RESOLUTION REGARDING FIRE RATING RE-EVALUATION
FOR VILLAGE OF CHANHASSEN
BE IT RESOLVED By the Village Council of Chanhassen, Minnesota
as follows:
(1) It is requested that the Office of Insurance Services
be contacted to re-evaluate the Village of Chanhassen
fire rating which currently has a fire rating of 8 & 9.
i (2) Since the issuance of the above rating,the Village of
Chanhassen has accomplished the following to upgrade
their fire rating:
(a) Provided municipal water services in congested
residential districts.
(b) Constructed new water tower which has a capacity
of 200,000 gallons.
(c) Constructed new Village well which has a pumping
capacity of 1,000 gallons per minute.
(d) Purchased a new fire truck pumper(Pirsch) which
has a pumping capacity of 1,250 gallons per
minute.
(3) It is directed that the Clerk -Administrator send a copy
of this resolution to the Office of Insurance Services,
Chanhassen Fire Chief, and Fire Marshall.

RESOLUTION
Whereas, the Village of Chanhassen, County of Carver, State of
w�
Minnesota has granted a franchise for electric utility purposes to The
Minnesota Valley Electric Cooperative by published Ordinance No. 54, and
Whereas, The Minnesota Valley Electric Cooperative desires to
accept all the rights and duties embodied in said franchise; and
Whereas, Section 6 of said franchise provides that a written
acceptance of the right granted shall be filed with the Village Clerk
within ninety days from the date of publication of the ordinance,
IT IS HEREBY RESOLVED by the Board of Directors of The Minnesota
Valley Electric Cooperative that all rights and duties granted or imposed
in said franchise are accepted and this Resolution constitutes the written
acceptance specified in said Section 6.

I, Raymond Jabs, the duly qualified and acting secretary of the
Board of Directors of The Minnesota Valley Electric Cooperative, do hereby

Due to the critical energy crisis our country is experiencing at
this time, as Mayor of the Village of Chanhassen, I recommend that
the Village Council adopt a resolution encompassing the following:
1. That all Village owned vehicles not be driven in
excess of fifty (50)M.P.H.
2. That no Village vehicle be idled for more than five
(5)minutes.
3. That the thermostat in all Village buildings be
turned down to 68°F.
4. That the Village Council create an Energy Committee
to study means of conserving energy in our community.
a. To study the possibility of creating car pools
to eliminate each individual driving their own
• car to their job.
b. To study the possibilities of utilization of
parking lots for commuters.
c. To study the possibility of using the transit
buses from Chanhassen to downtown Minneapolis.
d. That this Committee review all means and methods
of energy saving devices that can be implemented
by the citizens of Chanhassen and that this infor-
mation be dissiminated to the citizens of the
Village of Chanhassen.
It is urged that all the citizens of Chanhassen conserve energy and
fuel as directed by all levels of government.

Proposed Revisions at the
"Tri -Wye" of Trunk Highways
101, 169 and 212
Dear Mr. Schnelle:
The Minnesota Highway Department is proposing to make certain improvements
to the junctions of Trunk Highways 101, 169 and 212, within the Village of
• Chanhassen. Basically, these improvements would consist of realigning two
of the three legs of the present "wye" intersection to provide for a safer
traffic pattern. This proposed construction would be financed entirely by
the Minnesota Highway Department and would not involve any financial par-
ticipation on the part of the Village of Chanhassen. It is presently our
intention to let the contract for this construction in early 1974.
We have enclosed a copy of the layout showing our proposed construction,
along with copies of a resolution form. We would like the Village to review
the proposed construction and act upon the resolution. Also enclosed is
a receipt form, which we would like signed and returned to this office.

