RESOLUTION AUTHORIZING THE ACQUISITION OF PROPERTY RIGHTS FOR THE CON-
STRUCTION AND LOCATION OF SANITARY SEWER AND WATER MAIN, PROJECT NO 71-4
BE IT RESOLVED THAT:
1. This Council has ordered the preparation of plans and specifications
for the construction of the Sanitary Sewer and Water Main, Project
No. 71-4.
2. Minnesota Law gives this Council authority to acquire by purchase or
condemnation any real or personal property determined to be necessary
or convenient for the collection and disposal of sewage and the con-
struction of water mains in the Village.
3. The Council hereby determines that it is necessary to acquire all
property rights which will be needed for the construction and location
of the facilities described in paragraphs 1 and 2; and that such
acquisition is in the public interest and for the public purpose autho-
rized by Minnesota Statutes.
4. Russell H. Larson, Attorney at Law, is hereby authorized and directed
to proceed with the acquisition of all such property rights by negotiation,
contract or condemnation, and is. authorized to do all things necessary
to secure the right of entry or possession of such property for construction
purposes as soon as possible.

RESOLUTION ESTABLISHING SEWER AND WATER RATES
WHEREAS, Ordinances Nos. 5 and 6 of the Village authorize the Village
Council to establish by resolution municipal sanitary sewer and water usage
charges, and
WHEREAS, the Village Council has determined that water usage afford
• the most accurate and equitable means of establishing sanitary sewer usage
charges.
NOW, THEREFORE, BE IT RESOLVED THAT:
1. The sanitary sewer usage charge applicable to premises connected
to the municipal water system is hereby established to be $7. 50
per quarter plus 50 cents for each 1,000 gallons or fraction
thereof of water consumed per quarter in excess of 10,000
gallons, except that the sewer usage charge for all residential
structures for the 2nd quarter shall apply to the 3rd quarter
of each year.
2. The sanitary sewer usage charge for single family residences
not connected to the municipal water system is hereby
established to be $15. 00 per quarter.
3. The sanitary sewer usage charge for apartment buildings not
connected to the municipal water system is hereby established

to be $10.00 per quarter for each two-bedroom apartment and
$7. 50 per quarter for each one -bedroom or efficiency apartment.
4. The Chanhassen municipal water usage charge is hereby established
as follows:
a) $7.50 minimum charge per quarter, and
b) $0.40 per 1,000 gallons or fraction thereof consumed
from 10,001 gallons to 40,000 gallons, and
c) $0.35 per 1,000 gallons or fraction thereof consumed
in excess of 40,000 gallons.
5. The foregoing sanitary sewer and water rates shall be
effective with statements to be rendered July 1, 1971.

RESOLUTION APPROVING MINNESOTA LAWS, 1971, CHAPTER 898
WHEREAS, the Legislature of the State of Minnesota has enacted
Chapter 898 of Minnesota Laws, 1971, relating to the Village of Chanhassen
and authorizing a special federal census for the Village, and
WHEREAS, said Act provides that it is to become effective upon
• approval of the Act by the governing body of the Village and upon the
compliance with the provisions of Minnesota Statutes 645.021:
NOW, THEREFORE, BE IT RESOLVED:
1. That the Council of the Village of Chanhassen does
hereby approve Chapter 898 of Minnesota Laws, 1971,
being an Act relating to the Village of Chanhassen and
authorizing a special federal census.
2. That the Village Clerk furnish to the Secretary of
State of Minnesota the appropriate certificates

RESOLUTION RELATING TO NORTHERN STATES POWER COMPANY ELECTRIC
RATE INCREASE
WHEREAS, Northern States Power Company is the supplier
of electric service in this community, and
WHEREAS, the rates and charges of Northern States Power
Company for electric service are not subject to effective regula-
tion on a state or regional level, and
WHEREAS, Northern States Power Company has announced
a general rate increase for electric service of approximately
eight percent (8%), and
WHEREAS, this Council believes that the basis for such
increase should be subjected to a detailed analysis by persons
skilled in utility rate -making, to provide assurance to the Village
and to other consumers of electricity that the rates and charges
of Northern States Power Company are justified, and
WHEREAS, this Council believes that Northern States
Power Company should be willing to submit to such an examination
of its rates and charges, and
• WHEREAS, the costs of utility rate analysis incurred in
behalf of the public are customarily borne by the utility being
regulated;

• NOW, THEREFORE, BE IT RESOLVED by the Village
Council of the Village of Chanhassen, Minnesota, as follows:
1. This Council objects to any increase in the
electric rates of Northern States Power Company
in this community until such time as Northern
States Power Company submits to a detailed pro-
fessional analysis of such rate increase, by such
persons, acceptable to this Council with the costs
of such analysis being borne by Northern States
Power Company.
2. A copy of this Resolution shall be sent to
Northern States Power Company with the request
for a response from Northern States Power Company.

