Emission Control Testing Station, Located North of Lake
I Drive East, East of Dakota Avenue and South of Highway 5,
Pope Associates.
There is an existing surface drainage easement shown on the Chan
I Haven 2nd plat (reference Carver County Book 170 page 436)
located in the northwest quarter of Lot 2. This temporary,
non- exclusive appurtenant easement for surface drainage purposes
I was acquired for the benefit of the McDonald's property. The
grading plan for the Emission Control Testing Station site
proposes to contain the run -off from the McDonald's property
I along the shared property line and direct the flow to the north
into an existing catch basin along the Trunk Highway 5 ditch. If
the Emission Control site plan is approved and constructed, then
it appears that this drainage easement is no longer needed and
1 may therefore be released by the City.
Recommedation:
1 1. It appears that the previously referenced surface
drainage easement may be released by the City
I conditioned upon the approval and completion of the
replat Chan Haven 2nd and site plan for the Emission
Control Testing Station.