BE IT RESOLVED by the Village Council of Chanhassen, Minnesota, as follows:
1. The amount proper and necessary to be specially assessed at this time
for Street Improvement Project 73-4 against every assessable lot,
piece or parcel of land affected thereby has been duly calculated upon the basis of
benefits, without regard to cash valuation, in accordance with the provisions of
Minnesota Statutes, Chapter 429, and notice has been duly published and mailed as
required by law, that this Council would meet to hear, consider, and pass upon all
objections, if any, and said proposed assessment has at all times since its filing
been open for public inspection, and an opportunity has been given to all interested
persons to present their objections , if any, to such proposed assessments, and said
proposed assessment has been amended as to certain parcels of land as to the
Council seems just.
• 2. This Council, having heard and considered all objections so presented,
and being fully advised in the premises, finds that each of the lots, pieces and
parcels of land enumerated in the proposed assessment as so amended was and is
specially benefited by the construction of said improvement in not less than the
amount of the assessment set opposite the description of each such lot, piece and
parcel of land, and such amount so set out is hereby levied against each of the
respective lots, pieces and parcels of land therein described.
3. The assessment against each parcel, together with interest at the rate of
�% per annum accruing on the full amount thereof from time to time unpaid, shall
be a lien concurrent with general taxes upon such parcel and all thereof. The total
amount of each such assessment shall be payable in equal annual incipal install-
ments extending over a period of /0 years, the first of said ins tallments, together
with interest on the entire assessment from the date hereof to December 31, 19,
to be collectible with general taxes in the year 19�t/ , and one of each of the
remaining installments, together with one year's interest on that and all other unpaid
installments, to be payable with general taxes in each consecutive year thereafter

4. It is hereby declared to be the intention of the council to reimburse
itself in the future for the portion of the cost of this improvement paid for from
municipal funds by levying additional assessments, on notice and hearing as pro-
vided for the assessments herein made, upon any properties abutting on the improve-
ment but not herein assessed for the improvement when changed conditions relating
to such properties make such assessment feasible.
5. To the extent that this improvement benefits non -abutting properties
which may be served by the improvement when one or more later extensions or
• improvements are made, but which are not herein assessed therefor, it is hereby
declared to be the intention of the council, as authorized by Minnesota Statutes
Section 429.051, to reimburse the village by adding the portion of the costs so
paid to the assessments levied for any such later extensions or improvements.
6. Prior to certification of the first installment of the assessment to the
County Auditor, the owner of any lot, piece or parcel of land assessed hereby may
at any time pay the whole of such assessment with interest to the date of payment,
to the Village Treasurer, or he may make partial payments pursuant to the ordinance
providing therefor, but no interest shall be charged if such whole or partial payment
is made within 30 days after the date of this resolution; and he may thereafter pay
to the county treasurer the installment and interest in process of collection on the
then current tax list, and he may pay the remaining principal balance of the assess-
ment to the Village Treasurer. Such payment must be made before November 15 or
interest will be charged through December 31 of the next succeeding year.
7. The Village Clerk -Administrator shall file the assessment rolls pertain-
ing to this assessment in his office and shall certify annually to the county auditor
on or before October 10 of each year the total amount of installments and interest
which are to become due in the following year on the assessment on each parcel
of land included in the assessment roll.
. 8. The Village Clerk -Administrator shall also mail to each owner of a
right of way or public property included in the assessment roll a notice specifying
the amount payable by such owner as required by Minnesota Statutes, Section 429.

MINNETONKA COMMUNITY DEVELOPMENT GUIDE
WHEREAS, the City of Minnetonka has proposed a development guide,
designated Comprehensive Phase III, a Community Development Guide for the
City of Minnetonka, which sets forth certain proposals for the planned develop-
ment and growth of Minnetonka, and
WHEREAS, the growth and development of the communities of Minne-
tonka, Eden Prairie and Chanhassen are interrelated, especially along the
State Highway 101 corridor.
NOW, THEREFORE, BE IT RESOLVED that the Council of the Village of
Chanhassen commends the City of Minnetonka for its endeavors in establishing
a community guide plan as a necessary tool for the orderly development and
growth of the city, and
BE IT FURTHER RESOLVED that the Council of the Village of Chanhassen
supports Resolution No. 760 of the Council of Eden Prairie, which resolution
notes concerns that may effect planning elements at the border between Chan-
hassen and Eden Prairie; and further, that Chanhassen supports Eden Prairie
in any of its efforts to seek amendment of the Minnetonka plan which will be
jointly beneficial to planning the State Trunk Highway 101 border between
Chanhassen and Eden Prairie.