RESOLUTION IN SUPPORT OF A BILL IMPOSING A METROPOLITAN SALES TAX
WHEREAS, the Village Council of the Village of Chanhassen
is the official governing body of the Village of Chanhassen; and
WHEREAS, for the past several years, the Village Council
has had of prime concern the increased amount of taxes imposed upon
landowners within the Metropolitan Area and in the Village of Chan-
hassen due to rising costs for municipal and other governmental
services; and
WHEREAS, the Village Council believes that most taxpayers
who own property in the Village of Chanhassen or in other areas are
of the opinion that their own real property taxes have reached a
level which is too high for the average taxpayer; and
WHEREAS, the Village Council is of the opinion that steps
must be taken to remove the tax burden imposed upon the owners of
real property; and
WHEREAS, the Village Council has reviewed a bill pending
before the 1971 Legislature, designated as House File No. 2995 and
0 Senate File No. 2636; and
0 WHEREAS, the Village Council is of the opinion that
House File No. 2995 and Senate File No. 2636, if enacted by the
Legislature, would provide a fair tax which would benefit property
owners in the Metropolitan Area.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF
THE VILLAGE OF CHANHASSEN IN SPECIAL MEETING ASSEMBLED that the
Village Council of the Village of Chanhassen hereby endorses
House File No. 2995 and Senate File No. 2636 and urges the Legis-
lature of the State of Minnesota to enact it into law.
BE IT FURTHER RESOLVED that the Village Clerk of the
Village of Chanhassen cause a copy of this resolution to be delivered
to the Honorable John Metcalf, State Senator and the Honorable Ralph
Jopp, State Representative, and that they are hereby requested to
is support House File No. 2995 and Senate File No. 2636 and to present
a copy of this resolution to the Legislature of the State of
Minnesota.

SHOREWOOD - CHANHASSEN JOINT SANITARY SEWER FACILITIES
WHEREAS, the Metropolitan Sewer Board has submitted to Chanhassen for
its approval and execution a proposed agreement between said Board, Shorewood and
Chanhassen relating to the construction and cost allocation of Shorewood -Chanhassen
joint sanitary sewer facilities, and
WHEREAS, it is in the best interest of Chanhassen that the proposed joint
0 sanitary sewer facilities be constructed as contemplated by said agreement;
NOW, THEREFORE, BE IT RESOLVED that:
1. The proposed agreement be, and hereby is, approved.
2. The Mayor and Village Clerk be, and hereby are, authorized
and instructed to execute said agreement on behalf of the
Village of Chanhassen.
3. The Village Clerk, Engineer and Attorney be, and hereby
are, instructed to negotiate with Shorewood the matter of
the Shorewood -Chanhassen cost sharing as contemplated
by Section 3.03 of said agreement.
4. The Village Clerk, Engineer and Attorney prepare and submit
to the Metropolitan Council, either separately or in cooperation
with Shorewood, a petition for variance seeking a determination
that the Shorewood -Chanhassen joint sanitary sewer facilities
are metropolitan interceptors needed for the metropolitan
disposal system.

A RESOLUTION PROCLAIMING THE TWENTY-FIFTH DAY OF
APRIL, 19719 HONEY SUNDAY
A day set aside by His Honor the Mayor of
CHANHASSEN
supporting the Minnesota Jaycees and the CHANHASSEN
Jaycees• MINNESOTA HONEY SUNDAY, a program to help the
mentally retarded in our state and in our community.
WHEREAS, many of the mentally retarded have been found
capable of earning a living given proper training and
acceptance by employers and the general public, and
WHEREAS, more facilities, personnel, and finances are
needed to provide such programs and acceptance, and
WHEREAS, public awareness and concern are necessary
ingredients in the success of developing and maintaining
improved training and care for the retarded, and
WHEREAS, MINNESOTA HONEY SUNDAY is dedicated to
generating both finances and public awareness for the
programs for the retarded, and
WHEREAS, CAMP FRIENDSHIP for the retarded provides
valuable training as well as camping experience for the
retarded and will receive part of the proceeds from
MINNESOTA HONEY SUNDAY to replace a main lodge lost in a
fire in 196$, and
WHEREAS, local programs for the retarded benefit from
the success of the MINNESOTA HONEY SUNDAY program, and
WHEREAS, local programs for the retarded benefit from
the success of the MINNESOTA HONEY SUNDAY program, and
WHEREASp the GOVERNOR OF THE STATE OF MINNESOTA has
proclaimed April 259 19719 as MINNESOTA HONEY SUNDAY and is

WHEREAS, over 53,771 Americans have been killed in the
Vietnam was to date,

on the war, while
many Americans
go hungry and are deprived
of
the necessary things in life and over half the world goes to bed
hungry every night,
WHEREAS, the Vietnam Government insists on expanding
the war, thus involving the American people to supply them with
equipment and air support,
WHEREAS, the lives of 2,855,700 young Americans have
been disrupted since 1965, causing much hardship to the young
people and often causing conflict in the family,
WHEREAS, 294,414 Americans have been wounded in this
anti -cold war, many of them permanently,

American troops home immediately.

