backyard composters to be used in the pilot project and approved
Chanhassen as the pilot city.
Carver County purchased Toro backyard composters at wholesale cost after testing several types
of composters. Carver County agreed to pay $20 towards the cost of the composter and
Chanhassen was required to pay $10 towards each composter, with the final cost to the resident
at $24 (the normal cost of the composter would be $79.95). The number of composters available
to residents was set at 150.
The City sent out a mailing advertising the availability of the composters at a subsidized cost
to all Chanhassen residents, plus there was advertising in the local newspaper. The ad went in
the newspaper on Thursday, September 10, 1992, and the mailings probably reached the residents
by the same day or Friday, September 11, 1992. The 150 composters were reserved by noon on
Friday, September 11, 1992. The City was overwhelmed by the response. The phones were
literally ringing off the hook. We had stated in the information sent out that the composters
could be reserved through Friday, September 18, 1992, so we continued to take names until that
date and now have 151 people on a waiting list for next year. We continue to get calls
intermittently requesting a composter.
The composters were picked up by residents at the Public Works building on Friday, September
25 between 12:00 p.m. and 7:00 p.m. and on Saturday, September 26 between 9:00 a.m. and 1:00
p.m. Carver County provided the personnel to distribute the composters at the site. About 8
residents made prior arrangements to pick up their composters at a later date and 1 resident had
her composter delivered by our Public Works department, because she could not do it herself.
There were about 40 composters not picked up at the Public Works building. Some of the people
called later and made arrangements to pick the composter up. The residents who had not

1 contacted the City were sent a letter stating they had a certain time period which the composters
would be held for them and then they would be given to the people first on the waiting list.
Neither the City or Carver County expected the demand for the composters that we experienced.
Although it was a very good deal, I feel it just showed the interest the residents have in
composting and "doing the right thing ". The fact that the composter was made easily available
1 also played a part in the success of the project (i.e. a good composter was provided at a good
price at a close location).
1 The cost of this project to the City was $1,500 for the composters, plus the cost of printing,
mailing and the newspaper ad (we do not have the numbers for these yet). Carver County was
responsible for this project and Chanhassen was very lucky to be picked as the pilot City.
It is hoped that Carver County will provide funding for this project next spring. No matter what,
the City will have to provide the same deal to the people on the waiting list (the same composter
' at the same price). This is only fair since these people called to reserve the composter within
the time period given.
