ResolutionsRESOLUTION VILLAGE OF CHANHASSEN • April-, 1967 Councilman �J �� introduced the following resolution and moved its adoption: WHEREAS, it is to the best interest of the Village of Chanhassen that the operating revenues of the water and sanitary sewer systems be merged into one fund to be known as the Water and Sewer Operating Fund, and WHEREAS, the interests of the Village will best be served if said Water and Sewer Operating Fund be used solely and exclusively for the following purposes: a) Operation, maintenance and repair of the water and sanitary sewer systems and plants. b) The making of capital improvements to the existing plants and systems. • c) Future plant and system expansion. d) Prepayment of water and sanitary sewer bonded indebtedness if, in the opinion of the Council, such action is warranted after making adequate provision for the expense of operation, maintenance, repair, capital improvements, and probable future plant and system expansion. NOW, THEREFORE, BE IT HEREBY RESOLVED That there be established the Water and Sewer Operating Fund, that all water and sanitary sewer operating revenues presently on hand be transferred to said fund and that all future operating revenues of said systems be paid into said fund, and that said fund be used solely and exclusively for the following purposes, and none other: a) Operation, maintenance and repair of the water and sanitary sewer systems and plants. b) The making of capital improvements to the existing plants and systems. c) Future plant and system expansion. d) Prepayment of water and sanitary sewer bonded indebtedness if, in the opinion of the Council, such action is warranted after making adequate provision for the expense of operation, maintenance, repair, • capital improvements, and probable future plant and system expansion. NOW, THEREFORE, BE IT RESOLVED: 1. That Corridor System C of Exhibit 10 of said Corridor Location Study showing the proposed alignments of Trunk Highway 41, 169 and 212 as 41-C, 41-C1, 169/41 -CI and 212/169-C2 is approved and recommended to the Minnesota Highway Department by the Council subject to the following conditions: a) That Trunk Highway 5 be developed to expressway standards with access points as close as two to the mile, and adequately protected with acceleration and deceleration lanes and signals, if crossings are at grade. b) That an adequate system of bridges be constructed on the pro- posed freeway corridors in the Village to provide for the easy and free movement in all directions of traffic on local streets. c) That one point of access be provided to 212/169-C2 and to 41-C1 within the Village of Chanhassen to serve the needs of the community. 2. M ATTEST: Clerk -Adm' nistrator VILLAGE OF CHANHASSEN By Mayor A4 t • MEMORANDUM The Council, in making its determination of the proposed relocation of Highways 41, 169 and 212, has consulted with its professional planners, engineers and the Village Planning Commission, and has taken note of the fact that these consultants have approved the corridor locations as recommended by the Council in the foregoing resolution. Of significance is the fact that these corridor locations were recommended by the Village Planning Commission in consultation with the professional planning firm of Nason, Wehrman, Knight & Chapman in the preparation of the Chanhassen General Guide Plan. Of further significance is the fact that the Metropolitan 40 Council has approved the Village Guide Plan. The differences between a freeway and an expressway have been taken into account by the Council in making its recommendation. Freeways have the primary purpose of conducting traffic through an area, with points of access spaced at two miles or greater and with no crossings at grade. Expressways provide more access points at grade, with protection afforded by acceleration and deceleration lanes and signals. Freeways tend to divide community areas, whereas expressways serve abutting areas directly and provide relatively close points of access and good traffic capacity between local arterials and freeways. From this standpoint, it appears desirable to locate freeways either in areas where land use is not yet committed, or where other natural divisions occur. Of possibly equal importance, construction and right-of-way costs should be considered. Taking these matters 40 into account, the corridor system which the Council has recommended would best W • serve Chanhassen. The upgrading of Highway 5 to no more than expressway standards would provide a much needed highway improvement without restricting the circulation and mobility of the existing and future development of the area. The effect of the several proposed corridor locations to the Village has been a primary concern to the Council. The upgrading of Highway 5 to freeway status would present a serious obstacle to the continuing development of a compact business and industrial area near the present nucleus of the Village. On the other hand, construction of a freeway across the Southeast portion of Chanhassen, as shown by 212/169-02, would place the division in a location where no present development would be materially affected. Applying the same criterion to Highway 41, it appears that 41-C1 would put this freeway about on the boundary between Chanhassen and Chaska where it would serve both communities and not seriously affect present development. The several corridor proposals of the Minnesota Highway Department have been studied by the Chanhassen Chamber of Commerce, and it is to be noted that the Chamber supports the recommendations of the Village Council. The Council urges that the Minnesota Highway Department seriously con- sider the recommendations of the Council. These recommendations were made only after considerable study which has taken