A simple majority vote of City Council present.
BACKGROUND
The city attorney's office is recommending that the fees be adopted by
ordinance.
Minn. Stat. § 462.353, subd. 4, which provides as follows:
Subd. 4. Fees. A municipality may prescribe fees sufficient to defray the
costs incurred by it in reviewing, investigating, and administering an
application for an amendment to an official control established pursuant to
sections 462.351 to 462.364 or an application for a permit or other approval
required under an official control established pursuant to those sections.
Fees as prescribed must be by ordinance and must be fair, reasonable, and
proportionate to the actual cost of the service for which the fee is imposed.
A municipality shall adopt management and accounting procedures to ensure
that fees are maintained and used only for the purpose for which they are
collected. (Italics added)
If a dispute arises over a specific fee imposed by a municipality related to a
specific application, the amount of the fee must be deposited and held in
escrow, and the person aggrieved by the fee may appeal under section
462.361. An approved application may proceed as if the fee had been paid,
pending a decision on the appeal.
Staff is proposing that fees be incorporated in the City Code as Chapter 4, which
is currently reserved. At the present time, we are not changing any of the fees,
only consolidating them itt one section. In January, the fee schedule will be
revised.

The fees for the rental licensing program are based on the direction at the
August 11th City Council work session. The staff recommendation was to
reduce the service level of the rental inspection. Fifty-dollars per unit would
still be the fee, but the license would be good for two years as opposed to one
year. The City Council did discuss not requiring a fee for newly built rental
units for the first two years. Part of the fee for the licensing also pays for the
cost of administration of the conduct on premise portion of the ordinance.
Therefore, the fees for a license should still be required to cover the costs of
administrating the program. Changes to the administration of the rental
licensing program will be made as part of the amendment to Chapter 10 of the
Chanhassen City Code.
Staff is anticipating that all rental units be inspected by March of 2004.
RECOMMENDATION
Staff is recommending that the City Council adopt the attached ordinance for
Chapter 4 of the Chanhassen City Code; and approve the summary ordinance for
publication purposes.

THE CITY COUNCIL OF THE CITY OF CHANHASSEN, MINNESOTA ORDAINS:
Section 1. The City Code, City of Chanhassen, Minnesota, is hereby amended by adding
a new chapter 4 to read as follows:
Chapter 4. LICENSE, PERMIT, AND ADMINISTRATIVE FEES.
ARTICLE I. IN GENERAL
Sec. 4-1. Policy and Purpose of Chapter. By the enactment of this Chapter, the City
Council intends to establish fees for licenses and permits required by the City Code.
Sec. 4-2. Application of Chapter. Where a direct conflict exists between the amount of a
license or permit fee set by any provision of this Code and a fee set by this Chapter, the
fee set by this Chapter applies.
ARTICLE II. LICENSE AND OTHER BUSINESS AND PUBLIC SAFETY
RELATED FEES.
Sec. 4-15. Fees Set. The fees for the various licenses required by this Code are set forth
in this section as follows:
(a) Liquor License Fees

Section 4-30. The fees and charges for the various permits required by this Code are set

(a) Building Permit and Fire Prevention Fees
Building permit fees shall be as set forth in Table 1-A. When submittal of plans is
required, and the valuation is more than $3,000.00, a plan review fee equal to 65%
of the permit fee, shall also be charged.

2. Individual Sewage Treatment System permit fees shall be as set forth in Table I-A.
When submittal of plans is required, a plan review fee equal to 65% of the permit
fee shall also be charged.
3. Fire suppression and fire alarm permit fees, and fees for other construction permits
issued in accordance with the Minnesota State Fire Code, shall be as set forth in
Table 1-A. When submittal of plans is required, a plan review fee equal to 10% of
the permit fee shall also be charged.
