BACKGROUND
On August 8, 2011, the City Council held a public hearing for the Environmental
Assessment for this project.
On November 14, 2011, the City Council was updated on the status of the project and
the comments and responses received at the public hearing.
On December 12, 2011, the City Council approved a resolution accepting the
environmental assessment and making a negative declaration on the need for an EIS.
On April 23, 2012, the City Council approved a funding agreement with the
Minnesota Department of Transportation (MnDOT) for design and right -of -way
acquisition (Agreement No. 00789).

On January 15, 2013, the Planning Commission held a public hearing for a Wetland Alteration
Permit for the corridor. Staff did not receive any comments.
On January 28, 2013, the City Council approved the plans and specifications and authorized
advertisement for bids for the project and approved a Joint Powers Agreement with Carver County
and a Cooperative Agreement with MnDOT.
On February 25, 2013, the City Council approved a construction agreement and state funding
agreement, Contract #03091, with the State of Minnesota.
This segment of TH 101 is proposed to be reconstructed to a four -lane divided design with
pedestrianibicycle trails along both sides of the roadway. The primary goals of the project are as
follows:
Improve safety for people along the existing TH 101 corridor.
• Reduce crashes to the extent possible.
• Add turn lanes to provide safe turning movements at intersections.
• Improve sight distance by reducing sharp curves and steep grades near intersections.
Improve capacity and connectivity along the TH 101 corridor.
✓ Accommodate regional and local transportation needs of anticipated population and employment
growth in the TH 101 corridor by increasing traffic capacity.
The proposed design is consistent with the
environmental document that was completed in
2011. Additionally, three storm ponds will be
constructed to treat stormwater runoff from this
section of TH 101. These ponds have also been
oversized to treat runoff from local streets when
these streets are reconstructed in the future. A
pedestrian underpass under TH 101 is proposed
along with a new trail on the west side of TH 101.
The access location to Bandimere Park will be
moved farther to the north for better visibility and
safety. This access also aligns with the driveway on
the west side of TH 101. New trunk watermain is
planned to be constructed along this segment of TH
101 to plan for future growth in the area. A sewer
stub from the existing 96th Street lift station will be
provided across TH 101 for potential future service
to the Foxford Road area and the existing forcemain
for the lift station will be replaced.

The project is being completed in cooperation with MnDOT and Carver County since TH 101 is
currently under MnDOT jurisdiction and the roadway will be turned over to Carver County for
ownership and future maintenance.
The project required the acquisition of permanent right -of -way and /or temporary easements from
twelve individual properties. The acquisition needs of the project also include the dedication of
right -of -way from the Bandimere Park property and the acquisition of two residential properties
from Mark and Kari Nettesheim along the north side of the park. The westerly Nettesheim property
was paid for with State project funds. The eastern Nettesheim property was paid for using City Park
Dedication funds. All necessary right -of -way has been acquired for the project at this time.
BIDS
On Tuesday, March 19, 2013 at 2:00 p.m., two bids were received for the TH 101 Improvements
Project 12 -06. The bids have been tabulated and checked for errors. The bids received were as
follows:
The low bidder is Eureka Construction, Inc., with a total bid amount of $7,434,402.60 which is
approximately 23% under the engineer's estimate of $9,668,000.00. Eureka Construction is also the
contractor for the City's TH 101 and Pleasant View Road Intersection Improvements, Project 11 -05.
City staff has checked local government references for Eureka and they have a good reputation in the
construction industry. This project did generate a lot of interest by contractors. Staff checked with
contractors that did not submit a bid. The reason some contractors did not submit a bid was because
they were worried about the poor soils on the job site, potential significant delays if the summer was
to be rainier then normal and the tight completion date.
MnDOT and Carver County has reviewed the bid results and contractor information and have both
concurred with the award of the contract to Eureka.
Based on the low bid price, the total project cost is approximately $10,600,000. This cost includes
final design, right of way acquisition, construction administration /inspection/testing, and
construction costs.
Funding for the construction of the TH 101 Improvements project has been programmed to come
from several sources including Federal Surface Transportation Program (STP) funding that the City
secured through the 2009 regional solicitation process, other State funds, Carver County funds, and
City funds. The following is a summary of the proposed construction financing plan:

*The MnDOT Funding Agreement includes a total of $1,500,000 in County Turnback Funds. Since
the current project budget requires only $500,000 of these funds, the remaining funds are set aside
for as contingency funds to address any unforeseen conditions or changes during construction.
Construction administration contract which will include construction observation, geotechnical
testing and surveying which will be brought back to the Council for consideration at the next
Council meeting. Most of this cost will be paid by State funds but the City and the County will be
responsible for their work items.