RESOLUTION OPPOSING INDUSTRIAL ZONING ADJOINING UNIVERSITY OF
MINNESOTA LANDSCAPE ARBORETUM.
WHEREAS, the Villages of Victoria and Chanhassen in the past have
exhibited their mutual interest in the orderly development of their respective
municipalities and the west metropolitan area and have worked toward preserving
and maintaining the superior amenities of the areas, and
WHEREAS, the University of Minnesota Landscape Arboretum and
its adjoining areas are outstanding examples of the attractive environmental
qualities which characterize the west metropolitan area, and
WHEREAS, those areas which border the Arboretum are admirably
suited and highly desirable for residential living as they possess the best of
all criteria used in land use planning of residential districts, and
WHEREAS, it has been brought to the attention of the Chanhassen
Village Council that a plan has been proposed for the rezoning of a portion of
the Village of Victoria adjoining the Arboretum to permit industrial use of the
land, which in the opinion of the Chanhassen Village Council would be most

detrimental to the Arboretum and adjoining areas.
0 NOW, THEREFORE, BE IT RESOLVED:

1. That the Council of the Village of Chanhassen
records its opposition to the introduction of any
type of use in areas adjoining the University of
Minnesota Landscape Arboretum other than residential
use, and is especially opposed to the use of any such
land for industrial purposes.
2. That request is hereby made to the Victoria Village
Council to give the most favorable consideration to
the Chanhassen request that said lands be zoned
solely for residential use.

RECOMMENDATION FOR ESTABLISHMENT OF LAKE ANN SANITARY SEWER
INTERCEPTOR.
WHEREAS, consideration of the Lake Ann sanitary sewer feasibility studies
of March 1969 and September 1970 supports the conclusion that the proposed
Lake Ann trunk sanitary sewer is a main sewer line which can be designed and
• used to conduct sewage originating in more than one government unit through
connection with the Shorewood No. 2 Interceptor, and
WHEREAS, it is the opinion of this Council that it is in the public interest
that the Lake Ann trunk sanitary sewer be designated as an interceptor within
the Metropolitan Council comprehensive plan for the collection and disposal of
sewage in the metropolitan area.
NOW, THEREFORE, BE IT RESOLVED that:
1. The Metropolitan Council is hereby requested to
designate and establish the Lake Ann trunk sewer
as an interceptor within its comprehensive plan,

RESOLUTION AUTHORIZING THE ACQUISITION OF PROPERTY RIGHTS FOR THE CON-
STRUCTION AND LOCATION OF CHANHASSEN TRUNK SANITARY SEWER, PROJECT
70- 6
BE IT RESOLVED THAT:
1. The Metropolitan Sewer Board has ordered the preparation of plans and
• specifications for the construction of the Chanhassen Interceptor (Metropolitan
Sewer Board Project 70-25) , which construction shall include the installation of a
trunk sanitary sewer for the collection and disposal of sewage originating within
Chanhassen (Chanhassen Trunk Sanitary Sewer Project 70-. J.
2. Minnesota Statutes, Section 444.075, gives this Village authority to
acquire by purchase or condemnation any real or personal property, including ease-
ments and water and air rights, determined to be necessary or convenient for the
collection and disposal of sewage within and beyond the limits of the Village.
3. The Village hereby determines that it is necessary to acquire all property
rights which will be needed for the construction and location of the trunk sanitary
sewer described in Paragraphs 1 and 2; and that such acquisition is in the public
0 interest and for the public purpose authorized by Minnesota Statute 444.075.

4. Russell H. Larson, Attorney at Law, is hereby authorized and directed
to proceed with the acquisition of all such property rights by negotiation, contract
or condemnation, and is authorized to do all things necessary to secure the right
of entry or possession of such property for construction purposes as soon as
possible.

RESOLUTION

SPECIAL FEDERAL CENSUS
Resolution No. 12571-1
Seconded by Councilman Wolf
WHEREAS, it is in the best interests of the Village of Chanhassen that
a special census of the population of the Village be taken before January 1,
1973;
NOW, THEREFORE, BE IT RESOLVED:
1. That the Legislature of the State of Minnesota be, and hereby
is, requested to enact a bill authorizing a special Federal
Census of the population of the Village.
2. That said bill be in substantially the following form:
Section 1. The governing body of the Village of Chanhassen
may by resolution request the Federal Director of the Census
to take one special census of the population of the Village
before January 1, 1973. A certified copy of the results of
such census shall be filed with the appropriate state au-
thorities by the governing body of the Village. The result
of any such census so taken and filed shall be the popula-
tion of the Village for purposes of any law providing that
population is a required qualification for tax distribution,
liquor licensing under Minnesota Statutes, Chapter 340,
or distribution of highway aids. The expense of taking
the special census shall be paid by the Village of
Chanhassen.

Section 2. This act is in effect upon its approval by the
governing body of the Village of Chanhassen and upon
compliance with the provisions of Minnesota Statutes,
Section 645.021.