compared with the original records of said corporation.in my legal
custody, from which they have been transcribed; that said documents
are a correct and complete transcript of the minutes of a meeting
of the governing body of said corporation, and correct and complete
copies of all resolutions and other actions taken and of all doc-
uments approved by the governing body at said meeting, so far as
they relate to said bonds; and that said meeting was duly held by
the governing body at the time and place and was attended through-

PARK AND EQUIPMENT REFUNDING BONDS
BE IT RESOLVED by the Council of the Village of Chanhassen,
Minnesota, as follows:
1. Notice has heretofore been duly published of the sale
of $275,000 Park and Equipment Refunding Bonds of the Village to be
dated as of September 1, 1973, and all sealed bids received pursuant
to said notice have been duly opened and considered, and the highest
and best of such bids is that of BancNorthwest ,
of Chicago I Illinois , to purchase the bonds at a price
of $ 271,425.00 and accrued interest, bonds of said issue maturing
ixi the years set forth below to bear interest at the rates per
annum shown opposite the respective years of maturity, as follows:

2. The Mayor and Clerk are authorized and directed to
execute on behalf of the Village a contract.for the sale of said
bonds pursuant to the terms of said bid, and the Clerk shall retain
the good faith check of said successful bidder pending delivery of
and payment for the bonds, and shall return all other good faith
checks forthwith.

The motion for the adoption•of the foregoing resolution
was duly seconded by Councilman Neils , and upon vote being
taken thereon, all present voted in favor thereof and none voted
against the same, whereupon said resolution was declared duly passed
and adopted.

BE IT RESOLVED by the Council of the Village of Chanhassen,.
Minnesota, as follows:
1. The Village shall forthwith issue its negotiable
coupon general obligation Park and Equipment Refunding Bonds in the
aggregate principal amount of $275,000, dated September 1, 1973,
said bonds to be 55 in.number and numbered 1 through 55, each in
the denomination of $5,000. Bonds of said issue shall mature
serially on March 1 in the years and amounts set forth below, and
the bonds of each annual maturity shall bear interest from date of
issue until duly paid or duly called for redemption at the rate per
annum shown below opposite such years and amounts, as follows:

Interest shall be payable on each March 1 and September 1, commencing
on March 1, 1974. The bonds maturing in 1982 and later years shall
each be subject to redemption and prepayment in inverse order of
serial numbers at the option of the Village on March 1, 1981, and
any interest payment date thereafter•, at 101% of par, plus accrued
interest, on notice of call for redemption published not less than
30 days prior to the date specified for redemption in a weekly or

or its metropolitan area which circulates throughout the state and
furnishes financial news as a part of its .service. Notice shall
also be mailed to the bank at which principal and interest are then
payable, but published notice shall be effective without mailing.

said Village to refund and extend the maturities of outstanding
bonds of the Village pursuant to resolutions duly adopted by the
Village Council and in full conformity with the Constitution and
laws of the State of Minnesota thereunto enabling.
Bonds of this issue maturing in 1981 and earlier years
are not subject to redemption and prepayment, but those maturing
in 1982 and later years are each subject to redemption and pre-
payment at the option of the Village and in inverse order of