into account the needs of the Village and contiguous areas. • VILLAGE OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA Date November 16 Motion by Councilman_ 1970 Neils RESOLUTION Resolution No. 111670-2 Seconded by Councilman Pearson JOINT SHOREWOOD - NORTH CHANHASSEN SANITARY SEWER LINES. WHEREAS, studies are presently being made of the feasibility of serving a portion of the north Chanhassen area with sanitary sewer service through the Shore- wood Interceptor system, and WHEREAS, determination has not been made whether sewer lines connecting the north Chanhassen area with the Shorewood system are to be classified as inter- ceptor lines within the Metropolitan Sewer Board system, and WHEREAS, it is incumbent that the Council of the Village of Chanhassen ex- presses its position in the event said connecting lines are not determined to be interceptors within the Metropolitan Sewer Board system: NOW, THEREFORE, BE IT RESOLVED, that in the event the sanitary sewer lines connecting the north Chanhassen area with the Shorewood interceptor system are not determined by the Metropolitan Sewer Board to be interceptor lines within the metropolitan sewer system, the Village of Chanhassen agrees as follows: 1. To negotiate with the Village of Shorewood toward a mutually acceptable agreement for the construction and operation of said connecting sewer lines, including allocation of the costs thereof. 0 • 2. In the event a mutually acceptable agreement cannot be reached, the Village of Chanhassen will seek an agreement whereby the construction and operation of said lines, including allocation of the costs thereof, as between Shorewood and Chanhassen, shall be as determined by the Metropolitan Sewer Board. That the execution of said trust agreement by the Mayor and Village Clerk on behalf of the Village is hereby approved and ratified. 2. That the execution of an agreement by said officers on behalf of the Village whereby the Village agrees that any roadway constructed by it during the lifetime of Anna Welter for ingress and egress to State Highway No. 5 will be built on land not less than 200 feet east of the present roadway running to Mrs. Welter's house, is hereby approved and ratified. 3. That the execution of an agreement by said officers on behalf of the Village whereby the Village is granted an option to purchase the excepted 40 one acre home site under its right of first refusal as set forth in the option • r � � agreements heretofore executed, is hereby approved and ratified. 4. The Village of Chanhassen is a member of the Southwest Sanitary Sewer District Board created on March 29, 1968, by agreement among several municipalities. On September 18, 1969, said Board adopted a resolution entitled "Resolution Approving 1970 Budget, Providing for Debt Service and a Bond Reserve, and Requesting Member Municipalities to Levy Ad Valorem Taxes. " The Board's resolution was approved by this Council by resolution adopted October 13, 1969, entitled "Resolution Approving Southwest Sanitary Sewer District Board Resolution and Levying a Tax in the Amount Required for the 1970 District Budget. " In and by said resolution this Council levied an ad valorem tax in the amount of $34,174. 73 to be extended upon the tax rolls prepared in 1969 and collected in 1970, to finance its share of said 1970 budget. 2. On June 1, 1970, the Metropolitan Sewer Board established by Laws 1969, Chapter 449, will assume the ownership of all property, real and personal, contracts, rights and obligations of the Southwest Sanitary Sewer District Board, pursuant to Chapter 449, Section 5, and will become entitled to receive said taxes from the Village when collected, The Village hereby agrees to pay to the Metropolitan Sewer Board one-half of the taxes levied ($17,087.37) on August 15, 1970, and the other half of the taxes so levied ($17, 087.36) on January 15, 1971; and the Treasurer is authorized and directed to make such payments without further authorization by this Council. The Mayor and the Clerk are authorized to enter into an agreement on behalf of the Village with the Metropolitan Sewer Board, whereby the parties would agree as follows: a. The Village will transfer to the Sewer Board on or about June 1, 1970, all of its right, title and interest in and to the municipal treatment works and the site upon which it is located. b. The Village will pay all items which, under accepted accounting principles, constitute normal and current costs of operation and maintenance of the treatment works to December 31, 1970. C. The Village will pay all principal of interest coming due on or before February 1, 1971, on bonds issued by it for the acquisition and betterment of the treatment works and the treatment works site, and the Village will receive credit for such payment in accordance with law. d. The Sewer Board will pay to the Village amounts sufficient to pay when due the principal of and interest coming due on outstanding bonds issued by it for the acquisition and 0 betterment of the treatment works and the site; will operate the treatment works and provide sewage treatment for the Village until such time as sewage from the Village system can be diverted to another treatment works through an interceptor; and will transfer the treatment works site to the Village when it is no longer needed for metropolitan purposes, upon payment of an amount equal to the amount paid for it to the Village pursuant to Laws 1969, Chapter 449, Section 5. 2. The agreement shall be prepared under the direction of the Village Atorney and shall not be executed until he determines that it carries out the terms of this resolution. That it is the desire of this Council that the Board of Commissioners, Carver County, retain an Assistant County Attorney for the County of Carver. 2.
