This has caused a problem in that city crews have been unable to adequately plow municipal lots, as well as having people park for excessive time periods, and I in some cases even abandoning vehicles in these lots. ANALYSIS I Because existing ordinance does not regulate parking in municipal lots, the need exists to regulate parking in these areas, as well I as to provide the City with the authority to take action. Also recommended is a $10.00 permit fee ($10.00 is the usual fee we I charge for processing other permits to cover administrative time). RECOMMENDATION I It is the recommendation of Staff that the attached ORDINANCE AMENDING CHAPTER 12 OF THE CHANHASSEN CITY CODE CONCERNING PARKING II OF MOTOR VEHICLES be passed. ' AN ORDINANCE AMENDING CHAPTER 12 OF THE CHANHASSEN CITY CODE CONCERNING PARKING OF MOTOR VEHICLES THE CITY COUNCIL OF THE CITY OF CHANHASSEN ORDAINS: Section 1. Chapter 12 of the Chanhassen City Code is amended by adding Article III, Parking of Motor Vehicles, to read as follows: ARTICLE III. PARKING OF MOTOR VEHICLES ' Sec. 12 -5 Parking. A. Permit. On a space available basis, the Chanhassen Director of Public Safety shall issue permits authorizing over- night parking in municipal parking lots. The permit shall specify the date and lot for which the overnight parking is permitted. The permit fee shall be established by resolution of the City Council. No individual shall be given a permit authorizing over- night parking of more than seven (7) days in a calendar year. ' B. Prohibition. Without a permit issued by the City, no owner of a motor vehicle shall park or permit the same to be in a municipal parking lot between the hours of 2 o'clock a.m. and 4 o'clock a.m. All municipal parking lots shall be signed with this parking restriction. Sec. 12 -51. Towing. A. Towing Order Required. Motor vehicles parked in violation of Section 12 -50 may be towed. Before the motor vehicle ' is towed, a peace officer or parking enforcement officer must prepare, in addition to the parking citation, a written towing report describing the motor vehicle and the reasons for towing. The report must be signed by the officer and the tow driver. B. Four -hour Waiting Period. A motor vehicle parked in ' violation of Section 12 -50 may not be towed until four (4) hours after issuance of the traffic ticket or citation. Section 2. WHEREAS, the City of Chanhassen has the authority to regulate overnight parking in municipal parking lots; and WHEREAS, the Director of Public Safety may issue permits authorizing limited overnight parking in municipal parking lots.