• 3. The bonds shall be prepared under the direction of
the Village Clerk and when so prepared, shall be executed in behalf
of the Village by the printed facsimile signature of the Mayor and
the manual signature of the Village Clerk, and by'a printed facsimile
of the official corporate seal; and the interest coupons and certifi-
cate as to opinion of bond counsel shall be executed and authenticated
by the printed, engraved or lithographed facsimile signatures of the
Mayor and Clerk. When said bonds have been so executed and authenti-
cated, they shall be delivered by the Treasurer to the purchaser on
receipt of the purchase price heretofore agreed upon, and said_pur-
-chaser shall not be required to see to the application thereof.
4. The proceeds of said bonds, exclusive of any amount
to be deposited in the sinking fund established for their payment as
provided in Section 5, shall be used together with other available
funds to redeem and prepay, on March 1, 1974, all outstanding bonds
of the issue of $305,000 Park and Fire Equipment Bonds of 1970 of
the Village dated March 1, 1970; and are irrevocably appropriated to
the sinking fund established for the payment of such bonds until
needed for this purpose. Such bonds mature on March 1 in the amounts
of $20,000 in 1974 and $270,000 in 1975, and are subject to redemption
and prepayment on March 1, 1974. The Clerk shall forthwith give
notice of redemption and prepayment of the bonds maturing on March 1,
1975, as required by the resolution authorizing their issuance, and
• shall cause all such bonds to be paid and redeemed on March 1, 1974
without further order or authorization of this Council.
5. There is hereby created a separate sinking fund for
said bonds, which fund shall be used for no purpose other than pay-
ment of principal of and interest on said bonds and such other
general obligation bonds as the Council shall hereafter determine;
provided, that if any payment of principal or interest shall become
due when there is not sufficient money in said fund therefor, the
Treasurer shall pay the same from the general fund of the Village,
and said general fund shall be reimbursed for such advances out of
the proceeds of the taxes hereinafter levied. Into said sinking
fund shall be paid the proceeds of all taxes levied pursuant to
this resolution, any amount in excess of $270,000 received from the
purchaser of the bonds, and all other moneys received for or appro-
priated to the payment of said bonds and interest.
6. For the prompt and full payment of the principal and
interest on said bonds as the same respectively become due, the
full faith, credit and taxing power of the Village shall be and are
hereby irrevocably pledged. To provide moneys for the payment
thereof, there is hereby levied upon all of the taxable property
in the Village a direct, annual, ad valorem tax which shall be
spread upon the tax rolls for collection with *and as a part of other
general taxes of the Village in the years and amounts as follows:

7. The Village Clerk is hereby authorized and directed
to file with the County Auditors of Carver and Hennepin Counties a
certified copy of this resolution, together with such other infor-
mation as the County Auditors may require, and to obtain from each
of said County Auditors a certificate that the tax required by law
for the payment of said bonds has been levied, and that said bonds
have been entered upon their bond registers.
8. The officers of the Village and the County Auditors
are hereby authorized and directed to prepare and furnish to the
purchaser of said bonds, and to the attorneys approving the legality
of the issuance thereof, certified copies of all proceedings and
records of the Village relating to said bonds and to the financial
condition and affairs of the Village, and such other affidavits,
certificates and information as may be required to show the facts
relating to the legality and marketability of said bonds as the
same appear from the books and' -records under their custody and con-
trol or as otherwise known to them, and all such certified copies,
certificates and affidavits, including any heretofore furnished,
shall be deemed representations of the Village as to the facts
recited therein.
9. The Mayor and Village Clerk being the officers of the
Village charged with the responsibility for issuing the obligations
pursuant to this resolution, are authorized and directed to execute.
and deliver to the purchase a certification.in order to satisfy the
provisions of Section 1.103-13 of the amended Income Tax Regulations
(26 CFR Part 1) published in the Federal Register, May 5., 1973. Such
certification shall state that on the basis of the facts, estimates
and circumstances in existence on the date of issue and delivery of
the bonds as therein set forth, it is not expected that the proceeds
of the bonds will be used in such a manner that would cause the bonds
to be arbitrage bonds, and the certification shall further state
that to the best of the knowledge and belief of the certifying
officers there are no other facts, estimates or circumstances that
would materially change such expectation.

