Date TO: Charles Folch, City Engineer Approved by ity Cou 1 FROM: Dave Hempel, Sr. Engineering Technician - I DATE: January 7, 1992 SUBJ: Consider Request for Amendment to Conditions of Approval for Minnewashta Highlands II Project No. 88 -6 II Attached is a letter from the developer, Ellie Schwaba, requesting the City Council amend Item 8K in the development contract for Minnewashta Highlands to allow issuance of a certificate of II occupancy for Lot 2, Block 1 prior to acceptance of the utilities by the City. The utilities in Minnewashta Court had been tested and approved last fall; however, due to the early arrival of winter, the project was unable to be blacktopped. This lot does I have an existing sanitary sewer and water service stub available from Minnewashta Parkway which is proposed to be utilized. A building permit has been issued for Lot 2 with the understanding I that no certificate of occupancy would be issued without amendment to the development contract by the City Council. The City's policy in the past has been to allow building and I occupancy permits for those lots that are adjacent to a hard - surfaced street which this lot does (Minnewashta Parkway) when sewer and water services are available even though the streets are I not paved or utilities accepted. This request is consistent with previous requests from other developments, i.e. Kurvers Point 2nd Addition, Lake Susan Hills West 4th, 5th and 7th Additions and I Trappers Pass 4th Addition. Therefore, it is recommended that Item K under Section 8 "Other Special Conditions" in the development contract for Minnewashta I Highlands be amended as follows: "No occupancy certifications will be issued nor building utility connections allowed until such time as the utility portion of the public improvements have been tested 1 and accepted by the City except for Lots 1 and 2, Block 1, as noted tli, PRINTED ON RECYCLED PAPER 1 Charles Folch January 7, 1992 Page 2 • in 'd' above ". Notices. The cul -de -sac shall be constructed to City I standards for urban roadways. B. The applicant shall apply for and obtain per- 1 mits from the Watershed District, Department of Natural Resources and other appropriate regulatory agencies and comply with their 1 conditions of approval. C. Construction on Minnewashta Parkway shall be prohibited. I D. Lot 1, Block 1 shall obtain utility service by connecting to the existing sanitary sewer and water service stubs along Minnewashta Parkway. A connection charge of $6,369.64 shall I be paid with the building permit application for Lot 1, Block 1, which includes all City trunk hook -up charges for this lot. E. Utility service to Lots 2 through 5, Block 1 1 shall be obtained by connecting to the new sanitary sewer and watermain to be constructed in the new cul -de -sac. The City's hook -up charges for sewer and water trunks as well as the • I Metropolitan service availability charge (S.A.C.) will be due with building permit issuance except for Lot 4, Block 1 which has already been paid. F. An acceptable grading plan shall be provided by I the Developer for the corrective sight distance grading of Lots 4 and 5 prior to the issuance of building permits. II • SP -3 ATTACHMENT 1 II 4 G. A 15 -inch diameter culvert will be required underneath the northerly proposed driveway. H. A grading, drainage and erosion control plan for each lot will be required as part of the building permit application process. I. All private accesses shall be served by the internal cul -de -sac. No private accesses shall be allowed onto Minnewashta Parkway. 1 J. The accessory building on Lot 3 shall be removed and properly disposed of. 4C10 occupancy certifications will be issued, nor ' building uti y connections allowed, until such time as the uti- lity portion of the public improvements have been tested and accepted by the City, except for Lot 1, Block 1 as noted in "D" ' above. L. All building construction traffic shall restrict their access to the subdivision to one access point; that being the location of the new cul -de -sac connection. M. Landscaping along the rear of Lots 1 through 3 shall be installed immediately after the overall lot grading is completed. 1 9. General Conditions.