WHEREAS, the City of Chanhassen is planning to implement Municipal State Aid
Street Project 194 - 010 -011 in 2013 that will require State Aid funds in excess of those available
in its State Aid Construction Account, and in the Flexible Highway Account (Municipal
Turnback Account); and
WHEREAS, City of Chanhassen is prepared to proceed with the construction of Project
194 - 010 -011 through the use of an advance from the Municipal State Aid Street Fund to
supplement the available funds in their State Aid Construction Account, and in the Flexible
Highway Account (Municipal Turnback Account); and
WHEREAS, the advance is based on the following determination of estimated
expenditures:

from Municipal State Aid Street Fund; and
WHEREAS, Minnesota Department of Transportation's Metropolitan District has
agreed, by the attached letter from Scott McBride, MNDOT Metropolitan District Engineer, to
Julie Skallman, State Aid Engineer, dated October 10, 2012, to repay the advance with district
funds if the Municipal Turnback Account does not receive appropriations sufficient to repay the
advance.
WHEREAS, MNDOT Agreement No. 03649 provides $1,500,000.
NOW, THEREFORE, BE IT RESOLVED by the Chanhassen City Council that the
Commissioner of Transportation is hereby requested to approve this advance for financing
approved City of Chanhassen Municipal State Aid Street Project 194 -010 -011 in an amount up to
$1,500,000.00. The Commissioner of Transportation hereby authorizes repayments from
subsequent accruals to Chanhassen's Municipal State Aid Street Construction Account from
future year allocations until fully repaid should the Minnesota Department of Transportation fail
to make the payment established by MNDOT Agreement No. 03649.

City of Chanhassen intends to request an advance of funds from the Municipal State Aid
Street Fund for State Project 194 - 010 -011, a local federal project on Minnesota Highway 101.
The city is leading this project which will result in a transfer of roadway jurisdiction to Carver
County. The limits of the construction project and transfer are from Lyman Boulevard to Pioneer
Trail.
In lieu of the availability of all funds needed for construction of the project in 2013, the city
will request a municipal fund advance of up to $3,000,000. Repayment of funds advanced to the
city is planned for year 2016 from future allocations to the Municipal Turnback Account (MTB).
Funds sufficient to repay the total advance amount are included in Metro District's 2016 turnback
funding program. Metro District State Aid Office will request allocation of the funds to the MTB
account through State Aid for Local Transportation division for inclusion in the commissioner's
recommendations to the governor's fiscal year 2016 -2017 biennial budget. Attached is a
description and schedule for request and repayment of the funds from the Flexible Highway
Account to the MTB.
If, for any reason, sufficient funds are not allocated to the Municipal Turnback Account to
repay the advance, Metro District will repay the balance of the advance with its district funds.

This agreement is between the State of Minnesota, acting through its Commissioner of
Transportation ( "STATE ") and the City of Chanhassen, acting through its City Council
( "CITY').
Recitals
State Project No. 194- 010 -011 (AKA S.P.1009 -22) is a federal aid project lead by
City; and City is responsible for preparing construction plans, and for assembling
right of way and permits to construct the project.
2. City is willing to use its resources to provide project management and perform
project development tasks for State Project No. 194 - 010 -011.
3. State, City, and County of Carver by Minnesota Department of Transportation
Agreement ( MNDOT) Agreement No. 97020 have agreed to cooperatively
develop plans for improvements to, along, and adjacent to Minnesota State
Highway No. 101(MN 10 1) from Lyman Boulevard to Pioneer Trail within the
corporate limits of the City of Chanhassen.
4. Under MNDOT Agreement No. 97020, City agreed to be the State's and Carver
County's agent for procurement of engineering services to develop project plans.
5. Under MNDOT Agreement No. 02934, City agreed to be the State's agent for
procurement of contract for construction of State Project No. 194 - 010 -011.
6. Under MNDOT Agreement No. 97687, the State and Carver County agreed to
transfer jurisdiction of Minnesota State Highway No. 101(MN 10 1) from Lyman
Boulevard to Pioneer Trail from State to Carver County after completion of State
Project No. 194- 010 -011; and that the roadway will be designated a County State
Aid Highway route.
7. Upon completion of the project and transfer of the highway to Carver County,
State will have no further obligations or any responsibility for improvement or
maintenance of the portion of MN 101 transferred.
8. Under Minnesota Statutes Section 471.59, subdivision 1, State and City may enter
into an Agreement to cooperatively exercise any power common to the
contracting parties, and one of the participating governmental units may exercise
one of its powers on behalf of the other governmental unit.