After some discussion, Councilman Wolf introduced the following
resolution and moved its adoption:
RESOLUTION NO. 827731
RESOLUTION PROVIDING FOR PUBLIC SALE OF $275,000 REFUNDING BONDS
BE IT RESOLVED By the Council of the Village of Chanhassen, Minnesota,
as follows:
(1) It is hereby found, determined and declared that there are presently
outstanding $290,000 principal amount of Park and Fire Equipment
Bonds of 1970 of this Village dated March 1, 1970, maturing on March 1 in the
amount of $20,000 in 1974 and $270,000 in 1975, and bearing interest from date
of issue at 6.10% per annum, bonds maturing on March 1, 1975 being subject to
redemption and prepayment on March 1, 1974, and September 1, 1974, at the option
of the Village, in inverse order of serial numbers at 102% of par plus accrued
interest; that all principal and interest coming due on all bonds of said 1970
issue from date thereof through September 1, 1973, has been duly paid or depos-
ited for the purpose of payment with the payment agent of said bonds; and that
it is desirable and in the best interest of the Village to extend the maturities
of the remaining bonds to avoid a 1973 tax levy of over 10 times the average
principal payment by refunding the bonds of said issue maturing March 1, 1975,
on March 1, 1974, by the issuance in the principal amount of $270,000 refunding
bonds in accordance with the provision of Minnesota Statutes, Section 475.67,
Subdivision 3; and $5,000 additional principal amount of like bonds pursuant
to Minnesota Statutes, Section 475.56.
(2) This Council shall meet at the Village Hall on Monday, September 24,
1973, at 8:00 o'clock P.M., to receive, open and consider sealed bids
for and award the sale of said bonds on the terms and conditions specified in
the following Official Notice of Sale.

NOTICE IS HEREBY GIVEN That the Village Council of the Village of
Chanhassen, Minnesota, will meet at the Village Hall in the Village of Chan-
hassen on Monday, September 24, 1973, at 8:00 o'clock P.M., to receive, open
and consider bids for the purchase of $275,000 Park and Equipment Refunding
Bonds of the Village on the following terms:

Redemption Feature
Bonds maturing in the years 1982 through 1985 will each be subject to redemption
and prepayment at the option of the Village and in inverse numerical order, on
March 1, 1981, and any interest payment date thereafter, at 101% of par plus
accrued interest.
Interest
Interest on the bonds will be payable on March 1, 1974, and semiannually there-
after on each September 1 and March 1. All bonds maturing on the same date must
bear interest from date of issue until paid at a single, uniform rate, not exceed-
ing the rate specified for bonds of any subsequent maturity. Not more than seven
interest rates may be specified for the issue. Each rate must be in an integral
multiple of 5/100 of 1%, and no rate may .exceed 7%. No supplemental or "B"
coupons will be permitted.
Paying Agent
Principal and interest will be made payable at any suitable bank in the United
States designated by the successful bidder within 48 hours after award of sale,
subject to approval by the Village, and the Village will pay the reasonable and
customary paying agency charges.

