PROPOSAL '
As part of the Lake Drive and Lake Drive East roadway projects,
located between Co. Rd. 17 and 184th Street, the City impacted some
Class A and B wetland areas (Attachments #1 and #2). The city
received a wetland alteration permit for the Lake Drive and Lake
Drive East improvements. The Lake Drive project occurred in 1989 '
and impacted 3.85 acres of wetland. The project provided 3 acres
. of mitigation. The .85 .acres of remaining wetland were to be
�
replaced off site on the Eckankar property. The Lake Drive East
project occurred in 1990 and impacted .47 acres of wetland. The
full area of wetland was to be replaced off site on the Eckankar
property since there was no suitable site for on site mitigation.
Therefore, all but 1.4 acres of the wetland areas impacted by the
construction of Lake Drive and Lake Drive East were replaced with
a wetland mitigation area located directly west of Lake Susan Hills
Park and just east of Co. Rd. 17. The remaining 1.4 acres of
altered wetland that still require mitigation will be replaced as
part .of the West 78th Street detachment project by creating a
wetland area in the southeast corner of the Eckankar property. The
West 78th Street detachment project is moving forward with
contracts going out for bid this fall. The city is processing a
wetland alteration permit to allow for the creation of the required
storm water ponding area for the West 78th Street project, a
proposed future frontage road and for the provision of the wetland
mitigation required for the Lake Drive and Lake Drive East
construction. 1
In addition to the West 78th Street detachment project, the city is
designing the Hwy. 101 realignment. The current project area
extends from Co. Rd. 17 to mile west on West 78th Street. The
new roadway embankment for the TH 101 south leg realignment is
impacting a small portion of a Class B wetland (.01 acres).
Therefore, the city is also processing a wetland alteration permit
for the improvements to the south leg of Hwy. 101.
All of the alterations to wetlands from the previous projects and
the proposed projects are being fully mitigated and staff is
recommending approval with appropriate conditions.
TH 101 Realignment - South Leg

A portion of Class B wetland fringe is being impacted by the south
leg of Hwy. 101 roadway embankment (Attachment #3). The impacted 1
area is very small in size with only .01 acres (650 square feet)' of
wetland being altered. The wetland is designated as Class B and is
in marginal condition. The alteration is necessary to accommodate
the TH 101 roadway alignment that has been previously approved by
the Planning Commission and City Council. The .01 acres of wetland

being removed is being replaced with the creation of a wetland area
as part of the West. 78th Street detachment project.
1 West 78th Street Detachment
The West 78th Street detachment project is realigning existing West
78th Street to the north to provide adequate separation from Hwy.
5. The West 78th Street detachment project is creating a ponding
area to accommodate storm water runoff - from the adjacent properties
(including the Charlie James and B. C. Burdick properties), is
creating a wetland mitigation area and is also providing a future
roadway as an extension to West 78th Street to serve as a frontage
' road north of Hwy. 5.
Staff reviewed several options for the mitigation of the past
wetland alterations and for the creation of the required storm
water ponding area for the West 78th Street detachment project.
The original plan showed the entire storm water ponding area being
created within the existing wetland in the southeast corner of
' Eckankar property. This option altered a significant amount of
existing Class A wetland and subsequently required increased
mitigation. Locating the storm water ponding area fully within the
existing wetland also did not allow for pretreatment of the storm
' water runoff prior to it entering the wetland. Staff directed BRW
to review relocating the storm water ponding area to south of the
frontage road where it would be separate from the existing wetland.
' This is the plan that is now being proposed for approval by the
Planning Commission and City Council. The proposed plan
accommodates on site retention while also separating the storm
' water pond from the existing wetland and providing pretreatment of
the storm water runoff. This design also does not impact the Class
A wetland. The Fish and Wildlife Service and Corps of Engineers
have reviewed the most recent plan and have approved the plan.
Both agencies prefer the new plan over the previous plan. The
watershed district has also approved the plan.
The creation of the frontage road will result in alteration of .25
acres of the Class A wetland. The embankment on the north side of
the frontage road encroaches into the wetland edge. The frontage
road has always been planned for future development and to
eventually serve as access to Lake Ann Park. The road must be
located as proposed to connect with the West 78th Street
intersection on the east side of Co. Rd. 17 and to provide adequate
' room for the storm water pond. Therefore, avoiding any impact to
the wetland was not possible. The wetland is designated as a Class
A wetland and the alteration will occur on the south edge. The .25
acres of wetland being removed is being replaced in equal amount
and type within the mitigation area.

