Attached you will find a request from Todd Christopherson, Project Manager for Amcon Corporation, requesting
I an extension of the daily work hours to 9:00 for the earthwork operations on the Market Square project. The
general conditions of the development contract specify that working hours are limited to Monday through
Saturday from 7:00 a.m. to 6:00 p.m. AMCON is requesting daily work hours to last until 9:00 p.m. for the
I duration of the earthwork operations approximately three weeks. Considering the extent of poor quality soils
on the site and the fact that the weather as of late has been very favorable to performing these soil correction
operations, this appears to be a reasonable request.
I In observing the general land use around the site, it is evident that the closest residential properties are located
on Laredo Drive at Chan View approximately 800 feet from the site. The other obvious concern would be for
the clientele at the Country Suites Hotel. Staff did make contact with the management at the hotel to inform
I them of this temporary extension of working hours. They did not see a problem and suggested approving the
request on a trial basis. With the recent time change to daylight savings, the amount of evening work during
dark conditions should be minimal (less than one hour).
I It is therefore recommended that the working hours for the earthwork operations at the Market Square Project
No. 92 -2 be extended to 9:00 p.m. Monday through Saturday on a conditioned basis in order to expedite
completion of this portion of the project.

As we discussed at our meeting last week. we are requesting the City's permission to

extend operations of earthwork activity and hauling of dirt to and from our site.
Currently, we are limited to the hours of 7:00 A.M. to 6 :00 P.M. We are requesting that
these be extended until 9:00 P.M. starting immediately and ending at the completion of

tte project. This will allow us to complete the required soil correction work and site
grading work within the scheduled time frame for completion of the project.
