MNDot Highway 5 Condemnation of Parcel No. 215 Age
Dear Don: Vole?,
II I have reviewed the Notice of Petition and Petition of the
_ State of Minnesota regarding the condemnation of various parcels
II for the Highway 5 improvement. As you know one of the parcels over
which the State requires an easement is a 700 square foot
rectangular parcel which is the very -northerly end of a proposed
street easement. The parcel is identified on the MNDot Right-of-
II Way Plat 10-4 as Parcel No. 215. A photocopy of two maps showing
the size and location of the parcel are enclosed herewith.
I The State is proposing to acquire the permanent easement it
needs for the improvement of Highway 5 in return for a payment to
the City of $1,600.00. Based on all of the facts and circumstances
II surrounding this situation, it is our recommendation that the City
accept the proposed offer of $1,600.00 in return for granting the
Department of Transportation the easement it needs to upgrade
Highway 5.
II ' In the event the City acts in accordance with this
recommendation, or on some other basis, please let me know and I
will draft the appropriate documents. In the meantime if you have
any questions please feel free to call me.