The areas of wetlands impacted by the past and current, roadway 1
projects are being replaced in a wetland mitigation area on the
Eckankar site. The existing Class A wetland is located directly
north of the proposed frontage road. The existing Class A wetland
is being expanded to the west to provide the mitigation area. The
expanded wetland area will be of similar type as those that were
removed with both type A and B characteristics. The wetland will
be designed to the six Fish and Wildlife recommendations. The
plans show a 1.65 acre wetland area being created. This is being
expanded to 1.66 to provide for the .01 wetland area being lost
with the south leg of the TH 101 project. The top 18" of the muck
within the existing and proposed wetland area will be removed
during construction and spread back after construction is complete.
This will maintain existing vegetation characteristics. 1
The following table breaks down the mitigation areas.

Staff recommends the Planning Commission adopt the following
motion:
"The Planning Commission recommends approval Wetland Alteration 1
Permit #91 -3 as shown on plans dated July 2, 1991, with the
following conditions:
1. The wetland mitigation area will be increased to 1.66 acres
and be designed to meet the six Fish and Wildlife criteria.
2. Type III erosion control shall be installed between the
existing wetland area and all disturbed areas.
3. All disturbed areas shall be spread with topsoil /muck from the 1
project to revegetate the area with existing vegetation.

breeding season.

PLANNING COMMISSION UPDATE
On July 17, 1991, the Planning Commission unanimously recommended
approval of Wetland Alteration Permit No. 91 -3 dated July 2, 1991,
' with staff conditions.
CITY COUNCIL RECOMMENDATION
1 The Planning Commission recommends that the City Council approve
Wetland Alteration Permit No. 91 -3 dated July 2, 1991 with the
following conditions:
1. The wetland mitigation area will be increased to 1.66 acres
and be designed to meet the six Fish and Wildlife criteria.
2. Type III erosion control shall be installed between the
existing wetland area and all disturbed areas.
3. All disturbed areas shall be spread with topsoil /muck from the

months and a separate storm water retention basin shall be
used as a two pond system to absorb the most severe impacts
' from water level flucuation and roadway contaminants
entering the adjacent wetland.

Engineers and the Watershed District.
4. Staff will work with the applicant of Market Boulevard and
Lake Drive to reduce the amount of impact to the #5 wetland.
Lake Drive East as depicted on Figure 1 of the plans, east of
Market Boulevard and west of TH 101 is not part of this
wetland alteration permit application and is not included in
this approval.

Thomas E Carroll interim pond construction without a frontage road, while Figure 2B
Craig A. Amundsen shows the pond with the frontage road. As shown, the interim pond
Donald E. Hunt could easily be modified to allow the frontage road construction.

The construction of the retention basin will require the disturbance
of approximately 1.34 acres of existing wetland. It is proposed
that excavation be performed on other areas of the site to mitigate
' this loss of wetlands. In addition, mitigation is proposed to
replace wetlands previously disturbed as a part of the Lake Drive
and Lake Drive East projects. The Lake Drive project requires the
' mitigation of approximately 0.9 acres, -while the Lake Drive East
project requires approximately 0.5 acres of mitigation. The new
retention basin, will, therefore, include the establishment of
' approximately 2.74 acres of new wetlands.
In addition to the completion of the City of Chanhassen Wetland
' Alteration Permit, we have prepared other permit application
submittals for the project as follows:

Placement of fill material in wetland to construct dike for retention/
treatment pond. Excavation is also proposed to establish new wetlands as
mitigation for areas disturbed by the dike construction.

Dike will create a basin for treatment of storm water prior to discharge - II
to Riley Creek /Lake Susan. The treatment basin is proposed to be
constructed in accordance with Nationwide Urban Runoff Program (NURP) criteria.'

Sec. 20-439. Discharges.
' (a) Soil loss from a construction site any part of which is in a wetland or within two
hundred (200) feet of the wetland that is within the wetland watershed shall not exceed a rate

' (b) Projected soil loss from a completed construction project shall not exceed one -half ton
per year if any part of it is in a wetland or within two hundred (200) feet of a wetland that is