Delivery
• Within 40 days after sale, the Village will furnish and deliver at the office of
the purchaser or, at his option, will deposit with a bank in the United States
selected by him and approved by the Village as its agent to permit examination
by and to deliver to the purchaser, the printed and executed bonds, the unqualified
opinion thereon of bond counsel, and a certificate stating that no litigation in
any manner questioning their validity is then threatened or pending. The charge
of the delivery agent must be paid by the purchaser, but all other costs will be
paid by the Village. The purchase price must be paid upon delivery of the bonds,
or within five days after deposit with the delivery agent, in funds available
for expenditure by the Village on the day of payment.
Legal Opinion
An unqualified legal opinion on the bonds will be.furnished by Messrs. Dorsey,
Marquart, Windhorst, West and Halladay, of Minneapolis, Minnesota. The legal
opinion will be printed on the bonds at the request of the purchaser. The legal
opinion will state that the bonds are valid and binding general obligations of
the Village, and the Village is obligated and required to levy taxes for the
principal and interest thereon as the same become due without limit as to rate
or amount.
Type of Bid - Amount
Sealed bids must be mailed or delivered to the undersigned and must be received
prior to the time of said meeting. Each bid must be unconditional and must be
accompanied by a cashier's or certified check or bank draft in the amount of
$5,500, payable to the Village Treasurer, to be retained by the Village as
liquidated damages if the bid is accepted and the bidder fails to comply there-
with. The bid authorizing the lowest net interest cost (total interest from
date of bonds to stated maturities, less any cash premium or plus any amount
less than $275,000 bid for principal) will be deemed the most favorable. No
oral bid and no bid of less than $270,000 for principal plus accrued interest
on all of the bonds will be considered, and the Village reserves the right to
reject any and all bids and to waive any informality in any bid.

WHEREAS, the locations of the existing bituminous paved roadway and the platted

washta, do not conform to one another, and

ESTABLISHMENT OF SANITARY SEWER UNIT HOOK-UP CHARGES
WHEREAS, Section 5.05 (2) (b) of Ordinance No. 5, as amended, provides that the number
of unit hook-up charges to be levied against each lot or tract of land, or portion thereof,
benefited by the sanitary sewer system of the Village shall be established by resolution
of the Village Council, and
WHEREAS, The Village Council, in making the determination hereafter set forth, has taken
into account the estimated strength and quantity of sewage to be discharged into the
sanitary sewer system and the water estimated to be consumed on premises served by the
system.
NOW, THEREFORE, BE IT RESOLVED by the Village Council of Chanhassen as follows:
• 1. The hook-up charge for each building or structure shall be equal to the number
of units of sewage volume which it will discharge multiplied by $320. A unit of sewage
volume shall be 100,000 gallons per year and shall be assigned as follows:
a. Single family houses, townhouses and duplex units shall each comprise
one unit;
b. Condominiums and apartments shall each comprise 80% of a unit;
c. Standard hook-up charge units for various commercial, public and
institutional facilities:

RAILROAD GRADE CROSSING
WHEREAS, need has been established for the construction of a railroad
grade crossing over the Chicago, Milwaukee, St. Paul & Pacific Railroad at
the westerly limits of Frontier Development Park to provide direct access for
vehicular traffic between said development park and the commercial and
industrial areas lying northerly thereof.
NOW, THEREFORE, BE IT RESOLVED by the Village Council of
Chanhassen, as follows:
1. That the Minnesota Public Service Commission be, and
hereby is, petitioned to institute proceedings necessary
for the establishment of said railroad grade crossing at
the location shown on that certain map, designated
Exhibit A, attached hereto and made a part hereof.
2. That the appropriate Village officers, engineers and
consultants render all necessary assistance to the said
Commision in expediting the establishment of said
railroad grade crossing.

BE IT RESOLVED, by the Village of Chanhassen as follows:

1. It is hereby found and determined that Notice of Hearing on the
proposed Street Improvement Project 73-4 in the Village was duly mailed on
, 19 , and published in the Carver County Sun, the official
newspaper of the Village on April 12 , and April 19 , 1973 ,
as required by Minnesota Statutes, Chapter 429, and as ordered by resolution
of this Council adopted on April 2 , 1973 .
2. Public hearing having been on April 23, 1973, and opportunity having
been given at such hearing to all persons to make known their views on said
improvement, and this Council being fully advised of the pertinent facts, does
hereby find and determine that said improvement is needed and feasible and does
hereby order the construction of said improvement, in accordance with the
description thereof contained in said notice of hearing.