Agreement
1. Term of Agreement
This agreement will be effective upon execution and approval by the appropriate
City and State officials pursuant to Minnesota law and will remain in effect until
all obligations hereunder are performed, or until terminated in accordance with
Article 7.
2. Authorized Representative
2.1 State's authorized representative for purposes of administering this
Agreement is Cyrus Knutson, 1500 W Co Rd B2, Roseville, MN, 55113,
651- 234 -7769, cyrus.knutson(cr,state.mn.us or his successor in office.
2.2 City's authorized representative for purposes of administering this
Agreement is Paul Oehme, P.E. Public Works Director /City Engineer,

3. State Responsibilities.
3.1 Upon execution of this agreement, and receipt of an invoice from the City,
the State will pay City for eligible project expenses up to an amount of
$1,500,000 for State Project No. 194 - 010 -011. Eligible expenses are all
contract expenses for project development and construction including
acquiring construction plans; and construction contract administration; and
construction staking; and geotechnical and construction testing; and the
cost of acquiring the right of way subject to prior agreement under
MNDOT Agreement No. 00789. Eligible project expenses will be those
amounts actually and necessarily incurred by the City, without markup.
Charges for work performed by City staff will be at the actual rate of pay
plus normal and customary labor additives.
3.2 After completion of State Project No. 194 - 010 -011, and after payments are
completed under 3.1 of this agreement, the state will convey pre- existing
Minnesota State Highway No. 101 rights of way to Carver County as part
of jurisdictional transfer of the highway by separate agreement.
4. City Responsibilities:
4.1 The City will perform all acts reasonably necessary to accomplish State
Project No. 194 - 010 -011 including but not limited to contracting for
construction, and for contract administration, and supervision of
contractors.
4.2 The City will keep a detailed and itemized accounting of eligible
expenses, including all supporting documentation.

5. Liability. Each party is solely responsible for its own acts and omissions and the
results thereof to the extent authorized by law. The State's liability is governed
by Minnesota Statutes §3.736 and other applicable law. The City's liability is
governed by Minnesota Statues chapter 466 and other applicable law.
6. Audit. Under Minnesota Statutes § 16C.05, subd. 5, the books, records,
documents and accounting procedures and practices of State and City relevant to
this Agreement are subject to examination by MNDOT and the State Auditor or
Legislative Auditor, as appropriate, for a minimum of six years from the end of
this Agreement.
7. Termination. This agreement may be terminated only by mutual agreement of
the parties, except that the State or City may terminate this agreement if funds
sufficient to carry out this agreement are not appropriated by the Minnesota
Legislature or the Chanhassen City Council. If this agreement is terminated due
to non - appropriation of funds, the City may use the available State funds for costs
incurred by the City pursuant to this agreement, as of the date of termination, an
amount not to exceed $1,500,000, and all the property, and construction plans
acquired with funds provided by Section 3.1 shall be transferred to the State; and
all remainder funds shall be returned to the Flexible Highway Account established
by MS 161.081, Subd.3.
8. Assignment, Amendments, and Waiver
8.1 Assignment. Neither party may assign nor transfer any rights or
obligations under this Agreement without the prior consent of the other
party and a fully executed Assignment Agreement, executed and approved
by the same parties who executed and approved this Agreement, or their
successors in office.
8.2 Amendments. Any amendment to this Agreement must be in writing and
will not be effective until it has been executed and approved by the same
parties who executed the original agreement, or their successor in office.
8.3 Waiver. If a party fails to enforce any provision of this Agreement, that
failure does not waive the provision or the party's right to enforce it.
9. Data Practices Act
The City and the State must comply with the Minnesota Government Data
Practices Act, Minnesota Statutes Chapter 13, as it applies to all data created,
collected, stored, or received by a party pursuant to this Agreement.

I have received a copy of the certified low bid and Abstract of Bids for the above referenced project. The
letting date was March 19, 2013. The tabulation shows that the apparent low bidder is Eureka
Construction, Inc, in the amount of $7,434,402.60 which is 23% under the revised Engineers Estimate of
$9,668,247 prior to letting.
Our office concurs with the bid results memo dated March 29, 2013 which justified that the project
estimate was developed using unit prices based on recent bid results from similar projects and found
significant cost savings due to large quantities of bituminous, aggregate base, earthwork, and reduction in
the prorated items such as traffic control and dewatering.
In addition, l have received the Affirmative Action Certificate from Eureka Construction, Inc. indicating they
have not employed more than 40 full -time employees on any single working day in Minnesota within the
previous 12 months. Therefore, they are not required to hold a certificate of compliance issued by the
Miinesota Departmenet of Human Rights. I have been copied on the clearance letter from the MnDOT
Office of Civil Rights that Eureka Construction, Inc. has met the Disadvantaged Business Enterprise (DBE)
participation goal requirements.
City of Chanhassen is hereby authorized to award this project. The fully executed MnDOT Cooperative
Construction Agreement 02934 will follow this letter.

This project is proposed to make improvements on TH 101 from Lyman Blvd to Pioneer Trail. The improvements are proposed to improve safety,
mobility and to plan for future growth in the region. The project is consistent with the 2007 I01 corridor scoping study. Federal and state funds
are proposed to be used to pay for most of the improvements. The City will need to pay for extension of watermain consistent with the 2030
comprehensive plan, some storm sewer improvements, a portion of the corridor landscaping and sanitary sewer extension stub.
