PROPOSAL
The applicant, Wayne Larson, first contacted staff to inquire about
being able to add to his garage. Mr. Larson resides at 6801 Brule
Circle (Lot 3, Block 2 - Parcel A). After review of his survey it
was found that the existing garage is 10 feet from the side lot
line and that any addition to the structure would require a
variance. The applicant wishes to add 10 feet to his garage which
would take it up to the side lot line and cover a 6 foot utility
easement.
Rather than pursue a variance which staff could not support, the
applicant pursued acquiring additional property. The adjacent
neighbor (Lot 2, Block 2 - Parcel B) was willing to sell some
property but to take a straight 10 foot strip would result in the
lot with less than the required 15,000 square feet. Therefore, the
applicant is proposing to acquire only a 10' x 44' section of the
adjoining property to accommodate the 10 foot addition and maintain
the required setback and lot area. The applicant is requesting a
metes and bounds subdivision to add the 10' x 44' portion of land
to his platted lot.
The. Subdivision Ordinance (Section 18 -37 (b)) permits dividing a '
platted lot to add a portion of the lot to an abutting lot to be
exempt from platting if it meets all the Zoning Ordinance
requirements. The proposal meets these conditions. Since the
applicant is also requesting an easement vacation, staff is
bringing the subdivision request before the City Council together
with the vacation request for a better understanding of the
proposal. The Subdivision Ordinance (Section 18 -60 (b)) states
side lines of lots shall be substantially at right angles to
straight street side lines. This was to eliminate triangular and
odd shaped lots. The proposed lot configuration maintains a
straight side lot line at a right angle. Although the proposal
does create a "kink" in the lot line, staff feels the main purpose
of the subdivision standard is being maintained and can support the
lot configuration. We note that an acceptable straight utility
easement is being provided.
As a result of the proposed metes and bounds lot division,. an
existing side yard utility and drainage easement must be vacated
and a new one provided. The metes and bounds subdivision is
proposing to vacate the existing southerly 6' easement and provide
a new 6' easement line which will still accommodate the purpose of
the original easement line. Staff is requiring the applicant to
provide a drainage plan showing how drainage will be accommodated
between the two residences and within the new drainage easement.

A certificate of occupancy will not be issued until the City
Engineering Department approves of the drainage plan and on -site
improvements.

RECOMMENDATION
' Both the metes and bounds lot division and the easement vacation
result in the required lot areas being maintained, provision of the
required easements and allows for the addition to the single family
residence to maintain the required 10 foot side yard setback.
Staff is recommending the City Council adopt the following motion:
"The City Council recommends approval of Metes and Bounds
Subdivision #90 -19 and the proposed Easement Vacation #90 -8 of the
6 foot utility and drainage easement with the following condition:
1 1. That the new metes and bounds subdivision with the description
of the new drainage and utility easement be recorded at Carver
County along with a development contract listing any
conditions of approval.
2. The applicant shall provide a drainage plan showing how
drainage will be accommodated between the two homes (Parcel A
& B) and within the new drainage easement. A certificate of
occupancy will not be issued until the City Engineering
Department approves of the drainage plan and on site
improvements."

Dear Mr. Krauss:
Based on our discussions of the past two months I am enclosing 1
my request to allow the Campbells to sell 440 sq. ft. of pro-
perty to the Larsons. This will allow the Larson's to build
a 10 x 24' garage addition and still maintain the 10' side Get
back for each lot. The proposal includes a 10' utility ease-
ment that is in a straight line which meets the intent of the
code for straight property lines. The Campbells agree with the
proposal and are willing to appear in support of this plan. The
Campbells recently completed construction on their new home.
Enclosed is a set of photos that demonstrate visually the appro-
priateness of the proposal. The Campbells will complete their
yard work in 1991 and drainage is expected to occur along utility
and property lines.
It is my understanding that this request go to the city council.
Enclosed is a completed application, twenty -six copies of plans,
a check for $100.00 and a list of property owners.