sanitary sewer improvement in the Village was duly mailed on May 21, 1973 ,
1973, and published in the Carver County Sun, the official newspaper of the
Village, on May 24, and May 31, 1973, as required by Minnesota Statutes,
Chapter 429, and as ordered by resolution of this Council adopted on May 7,
1973.
2. A public hearing having been held on June 4, 1973, and opportunity
having been given at such hearing to all persons to make known their views on

the description thereof contained in said notice of hearing, and as shown on

4. Schoell & Madson, Inc. , the consulting engineers for the Village are
hereby authorized and directed to prepare final plans and specifications for

5. The Village hereby determines that it is necessary to acquire all
property rights which will be needed for the construction and location of the
trunk and lateral sanitary sewer mains and related facilities described in
Paragraphs 2 and 3; and that such acquisition is in the public interest and for
the public purpose authorized by Minnesota Statute 444.075.
6. Russell H. Larson, Attorney at Law, is hereby authorized and directed
to proceed with the acquisition of all such property rights by negotiation,

Redemption Feature
Bonds maturing in the years 1986 through 1989 will each be subject to redemption
and prepayment at the option of the Village and in inverse numerical order, on
January 1, 1985, and any interest payment date thereafter, at 101-1/2% of par
plus accrued interest.
Interest
Interest on the bonds will be payable on January 1, 1974, and semiannually there-
after on each July 1 and January 1. All bonds maturing on the same date must
bear interest from date of issue until paid at a single, uniform maturity. Not
more than six interest rates may be specified for the issue. Each rate must be
in an integral multiple of 5/100 of 1%, and no rate may exceed 7%. No supple-
mental or "B" coupons will be permitted.
Paying Agent
Principal and interest will be made payable at any suitable bank in the United
States designated by the successful bidder within 48 hours after award of sale,
subject to approval by the Village, and the Village will pay the reasonable and
customary paying agency charges.
Delivery
•
Within 40 days after sale, the Village will furnish and deliver at the office of
the purchaser or, at his option, will deposit with a bank in the United States
salected by him and approved by the Village as its agent to permit examination
by and to deliver to the purchaser, the printed and executed bonds, the unquali-
fied opinion thereon of bond counsel, and a certificate stating that no litiga-
tion in any manner questioning their validity is then threatened or pending.
The charge of the delivery agent must be paid by the purchaser, but all other
costs will be paid by the Village. The purchase price must be paid upon delivery
of the bonds, or within five days after deposit with the delivery agent, in funds
available for expenditure by the Village on the day of payment.
Legal Opinion
An unqualified legal opinion on the bonds will be furnished by Messrs. Dorsey,
Marquart, Windhorst, West & Halladay of Minneapolis, Minnesota. The legal opin-
ion will be printed on the bonds at the request of the purchaser. The legal
opinion will state that the bonds are valid and binding general obligations of
the Village, and the Village is obligated and required to levy taxes for the
principal and interest thereon as the same become due without limit as to rate
or amount.
Type of Bid - Amount
Sealed bids must be mailed or delivered to the undersigned and must be received
prior to the time of said meeting. Each bid must be unconditional and must be
accompanied by a cashier's or certified check or bank draft in the amount of
$33,000, payable to the Village Treasurer, to be retained by the Village as
liquidated damages if the bid is accepted and the bidder fails to comply there-
with. The bid authorizing the lowest net interest cost (total interest from
date of bonds to stated maturities, less any cash premium or plus any amount
less than $1,650,000 bid for principal) will be deemed the most favorable. No
oral bid and no bid of less than $1,620,000 for principal plus accrued interest
on all of the bonds will be considered, and the Village reserves the right to
reject any and all bids and to waive any informality in any bid.

