-1 : _ft 0 VILLAGE OF CHANHASSEN RESOLUTION NO.12869 RESOLUTION CONCERNING TREATMENT FACILITY WHEREAS the Village Council of the Village of Chanhassen is duty- bound and obligated to protect the health and welfare of the residents of the Village of Chanhassen, and WHEREAS, the Village Council, in order to protect the said health and welfare of its citizens and to provide orderly development, has ini- tiated and implemented the following: 1. Installation of the original sewage collection and treatment facility in 1958, and expanded it several times, the most recent expansion in 1969; 2. Municipal water supply and distribution system in 1961, and 0 expansion by drilling of a new 1,000 GPM well in 1969; 3. Community growth guide plan approved by the Metropolitan Council and adopted by the Village Council in 1969; 4. Community park and open space plan approved by the Metropolitan Council and adopted by the Village Council in 1969, and the first bond issue for acquisition of land approved by the voters in 1969; 5. Adopted an orderly street numbering and renaming system in 1969, tieing into the Minneapolis grid; and WHEREAS, the sewage treatment plant serving the Village of Chanhassen has recently been improved by doubling its capacity to 140,000 gallons per day, and WHEREAS, present measured flows to the plant are about 78,000 gallons per day, and v 6 WHEREAS, municipal sewers are laid in streets and can serve approx- imately 200 additional family units, both single family and multiple units, which construction will substantially use up all of the capacity of the expanded sewage treatment plant, and WHEREAS, development and construction of at least 175 additional family units in multiple residential buildings is imminent, and WHEREAS, effluent from the Chanhassen treatment plant flows first into Rice Marsh Lake and thence into Riley Lake, both lying in Eden Prairie and Chanhassen, and WHEREAS, Riley Lake has shown signs of extreme algae pollution during the past summer, and adjacent residents have supported chemical treat- ment to temporarily alleviate the nuisance condition, and WHEREAS, orderly planning for present population requires that • "areas to be sewered immediately are those that pose threats to public health or could pollute natural resources" (ref: Metropolitan Council Newsletter, Volume II, Number 11, November 1969) and WHEREAS, "sewer systems should . . . be extended into communities only when residents are assured of governmental capability to provide a full range of urban services and exercise adequate planning and development control." (ibid) NOW THEREFORE BE IT RESOLVED, THAT for said Council of the Village of Chanhassen to provide for the continued protection of the health and welfare of its residents and the orderly development of its resources, it is necessary that sewage effluent be removed from the watershed of Rice March and Riley Lakes at the earliest possible time by the construction of interceptor sewers leading into the present Southwest 0 • 3. Sanitary Sewer District system, either along Riley Creek or along some other alternate route; such as the force line interceptor on preliminary plan, Southwest Sanitary Sewer District Recommended Service Area, dated October 1968. BE IT FURTHER RESOLVED THAT THE VILLAGE COUNCIL OF THE VILLAGE OF CHANHASSEN further emphasizes the need for some timely solution to its sewage disposal problem by the attachment hereto of petitions and resolutions from other interested municipal and citizens' groups. Adopted this 8th day of December, 1969. 67 Mayor • ATTEST Cle -Administrator 0 • VILLAGE OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA RESOLUTION NO. /Z ' 6'7/ WHEREAS, the Council of the Village of Chanhassen has been informed that there is pending before the Planning Commission of the City of Chaska an application to rezone certain lands in the Northwest Quarter of the Southeast Quarter and the North Half of the Southwest Quarter of Section 16, Township 116, Range 23, Carver County, from a Single Family Residential District to a Multiple Dwelling District to accommodate a mobile home court, and WHEREAS, said lands are situated on both sides of Trunk Highway 41 • and lie on the common boundary between the City of Chaska and this Village, and hence, the projected land use is of considerable concern to this Village, and WHEREAS, said lands lie within Independent School District No. 112 which serves the City of Chaska and the Village of Chanhassen. NOW, THEREFORE, BE IT RESOLVED, That the Council of the City of Chaska be, and hereby is, urged to deny said rezoning application for the following reasons: 1. The development of a mobile home court on these lands would create a potential eyesore at one of the entrances to both communities. 2. The said lands lie within close proximity to the University of Minnesota Landscape Arboretum, Hazeltine and Jonathan and the development of a mobile home park in the area would detract in considerable measure from the amenities created by these existing land uses. • 0 • 3. The location of a mobile home park astraddle Trunk Highway 41 would be likely to create a serious traffic problem on said highway. 