Negative Declaration
BACKGROUND
As a part of the review of the Chanhassen Business Center PUD #91 -4 an Environmental
Assessment Worksheet was required. Final approval of this project could not be given until
' publication in the EQB Monitor, and allowing for a 30 -day comment period. This comment
period expired on February 6, 1992.
1 ANALYSIS
The City has received comments from the Metropolitan Council, Pollution Control Agency,
' Department of Natural Resources, and the Historical Society. Staff has responded to the
comments each of these agencies have made. Most of these comments have been
addressed in the staff report and thoroughly discussed as a part of the review process by the
1 Planning Commission and City Council. More specifically, many of the comments, including
items such as type of erosion control, limitation of the temporary pond, NURP standards,
etc. are in the conditions of approval. Where concerns were raised by - a reviewing agency,
1 - staff prepared response letters indicating how the concerns have been resolved. The
comments have raised no new issues warranting further study.
1 The comments from the various state agencies will be made a part of the Environmental
Assessment Worksheet (EAW). Based on the comments received, a Environmental Impact
Statement (EIS) will not be required. The City Council needs to make a negative
1 declaration for an EIS and acceptance of the EAW.

project. The Environmental Review Program rules (at Minnesota Rules,
part 4410.1500, item B) require that a press release containing
notice of the EAW availability be provided to at lea §t one newspaper
of general circulation within the area and that copies of the EAW be
distributed to all points on the EQB distribution list. We presume
• that these requirements have been met.
Notice of the EAW availability will be published in the EOB Monitor
on January 6, 1992. The 30 -day comment period will begin on that day
and will expire on February 5, 1992.

governmental decision to grant a permit, approve the project, or
• begin the project may be made until a negative declaration or EIS

1 The Council approved the following recommendations contained in the above report:
• 1. That the Council adopt the report findings and the staff report as part of these
recommendations.
2. That the Council advise the city of Chanhassen that the EAW is incomplete and that
' the city should indicate:
* the physical characteristics and design criteria of the temporary detention basin
' site on lot 6;
* the floodplain mitigation will be on a 1:1 ratio;
* the timeline for the construction of permanent and temporary stormwater runoff
basins;
* the number of acres generating stormwater runoff;
* the location of the ditch and swale area.

1 Thank you for the opportunity to review and comment on the Environmental
Assessment Worksheet (EAW) for the proposed Chanhassen Business Center. Based
on the information contained in the EAW, the Environmental Analysis Office
' staff believes that significant environmental effects are not likely to occur
as a result of this project. The preparation of an Environmental Impact
Statement (EIS), therefore does not appear to be warranted. We do have,
1 however, a number of comments concerning the proposed project.
1. Wetlands
1 Question 10 of the EAW identifies 0.75 acres of wetlands existing on the site.
The discussion and the maps do not provide a clear description of the location.
Will this wetland area be incorporated into the storm detention pond? What
precautions will be taken to protect the wetland area? The EAW should clarify
if any wetlands will be effected as a result of this project.
1 2. Sewer Extension Permit
It should be noted on question 8 that a sewer extension permit is required from
1 the MPCA.
3. Erosion Control Plan
1 Question 17 indicates that an erosion plan will be developed in conjunction
with city and Watershed District standards. This plan should mitigate possible
effects on the Minnesota River by incorporating the following measures:
1 1. Grading operations should be staged in increments of area of workable
size so that adequate control of erosion and siltation can be provided and
maintained during the construction period.
1 2. Temporary vegetation and /or mulching should be used to protect areas
exposed during construction.

3. Permanent vegetation should be installed within thirty days after 1
completion of initial grading.
4. A system for routine inspection of the erosion control devices should
be developed. This should include an inspection regime that is used after
storm events.

' Thank you for providing this office a copy of the Environmental Assessment Worksheet
for the above - referenced project. It has been reviewed pursuant to responsibilities
given to the Minnesota Historical Society by the Minnesota Historic Sites Act and the
Minnesota Field Archaeology Act and through the process outlined in Minnesota Rules
4410.1600.
You have indicated that four brick farmhouses are located in the area of the proposed
project. We concur that these farmhouses merit consideration for listing on the Na-
tional Register of Historic Places, and should be protected.
In the absence of any reported archaeological properties, we have also evaluated the
likelihood that any such properties may be present. Although we cannot state with
certainty that there are no significant unreported archaeological properties within
the project area, we feel that the probability of such properties being present is
low.

If the project will not affect the four brick farmhouses, we have no further comment.
On the other hand, if there will be effects on any of these buildings, we would like
to work with you further to address possible avoidance or mitigation measures.
Please note that this comment letter does not address the requirements of Section 106
of the National Historic Preservation Act of 1966 and 36CFR800, Procedures of the Ad-
visory Council on Historic Preservat_ion fnr the protection of historic properties.
If this project is considered for federal assistance, it should be submitted to our
office with reference to the assisting federal agency.

Dear Mr. Krause:
The Department of Natural Resources has reviewed the EAW for the proposed Chanhassen '
Business Center. We offer the following comments for your consideration.
The National Wetlands Inventory shows a partially drained wetland in the vicinity of lots 6 1
and 7, which is not mentioned in the EAW. The proposer should contact the U.S. Army
Corps of Engineers to determine whether a Corps Section 404 permit is required for
development in this area. 1
A buffer strip of at least 25 feet should be maintained along Bluff Creek; the bluff impact
zone should be left undisturbed and structures must be set back a minimum of 50 feet from
the creek and 30 feet from the top of the bluff. There should be no grading of the creek bed
proper, which cause serious erosion and sedimentation problems. The remaining grading,
next to the creek, would create or restore wetland values and thus would be acceptable to us.
The proposed stormwater treatment pond, proposed as part of Phase 11 construction, is
especially appropriate and needed in this type of development.
Thank you for the opportunity to review this EAW. From a natural resources management 1
perspective, the project does not appear to require preparation of an Environmental Impact
Statement. We look forward to receiving your record of decision and responses to our
