Attached is a letter from the developer's engineer, Mr. William Engelhardt of Engelhardt
1 & Associates requesting the City of Chanhassen consider acceptance of the public utility
improvements in the above - reference project. This particular project was granted a six-
, month extension for installation of the public improvements; however, apparently due to
financial troubles the project still is not complete. Staff has placed this item on the City
Council agenda to help expedite closing of a house that was granted a building permit
I previously which is adjacent to Minnewashta Parkway. The new house is unable to hook
up to City utilities prior to the City formally accepting the utility improvements for
ownership and maintenance. City staff has acknowledged completion and approval of the
I necessary tests for acceptance; however, as of today staff still has not prepared a walk -
through punch list of any necessary minor adjustments.
I The letter of credit for this project is scheduled to expire on June 30, 1992. Staff has sent
a certified letter to the developer, Ms. Ellie Schwaba, requesting a 60 -day extension on the
letter of credit in order to complete the remaining public improvements with a deadline of
June 23, 1992 to respond with an amended letter of credit. Should staff not receive the
amended letter of credit, staff is prepared to draw on the existing letter of credit in order
to complete the outstanding public improvements. The outstanding public improvements
I consist of final wear course, minor landscaping and 21 Australian Pines. The grand total
of the draw request would be $9,500. The existing letter of credit currently on file is listed
in the amount of $16,360.

Therefore, it is recommended that the City Council accept the utility improvements
conditioned upon completion of the following items:
1. The developer supply a renewed letter of credit in the amount of $9,500 scheduled
to expire August 31, 1992.
' 2. The developer and /or contractor supply the City with a maintenance bond to
guarantee workmanship and materials for a two -year period from the date of
acceptance (June 22, 1992).
3. The developer's engineer shall supply the City with a mylar as -built set of plans along
with two blueline copies.

Re: Default of Development Contract - Minnewashta Highlands, Project No. 88-6
Dear Ms. Schwaba:
On December 9, 1991, the Chanhassen City Council approved your request to extend the completion date for
installation of the public improvements until May 31, 1992 for the above - referenced project. As of today, the
remaining public improvements consist of final wear course and some landscaping items.
On May 6, 1992 I sent you a letter regarding the status of the public improvements in Minnewashta Highlands.
In that letter I indicated that the public improvements needed to be completed by May 31, 1992 and requested
that you contact me no later than May 15, 1992 with a schedule for completion of the remaining improvements.
As of today, I have had no communications with you and there are still remaining site improvements that are
required to be completed prior to expiration of the letter of credit. The letter of credit is scheduled to expire
on June 30, 1992. Please be aware that the City is prepared to draw on the letter of credit unless an extension
to the letter of credit is received in my office by June 23, 1992. If the City does not receive the amended letter
of credit extending the expiration date of the letter of credit a minimum of 60 days, the City will proceed on
drawing on the letter of credit in the amount of 89,500 and proceed to have the remaining site improvements
completed and paid for out of the funds drawn on the letter of credit. Please contact me as soon as possible
regarding this project and no later than June 23, 1992.
On another note, the City is considering accepting utility improvements at the June 22, 1992 City Council meeting
contingent upon punch list items being completed and receipt of a two-year warranty bond and mylar as -built
plans. I will be sending you a copy of the staff report when it is completed within the next few days.