Sec. 20-440. Stormwater runoff.
(a) A minimum increase in volume of stormwater runoff to a wetland from a development
over the natural volume of runoff may be allowed when necessary for use of property but only
when it will not have a net adverse effect upon the ecological and hydrological characteristics
of the wetlands. In no case shall the restrictions on runoff set out below be exceeded. Since the
total increase in runoff which can be permitted is limited, the council when considering
permit applications shall consider, in addition to the following, apportionment of increased
runoff opportunity to all wetland property within the surrounding wetland area.
(b) Stormwater runoff from a development may be directed to the wetland only when free
of debris and substantially free of chemical pollutants and silt, and only at rates which do not
•' disturb vegetation or increase turbidity. Sheet flow and other overland drainage of runoff
shall be encouraged.
I ' (c) The proposed action shall not cause stormwater runoff on the wetlands to take place at
a rate which would materially exceed the natural rate.
(d) The allowed total increased runoff, in combination with the total fill allowed, shall not
cause total natural flood storage capacity of the wetland to fall below, or fall below further,
the projected volume of runoff in the whole developed wetland watershed generated by a
5.9 -inch rainfall in twenty -four (24) hours.
(e) The allowed total increase in runoff, in combination with the total fill allowed, shall
not cause total natural nutrient stripping capacity of the wetland to fall below, or fall below
further, the projected nutrient production from the whole developed wetland watershed.

The alternative to wetland alteration would be to not construct the
treatment pond resulting in additional storm water contaminants being
discharged to Riley Creek and Lake Susan. •

ALTERATION: Alteration will allow the construction of a a Ke
for a storm water treatment basin, improving the quality of water discharged
to Riley Creek and Lake Susan. The proposed construction will disturb

The Board of Managers of the Riley- Purgatory -Bluff Creek Watershed
District has reviewed the plans and grading and land alteration permit
application as submitted to the District for the improvement- relocation of
the West 78th Street - County Road 17 intersection in Chanhassen.
•
The Managers approve of the grading and land alteration permit subject
to the following conditions:
1. All erosion control measures shown on the plans must be installed
prior to commencement of grading operations and be maintained until
all areas altered on the site have been restored.
If silt fence is used, the bottom flap must be buried and the
maximum allowable spacing between posts is 4 foot on center. All
posts must be either 2" x 2" pine, hardwood, or steel fence posts.
If hay bales are used, all bales must be staked in place and
reinforced on the downstream side with snow fence.
2. All areas altered because of construction must be restored with
seed and disced mulch, sod, wood fiber blanket, or be hard surfaced 1
within two weeks after completion of construction or no later than
October 15, 1991.

Marge Shorba: I just have a question. .
Emmings: Would you please stand up and identify yourself. '

Marge Shorba: My name is Marge Shorba. We own property on Hwy 101 south. I
t Right after you go over the bridge to the left. I'm just not quite sure
where this is with our property. I guess what I want to make sure that it
is far enough east because the frontage road will now be running in front
of our property. The new highway running directly behind it.. At one of II
f the other meetings they had promised us that they would build a dirt sound
1 mound adjacent to our property for the noise of the new highway.
1 Olsen: Those plans are still.

Marge Shorba: Okay, I just wanted to make sure that this wouldn't be II taking any, that there still would be room for that mound.
{ Olsen: Oh yeah. Actually this is part of with that design of the street.

Marge Shorba: Nothing else then?
*- Olsen: I think it's pretty well south of you where the creek?
Marge Shorba: Okay, we own property right after you cross the creek.

Olsen: Oh okay, to the south? It shouldn't.

favor and the motion carried. The public hearing was closed.

I Batzli: Is an earth work permit going to be required to do this? Is that
going to be brought in separately? Are they going to have to move a lot of
dirt for this?
1 Olsen: Yeah, they'd be getting into that. They'd be over 1,000 cubic
yards.
Batzli: We can't do that administratively?
Krauss: We can. Public projects are exempted from that requirement.
Batzli: Okay. Good. That's all I have. -
Emmings: Jeff?
I Farmakes: I have no further comments.
1 Emmings: I don't either. Is there a motion on this?
Batzli: I move the Planning Commission recommend approval of Wetland
Alteration Permit *91-3 shown on plans dated July 2, 1991 with the
conditions set forth in the staff report.
Erhart: Second.
I Batzli moved, Erhart seconded that the Planning Commission recommend
approval of Wetland Alteration Permit #91 -3 as shown on plans dated July 2,
1991 and with the following conditions:
1. The wetland mitigation area will be increased to 1.66 acres and be
' designed to meet the six Fish and Wildlife criteria.
2. Type III erosion control shall be installed between the existing
wetland area and all disturbed areas.
1 3. All disturbed areas shall be spread with topsoil /muck from the project
to revegetate the area with existing vegetation.
1 4. No alteration /construction shall be allowed during waterfowl breeding
season.
1 5. No direct storm water discharge into the wetland will be permitted.
6. The storm water pond shall be seeded with MnDot roadside mix for steep
1 slopes (clover).
All voted in favor and the motion carried'unanimously.
