Background
I On July 11, 1989, the City Council approved the site plan request for a second garage a on P q g g
the site on the corner of West 77th Street and Quattro Drive. The site plan was approved
1 with numerous conditions. One of those conditions was that all parking and driveway areas
be paved and surrounded by concrete curb and gutter only if now or in the future the City
Engineer determines it is necessary. The applicant requested that the concrete curb and
I gutter improvements be delayed or deleted due to the passive use of the site along with
safety concerns when the applicant's helicopter utilizes the site.
1 In an effort to compromise the previous City Engineer, Mr. Gary Warren, reached an
understanding with the applicant relating to the deferral of the City's requirement for the
I installation of concrete curbs and gutters. It was mutually agreed that the applicant's
obligation to install the required curbs and gutters at the time they construct the Phase III
garage or within three years of the date of the agreement which was September 14, 1989.
I To guarantee that the improvements would be installed within the three -year timeframe, the
applicant has on file with the City, a letter of credit in the amount of $7,700. The letter of
credit is scheduled to expire December 15, 1992. Staff has been in contact with the
I applicant who has agreed to extend the letter of credit for a minimum of 30 days until the
City Council has considered their request for an extension. Action by CPty AchIntstrs`.

Proposal /Summary
Attached is a letter from Mr. Beddor's representative, Mr. Daryl Fortier, requesting that the
City grant an additional three -year extension for the installation of concrete curbs on the
site. Mr. Fortier is requesting the deferral for two reasons: 1) the anticipated expansion
(Phase III) is no longer eminent and the curbs present a safety hazard to helicopter
' landings, 2) there has been no erosion or drainage problems over the site due to the lack
of concrete curbs and gutters. Staff is comfortable in recommending approval of this
request due to the passive use of this site along with no apparent erosion or drainage
problems.
Therefore it is recommended that the City Council approve the request for deferring the
' City's requirement for the installation of concrete curbs and gutters on the Quattro garage
site, Lot 1, Quattro Addition in Park One for another three years until September 14, 1995
t or until future site expansion, whichever event first occurs conditioned upon Mr. Beddor
maintaining on file with the City of Chanhassen a letter of credit in the amount of $7,700
to guarantee future installation of concrete curbs and gutters in the event the curbs are not
' installed within accordance of this approval.

Dear Mr. Warren:
Ths letter is to confirm the understanding reached between the
City of Chanhassen and my architect, Daryl Fortier, relating to
the deferral_ by the City of its requirement of the installation of
curb and gutters as a condition of City approval of the site plan
and building permit for the Phase Three garage in Quattro Addition
(a replat of Lots 1 and 2, Block 1, Park One Third Addition). '
I understand it is my obligation to install the required curbs and
gutters at the time I construct the Phase Three garage or within
three years from the date of this letter, whichever event first
occurs. I further agree that at that time the required curbs and
gutters will be installed in accordance with the ordinances of the
City of Chanhassen. To assure timely performance of the
installation of site curbs and gutters as agreed, I enclose a
Letter of Credit from the State Bank of Chanhassen in the amount
of $7,700 (110% of the agreed estimated cost of the installation
of the required curbs and gutters), payable to the City of
Chanhassen, and which can be drawn on by the City and used by it
to pay for the installation of said curbs and gutters in the event
I do not have the same installed in accordance with my agreement
as set forth herein.
If this letter is in accordance with your understanding of our
agreement, would you kindly initial the enclosed copy of this
letter and return it to me in the enclosed self - addressed
envelope. Thanks.

Dear Mr. Krause:
t It has been called to our attention that the Performance Bond for the
Quattro Garage will expire this December 15th. This bond was
originally required to assure the installation of concrete curbs
1 about the paved area of the Quattro Garage, located in Park One.
Please be advised that Mr. Beddor would like to request an additional
three (3) year extension for the installation of curbing.
' The curbs were deferred for two reasons: an anticipated expansion
would require their removal shortly after installation; and the curbs
' present a safety hazard to helicopter landings. While the expansion
is no longer eminent, the safety issue continues. As there has been
no errosion, maintenance or other difficulties encountered by lack of
' curbs, we do not believe this extension will in any way affect the
public interests or health and welfare.
