two roadways which are critical to Chaska. Although it may be .
worthwhile to have the county escrow the $35,000 necessary for the
overlay, this office is very reluctant in recommending that the
improvement ':e completed immediately. The fact is that the
Chanhassen section is in the best condition. It should also be
noted that there is a "hole" in our ownership, i.e. Stoughton
Avenue is totally within the City of Chanhassen from TH 212 to the
cemetery. The cemetery section of the roadway is totally within
the City of Chaska. From the westerly edge of the cemetery to
Gedney, the roadway again is in Chanhassen. From Gedney back into
Chaska, Stoughton Avenue is totally within the City of Chaska.
Recognizing the odd ownership positions, the proposed overlay would
appear to the layman as a "patch job" completed with no apparent
logic. Again, the maintenance aspect of the turn back as well as
continued public safety concerns by Gedney needs to be addressed
during the next three year period.
A resolution supporting the county's request to remove Stoughton
Avenue as a county state aid road within the City of Chanhassen is
recommended. Approval should be conditioned upon the county
escrowing $35,000 for potentially overlaying the roadway - such at
the discretion of the City of Chanhassen.

Dear Don:
Previously we discussed the City of Chanhassen's interest in obtaining
sewer service from the City of Chaska for the area adjacent to the
Arboretum and south of Highway 5. In addition, we discussed the need for
a long term maintenance agreement relative to Stoughton Avenue and the
issue of fire response for Gedney's.
The purpose of my letter is to summarize in writing the general elements
of an agreement which may address each of these issues. For discussion
purposes, our agreement would potentially included the following elements:
A. The City of Chaska would agree to maintain that portion of Stoughton '
Avenue within the City of Chanhassen from Gedney's easterly to Highway 212
for a two year period starting August 1, 1991.
B. During the two year period, the City would agree to provide first 1
response fire service to M.A. Gedney as we are presently providing.
C. On or before January 1, 1993, Chaska and Chanhassen would execute a 1
concurrent attachment /detachment to the property identified on the attached
map.
D. The City of Chaska would agree to allow the City of Chanhassen to
connect to the Chaska municipal water and sewer systems in order to
serve the area identified in the attached map. Prior to finalizing the
agreement, the City would need to agree to a maximum water and sewer usage
for the properties.
E. It would be agreed that the property located west of Highway 41 and 1
south of Highway 5 would remain an industrial zone reserved for large
corporate sites and that no vehicular access would be permitted off of
Highway 41 except at 82nd Street. 1

F. It would be agreed that the Developer of the industrial land would
pay sewer and water connection charges to the City of Chaska and
annual sewer and water bills would be paid to Chaska.
Again, I am providing you this information for discussion purposes. I
hope we will be able to meet in the near future to discuss these concepts
further.

Dear Mr. Ashworth:
II Attached hereto is a drawing which illustrates the proposed
revision of the county state aid highway (CSAH) system and the
. transfer of county highway jurisdiction within the cities of
I Chanhassen and Chaska that has been a discussion item with staff of
the two communities during the past several months. Also, a copy
of this proposal has been reviewed by our district state aid
II engineer. The proposed revision and the proposed transfer are
summarized as follows:

TOTAL 2.46 Miles
This summary describes a county system of highways in Chanhassen
and Chaska that is reduced in length by 2.46 miles. It is,
therefore, important to interface this reduction with the 1977 CSAH
system agreements involving Chanhassen, Chaska, and the county.
Those agreements included the following statement about the
jurisdictional responsibilities for CR 117 (CSAH 10 to CR 114) and
CR 114 (CR 117 to TH 101):
"CSAH 14 between CSAH 17 and TH 101 is not currently
indicated as a county facility in the County Thoroughfare
Plan and would therefore, be turned back to the cities of
Chaska and Chanhasseh. However, this is complicated by
the fact that future TH 212 will affect the continuity of
this road, but the extent will not be known until
detailed layouts for TH 212 are prepared. Also, the
continuation of future CSAH 17 south of CSAH 14 is not
certain and depends upon access with TH 212, development
of a feasible alignment and approval by Chanhassen.
Because of these uncertainties portions of CSAH 14 will
be removed from the state -aid system, but the county will
maintain jurisdiction of this road, as well as CR 17 from
CR 14 to Engler Road, until more details are known and
the turnback will be a separately negotiated
arrangement."
The uncertainties of 14 years ago regarding the functions of these
two highway corridors are, for the most part, gone. In the
recently completed Eastern Carver County Comprehensive
Transportation Planning Study, these two highways are classified as
"class 2 minor arterials ". It is understood that these
classifications are being incorporated into the comprehensive plans
of both Chanhassen and Chaska. Also, the extension of new CSAH 17
south of CSAH 14 to existing TH 212 is now considered very
unlikely. This unlikelihood leaves CR 117 and TH 101 as the
primary north -south corridors in the county east of TH 41.

