7a. Proposed Target Dev City Code Amendment Rezoning Property for BG to PUD, final reading 7 A- J Note: First Reading of this ordinance was approved on September 28, 1992. Approval of second and final reading CITY OF CHANHASSEN is recommended . CARVER AND HENNEPIN COUNTIES, MINNESOTA DWA ORDINANCE NO. AN ORDINANCE AMENDING CHAPTER 20 OF THE 1 CHANHASSEN CITY CODE, THE CITY'S ZONING ORDINANCE, BY REZONING CERTAIN PROPERTY 1 THE CITY COUNCIL OF THE CITY OF CHANHASSEN ORDAINS: Section 1. Chapter 20 of the Chanhassen City Code, the City's zoning ordinance, is hereby amended by rezoning all property shown on attached Exhibit A from BG, General Business District to PUD, Planned Unit Development. All property rezoned is contained within the plat of CHANHASSEN RETAIL ADDITION. Section 2. The rezoning of this property is subject to the following conditions: 1 1. The applicant shall enter into a PUD Agreement and development contract containing all of the conditions of approval for this project and shall submit all required financial guarantees. The PUD Agreement and development contract shall be recorded against the property. 2. The applicant shall meet all conditions of the PUD #92 -5, Site Plan Review #92 -2 and Interim Use Permit #92 -6. ' Section 3. The zoning map of the City of Chanhassen shall- not be republished to show the aforesaid zoning, but the Clerk shall appropriately mark the zoning map on file in the Clerk's Office for the purpose of indicating the rezoning hereinabove provided for in this ordinance, and all of the notations, references, and other information shown thereon are hereby incorporated by reference and made a part of this ordinance. Section 4. This ordinance shall be effective immediately upon its passage and publication. 1 PASSED AND ADOPTED by the Chanhassen City Council this day of 1992.
