1 SUBJ: Hazeltine /Bavaria Watershed District, Decline Membership
I In 1982, the legislature required that all watersheds within the
metro area formally be recognized as a separate district having
specific powers including administration, planning, and execution
I of a storm water plan for that district. The process of developing
a plan for the Hazeltine /Bavaria District was slow in the early
years, but has picked up momentum in the last two to three years.
I As Chanhassen technically has land areas within the Bavaria
District, we have a right to select a member to sit on the district
board. Victoria, like Chanhassen, has such a small land area in
the Bavaria District that they requested and received approval for
I not having a representative on that board. Chanhassen has two
relatively small parcels in the Bavaria District - -a 17 acre parcel
north of West 82nd Street and west of Highway 41, and a 5 acre
I parcel at County 117 and County 14. In total, the Bavaria
Watershed District is in excess of 8,000 acres, making Chanhassen's
representation approximately .03 of 1% of the total land area.
I Another reason to consider declining membership is the fact that no
residences or other improvements exist on the 22 acres in
Chanhassen and in the Bavaria District.
I This office would recommend that the attached letter to the City of
Chaska and appropriate state agency be approved.

Re: Chanhassen Membership, Hazeltine /Bavaria Watershed District
Dear Mr. Pokorney:
1 Attached please find the report I prepared for our City Council
considering potential membership on the Hazeltine /Bavaria Watershed
1 District. For all practical purposes, the City of Chanhassen has
virtually no lands within the Bavaria District and, accordingly,
our membership on the Hazeltine /Bavaria Watershed District could
not realistically provide a representative vote on watershed
1 district matters. An additional factor is the recognition that of
the 22 acres lying within the City of Chanhassen and Bavaria
District, none of these acres include any home sites or other
permanent improvements.
The City of Chanhassen recognizes that future improvements may
' represent benefits to properties lying within the City of
Chanhassen. By this letter, we hereby acknowledge the necessity
for the City of Chanhassen to potentially work with the watershed
district in determining how these benefits may be assessed back to
1 Chanhassen properties. However, in the interim, we do not see
where our membership on the district board could truly benefit
property owners who do live and work within the district itself.
1 Accordingly, we would ask that you submit this letter to the state,
on the behalf of both cities, requesting that Chanhassen not be
required to select a representative to sit on the Hazeltine /Bavaria
1 Watershed District Board.

Dear Don:
A number of years ago Chaska, Chanhassen, and Laketown Township created
through the Joint Powers Agreement the Hazeltine- Bavaria Watershed
Management District. Under the terms of the Agreement Chanhassen is to
appoint one member to the Board along with four members from Chaska and
one from Laketown Township. Approximately 18 months ago the Board directed
Bonestroo Rosene Anderlik & Associates, a consulting firm, to prepare a
Watershed Management Plan for the District. A draft of that Plan has now
been completed, a copy of which has been included for your review.
We have scheduled a meeting of the District for January 13, 1992 at 7 p.m.
at the Chaska City Hall. Since it isn't clear from our records who the
present Chanhassen representative is on the Board I am forwarding a draft
report and the meeting notice to you so that it can be forwarded to the
appropriate individual.
