Concept plans have been submitted to the Planning Department for review which depict the first phase of development occurring in the southwest corner of the property immediately north of 82nd Street which is the corporate limits between 1 Chanhassen and Chaska. This location for Phase I is primarily dictated by the timing of sanitary sewer and water service to the property. The overall property was previously proposed to be served by Phase II of the Upper Bluff Creek Trunk Utility Improvement Project; however, it will likely be a few years before these trunk utility improvements are able to serve the property. 1 During the discussions and meetings with the Metropolitan Council, Metropolitan Waste Control Commission and the City of Chaska concerning interim diversion of Chaska sewer flow through Chanhassen into the Lake Ann Interceptor, four areas in Chanhassen were 1 identified as being more logically served by gravity flow to Chaska. The southwest comer of the Gateway Partnership /Opus Corporation property (Phase I) was one of the four sites identified. The City of Chaska and the as a d t e City of Chanhassen are prepared to execute an agreement to allow these four defined areas to be served by Chaska. It is therefore recommended that authorization be given to prepare the feasibility report for this extension 1 of utilities to Gateway West Business Park, Project No. 92 -17 conditioned upon the City of Chanhassen and the City of Chaska executing the Joint Utility Service Agreement and the that the developer, Gateway Partnership /Opus Corporation, provide a cash escrow or letter of credit in the amount $2,100 to secure the cost for this study. ktm I Attachments: 1. We are very anxious to find out the city's schedule and expected cost for extending utilities by the summer of 1993 to the subject property. In this context it should be mentioned that the city of Chaska has offered to serve a portion of the Gateway property with sewer and water. As I understand it, an agreement between Chaska and Chanhassen is in the works to allow for such an alternative if feasible. We are very interested in having this alternative explored to determine the nature, cost and timing of such an extension through Chaska. As such, we request that the feasibility study for the Upper Bluff Creek District be amended to allow exploration of the Chaska alternative for serving a portion of the Gateway property with sewer and water. 1 Please give me a call at 936 -4419 when you have had a chance to set up the meeting between us, Paul Krause and Phil Gravel of Bonestroo. As you know, I appeared before the Council at that meeting to question and protest the abnormally high cost of the improvements as contained in the original Feasibility Report #91 -17 by Bonestroo, Rosene, Anderlik & Associates. However, we did not speak to the phasing of improvements issue because little discussion was raised concerning the proposed phasing plan. I quite frankly did not receive a copy of the Staff Report containing the ' phasing recommendation until late yesterday afternoon and due to my busy schedule did not have opportunity to read all of its contents. I only discovered that the subject property was not included in the initial ' construction phase after the item was acted on by the Council. This was my error and I apologize for it. But we feel the process still has room for us to request further consideration of the matter to see if inclusion of the subject property in the initial construction phase of the proposed improvement schedule is possible. We feel that if our property is not included in the initial phasing of the ' proposed improvement schedule, then a significant business opportunity will be lost if we have to wait until late '93 —'94 for extension of utilities.
