Improvement Project No. 90 -13
On Monday, August 26, 1991, the City Council awarded the Market Square Storm
II Sewer Extension Project No. 90 -13 to Shafer Contracting Company, Inc. at a bid
of $176,983. The proposed right turn lane on West 78th Street at Market
Boulevard, the right turn lanes on Market Boulevard and the bus shelter
relocation were all part of the overall project scope of improvements associated
II with the proposed Market Square development project. At the time of the award
of this contract it was still uncertain as to the exact date for which all the
necessary documents and transactions would be completed to secure the ground •
II breaking for the Market Square development. Therefore, the City, as.a part of
the bidding process for this project, secured a 90 -day time period to award the
bid. The actual award was contingent upon the necessary property transaction
II securities of the Market Square development taking place. This 90 -day time
period expired on November 11, 1991.
At this time, the Market Square development project still appears to be a
II potential project for the 1992 construction season. Therefore, Shafer
Contracting Company, Inc. has been asked if they would be willing to guarantee
their current bid prices for performing this project in 1992. However, due to
II the uncertainty of their future project scheduling and in relation to the
construction and coordination with Trunk Highway 5, Shafer Contracting Company,
Inc. has stated that they cannot extend the time period for their bid prices.
1 Therefore, it would seem appropriate that the City Council take formal action to
reject all bids for the Market Square Storm Sewer Extension Project No. 90 -13
which were received and opened on Tuesday,. August 13, 1991. I would anticipate
II that this project would be scheduled for re- bidding again in the spring of 1992.

Shafer Contracting Company, Inc., has responded to our letter dated
Planning November 13, 1991, regarding their willingness to be retained for

Thresher Square Shafer has stated that they do not wish to be retained at their