1 These "planning" changes support the proposal to again designate CR
117 (Engler Boulevard to CR 114) and CR 114 (CR 117 to CSAH 17)
county state aid highways. 'These designations would, in affect,
complete the 1977 commitment to negotiate the turnbacks of these
two segments of highway to the cities. Rather than 2.49 miles of
CR 114 and CR 117 turnback, 2.46 miles of Stoughton Avenue would be
' transferred to the jurisdiction of Chanhassen and Chaska.
As discussions about this CSAH system revision and about this
county highway transfer were taking place among staff members of
the two cities and the county, review and approval of the Carver
County 1991 -1995 Capital Improvement Program was also occurring.
The positive reaction to this system change and this highway
' transfer by staff members of the cities and the county did
influence this 5 -Year C.I.P. The county's approved 1991 -1995
C.I.P. assumes and incorporates the acceptance by the impacted
1 agencies of this CSAH system revision and this county highway
transfer.
The 1991 county highway department program does include the
' reconstruction of a portion of CR 117 that would be added to the
CSAH system by this proposed change. If the change is not made,
CSAH dollars could not be spent on the improvement. This would
' result in the County Board needing to reconsider the project.
To accomplish the objective of reconstructing a portion of CR 117
during 1991, the proposed CSAH system revision and the highway
' transfer must be advanced in a timely manner. The resolutions to
formally have the county, the cities, and the state consider these
changes have been written. These resolutions are:
1. County Board resolution revoking and designating
county state aid highways as described.
2. Chanhassen and Chaska resolutions approving the
CSAH revocations and designations.
' 3. Mn /DOT Commissioner's formal revocation and
designation of described CSAH system revisions.
' 4. County Board resolution revoking CSAH 12 as a county
highway following the removal. of CSAH designation
from the same corridor.
' I am enclosing with this memorandum a copy of Carver County Board
resolution 23 -91 revising the county state aid highway system.
This resolution was adopted by the County Board on March 26, 1991.

to be considered by the Chanhassen City Council. Adoption of this
resolution will permit the described CSAH system revision to be

WHEREAS, the County of Carver has proposed a revision of the county state aid highway
system within the Cities of Chanhassen and Chaska, and
WHEREAS, it appears to the County Board of the County of Carver that the roads

' APPROVAL OF COUNTY STATE AID HIGHWAY REVOCATION
•
WHEREAS, the County Board of the County of Carver did adopt a resolution revoking
the designation of County State Aid Highway No. 12 within the corporate limits of
the City of Chanhassen as follows:
1 That portion of County State Aid Highway No. 12, also named Stoughton
Avenue, said highway beginning at a point on Trunk Highway No. 212, said
' point being located approximately 400 feet north and 1650 feet east of the
south quarter corner of Section 34, Township 116 North, Range 23 West,
thence along the center line of Stoughton Avenue described as follows:
' From said point of beginning extending southwesterly across the South
One -Half of the Southeast Quarter (S 1, SE 1) of said Section 34 and
continuing southwesterly across the North One -Half of Section 3, Township
' 115 North, Range 2:3 West, to a point on the east limits of the City of
Chaska, said point being on the center line of Stoughton Avenue, and there
terminating.

NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Chanhassen that
