Audubon Road South, Project No. 89-18

The Audubon Road South roadway project from the Soo Line Railroad Bridge south
' to Lyman Boulevard was unable to be completed in 1990 as planned due to the late
construction start. The construction lift of the final bituminous and final
restoration work will be completed in the spring of 1991 as soon as weather
' permits. In light of this fact, additional project expenses will be incurred by
HNTB, our consultant on this project as they oversee the remaining contractor
work efforts.
' Additional project expenses have also been experienced and are layed out in the
attached February 19, 1991 letter fran HNTB. Specifically, additional survey
time was involved in investigating a number of site conditions which arose
' during the construction phase. Several of these items relate to easement
negotiation work which was extensive for the Michel, Barinsky and Stockdale
properties. The other efforts relate to an unanticipated perched ground water
problem and resulting drainage design modifications.
The previously approved contract ceiling amount for this construction phase was
$43,151.00 as shown in the attachments. This scope change has been negotiated
' with HNTB and the revised amounts I believe are representative of the work which
is needed to complete this project effectively in 1991. The consultant contract
is, by necessity, set up on an hourly reimbursement basis to cover the
uncertainties which are typically covered during the construction. Other issues
which are for the most part out of the control of the consultant but impact °
their fee relates to how aggressively the contractor pursues the work. The
weather has been a factor in this regard as well in causing contractor delays
and backtracking to dry subgrade materials.
The good news is that the project is no longer exposed to unknowns from
underground conditions and weather. We therefore expect the project to be
canpleted rapidly this spring within the revised ceiling cost as proposed by

HNTB in their February 19 summary. As will be recalled, this project is
primarily funded out of Tax Increment Financing, District No. 2-1 proceeds
' (McGlynn District) and we anticipate no increase in the assessment portion of
this project.
' It is therefore recommended that the City Council approve amending the
construction services contract with HNTB for improvement project 89-18
establishing a revised ceiling of $65,600.

Revised Engineer Estimate for Construction Services
Dear Mr. Warren:

I have reviewed past, present, and future engineering costs for the referenced project. I
HNTB's letter dated July 26, 1990, provided an estimate of our staffing requirements to
construct Audubon Road. If the project had been completed during 1990, the estimate for r
project management and inspection would have been adequate to build the street.
However, the estimate to do the construction staking was probably insufficient from the
start. The actual construction staking has taken approximately 340 hours. An additional

100 hours were needed to survey the following areas: additional slope staking on the Michel
property, drainage ditch design and construction staking for the new drainage ditch along
Lyman Road, additional cross sections and slope staking on the Barinsky property, design I
survey and construction staking for new storm sewer north of Heron Drive, and additional
slope staking required on the Stockdale property.

I Based on the fact that the construction extended beyond October 15, 1990 and the fact that
the project will not be completed until June, 1991, we are requesting that our construction
engineering contract be increased to $65,600. We are presently studying the intersection
Icapacity and level of service for Audubon Road and Heron Drive as an additional
transportation planning service (Estimated Study Cost $1,000.00).

Dear Mr. Warren:
With the award to Imperial Developers, Inc., we would like to proceed into the construction phase '
for the project. We propose that the compensation will be on a cost plus with a maximum. We
have attached a description of the proposed person hour estimate and fees. The estimated hours for
Construction Inspection are based on a full-time Resident Project Representative (as described in an
Appendix "B" of the contract) on the site for about 11 weeks and periodic visits by office personnel
for inspection of utility construction. We will request, if necessary, additional funds if the
maximum amount is exceeded in the future. We also have enclosed a-copy of correspondence '
indicating our latest overhead rate which is slightly higher than last years overhead rate. The
multiplier, using the new overhead rate is 2.69 [(134.24% + 100%) x 1.15].
Regarding the additional services for preparation of easements, we estimate the total amount spent
as of Friday, July 20th at about $11,000. Chet is still working with the property owner and some
easements will change with deletion of the trail south of Heron Drive. We estimate an additional
fee amount of about $4,000 to complete the additional services for easements. For your information '
we have attached a summary of the estimated fees for the different task and services.
We have forwarded the contracts to Imperial Developers, Inc. in a separate letter dated July 25,
1990. '
Unless you have any objections, we will proceed to contact GME Consultants, Inc. and have them
perform the necessary construction and density testing. GME will bill you directly for their
services.
