Mr. Amoruso's house is I currently located in the easement which was conveyed in 1989. Staff believes the easement description was prepared in error since the actual utility lines lie north of Mr. Amoruso's property. According to City records, there are no public utilities within I this utility easement. Therefore, it is recommended that the City Council approve vacation of the southerly 20 feet of the 25 -foot wide utility easement. The remaining northerly 5 feet of the I utility easement adjacent to the property line is consistent with the subdivision ordinance whereby the City requires a 5 -foot side yard drainage and utility easement.