4. The potential concentration of children resulting from a mobile home park bordering the Landscape Arboretum would seriously increase the risk of damage to the arboretum from the destruction of plantings. 5. WHEREAS, the Villages of Chanhassen, Deephaven, Eden Prairie, Minnetonka, Prior Lake and the Town of Eagle Creek, are parties to a joint powers agreement dated March 29, 1968, pursuant to the provisions of Section 471.59, Minnesota Statutes, providing for the creation of a joint sanitary sewage system to be administered by a Southwest Sanitary • Sewer District Board composed of representatives from each of the said above municipalities, and; WHEREAS, said Southwest Sanitary Sewer District Board did, in the exercise of its authority, cause the preparation of plans and specifications for the construction of sanitary sewer interceptors, more specifically described as Purgatory Creek Interceptor, Section II, and; WHEREAS, the Southwest Sanitary Sewer District Board did, in the proper exercise of its authority, accept such plans and specifications and cause to be published an advertisement for bids for the construction of the aforesaid sanitary sewer interceptor, and; 40 WHEREAS, pursuant to said advertisement bids have been received and have been tabulated by the consulting engineers retained by the Southwest Sanitary Sewer District Board and said Board and its engineers have recommended the acceptance of the low bids of Johnson Brothers, of C. (SEAL) ADOLPH SSNESS, CLERK • /0 �3 I • VILLAGE OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA RESOLUTION WHEREAS, it is the opinion of the Council of the Village of Chanhassen that from the standpoint of economy and efficiency all policing services for the entire Carver County area, including the municipalities therein, could best be furnished by Carver County as a county function under a county- wide policing program, and WHEREAS, it appearing that such county -wide policing is not possible at the present time and that, therefore, the policing requirements of the Village • of Chanhassen must be met by some other method, and 'WHEREAS, after study of all aspects of the problem of furnishing police services to the Village, the Council has concluded that the best interests of the Village and its residents would be served by contracting with Carver County for police services, provided that the cost therefor is fair and reasonable, and WHEREAS, based on current information it appears that a fair and reasonable method of sharing the cost for such police services should be based on assessed valuations, and that an an annual cost so determined of 8 mills is fair and reasonable to the Village. NOW, THEREFORE, BE IT RESOLVED: 1. That the Council of the Village of Chanhassen recommends to the Board of Commissioners of Carver County that said Board give favorable consideration to the establishment of county- wide policing, or Y 'V U 2. It is hereby found and determined that the geographical size of the Village of Chanhassen necessitates the establishment within the Village of three election precincts as hereinafter described. The amount of principal and interest to come due in 1970 on all Southwest Sanitary Sewer District Bonds issued by the Member Municipalities is $451,669.18 on April 1 and $465,260 on October 1. On or before March 20 and September 20, . 1970, respectively, the Treasurer shall transfer to the Debt Service Fund from the Reserve Fund such amount as may be necessary to increase the balance in the Debt Service Fund on such date to an amount equal to the principal and interest and paying agent's charges coming due on April 1 or October 1, respectively, less the amounts of unused discount and accrued interest retained by the Member Municipalities and available for payment of debt service. The deficiency in the Reserve Fund created by such transfers shall immediately be eliminated by the transfer of funds to the Reserve Fund from the Construction Fund, and until September 20, 1970 the amount in the Construction Fund shall not be reduced to an amount less than the principal and interest and paying agent's charges to come due on October 1 on all Southwest Sanitary Sewer District Bonds issued by the Member Municipalities. This Council has examined and considered the resolution adopted by the Southwest Sanitary Sewer District Board on September 18, 1969 entitled "Resolution Approving 1970 Budget, Providing For Debt Service And A Bond Reserve, And Requesting Member Municipalities To Levy Ad Valorem Taxes", and does hereby concur in and approve said resolution and the 1970 budget approved therein. 2. To provide moneys necessary to meet the 1970 budget of the Southwest Sanitary Sewer District, as set forth in Section 3 of said Board resolution, there is hereby levied upon all taxable property within the corporate limits of the Village of Chanhassen a tax in the amount of $ 34,174.73 which tax shall be extended upon the tax rolls prepared in 1969 and collected with other general taxes of the Village in 1970. 3.