CONSIDERATION OF MUNICIPAL INDUSTRIAL DEVELOPMENT BONDS
WHEREAS, The 1967 session of the Minnesota Legislature enacted
Chapter 474 Minnesota Statutes entitled the Municipal Industrial Development
Act; and
WHEREAS, the purpose of this Act is the promotion, attraction,
encouragement and development of economically sound industry and
commerce; and
WHEREAS, the further purpose of the Act is to improve the use of
marginal and undeveloped lands and increase job opportunities; and
WHEREAS, said Act grants to municipalities the authority to issue
• revenue bonds and to finance the cost of construction, engineering and
other incidental expenses connected with the development of industrial
property; and
WHEREAS, such industrial bonds do not involve pledging the full
faith and credit of the municipality; and
WHEREAS, the municipality has reason to believe that certain
economically sound industries are interested in leasing industrial
plants constructed under the authority of the above Act, and
WHEREAS, there is about the municipality substantial undeveloped
industrial property.
NOW THEREFORE, BE IT RESOLVED that the Council of the Village of
Chanhassen approves of the issuance of industrial development bonds and
shall actively encourage economically sound companies to expand or locate
within the environs of such municipality considering the possibility
of development pursuant to the Municipal Industrial Development Act.

The total amount of each such assessment shall be payable in one annual principal
installment together with interest on the entire assessment from the date hereof
to December 31, 1973, to be collectible with general taxes in the year 1974.
4. Prior to certification of the assessment to the Carver County
Auditor, the owner of any lot, piece or parcel of land assessed hereby may at
any time pay the whole of such assessment, with interest to the date of payment,
to the Village Treasurer, but no interest shall be charged if such payment is made
within 30 days after the date of this resolution.

5. The Village Clerk shall, as soon as may be, prepare and transmit
to the County Auditor a certified duplicate of the assessment roll, with interest
• on each unpaid assessment set forth separately, to be extended upon the proper
tax lists of the County, and the County Auditor shall thereafter collect said

BE IT RESOLVED, by the Village Council of the Village of Chanhassen as
follows:
1. It is hereby found and determined that Schoell & Madson, Inc. , the
consulting engineers for the Village, have reported to this Council that a local
improvement as hereinafter described is feasible and may best be made as pro-
posed, and not in conjunction with any other improvement, and that the estimated
cost of said improvement to the Village is $22,000.00.
2. Said improvement consists of bituminous street surfacing and construc-
tion of asphalt curb and gutter on the following described streets:
a) West 76th Street from Iroquois to Great Plains Blvd.
b) Great Plains Blvd. from Sante Fe Trail to Chan View
3. This Council shall meet at the Village Hall on the 23rd day of April,
1973, at 8:00 o'clock P. M. , for the purpose of holding a public hearing on the
proposed construction of said improvement.
4. The Clerk is authorized and directed to cause notice of the time, place
and purpose of said meeting to be published for two successive weeks in the
Carver County Sun, being the official newspaper of the Village, the first of such
publications to be not less than 10 days and the second not less than 3 days prior

RESOLUTION ESTABLISHING SEWER AND WATER RATES
WHEREAS, Ordinances No. 5 and 6 of the Village authorize the Village
Council to establish by resolution municipal sanitary sewer and water
usage charges, and
WHEREAS, the Village Council has determined that water usage afford
the most accurate and equitable means of establishing sanitary sewer usage
charges.
NOW, THEREFORE, BE IT RESOLVED THAT:
1. The sanitary sewer usage charge applicable to premises
connected to the municipal water system is hereby estab-
lished to be $7.50 per quarter plus 50 cents for each
1,000 gallons or fraction thereof of water consumed per
quarter in excess of 10,000 gallons, except that the
sewer usage charge for all residential structures for
the lst quarter shall apply to the 2nd, 3rd and 4th quarters.
2. The sanitary sewer usage charge for single family
residences not connected to the municipal water system
is hereby established to be $15.00 per quarter.
3. The sanitary sewer usage for apartment buildings not
connected to the municipal water system is hereby
established to be $10.00 per quarter for each two-bedroom
apartment and $7.50 per quarter for each one -bedroom or
efficiency apartment.
