APPLICABLE REGULATIONS 1
Section 20-1303 - Highway and General Business Districts. The sign
ordinance permits one pylon business sign greater than 64 square
feet no larger than 80 square feet after securing the conditional
use permit. Such sign must be located at least 10 feet from any
property line and shall not exceed 20 feet in height.
BACKGROUND
With proposed expansion of Hwy. 5 and the realignment of Dakota
Avenue, portions adjacent to the right-of-way from the Sinclair
site will be taken. Existing signs are located on that portion
that will be taken by MnDOT and the existing signage has to be
removed.
On February 28, 1989, Planning Department Staff denied an
application for two pylons signs. The area of each sign was
proposed as 176 square feet. This is the only record the city has
of a sign application for the Sinclair site. At the present time,
there are three pylon signs on the site which have a total area of
112 square feet (Attachment #1) .
ANALYSIS
The applicant is proposing to remove three pylon signs that have a
total area of 112 square feet and install a sign with a total area
of 72 square feet and 20 feet in height (Attachment #2) . The Sign
Ordinance permits such signs after securing a conditional use
permit.
Section 20-232, General Issuance Standards. The Planning ,
Commission shall recommend a conditional use permit and the Council
shall issue such conditional use permit only if it finds that such
use at the proposed. .ocation: ,
1. Will not be detrimental to or endanger the public health,
safety, comfort, convenience or general welfare of the
neighborhood or the city.

2 . Will be consistent with the objectives of the city's ,

be compatible in appearance with the existing or intended

PLANNING COMMISSION UPDATE
The Planning Commission unanimously recommended approval of the
conditional use permit for Sinclair Oil. After review of this
application by the Commission, staff felt that it would be
appropriate to add a condition that would ensure the removal of the
existing free standing sign when the new sign is installed.

' RECOMMENDATION
Staff is recommending that the City Council adopt the following
motion:
' "The City Council approves Conditional Use Permit Request #91-2 for
one 70 square foot pylon sign with the following conditions:
1. The sign may not exceed 20 feet in height.
2 . The area of the sign may not exceed 72 square feet.
3 . The sign shall maintain a minimum setback of 10 feet from all
property lines.
4 . The applicant must submit an application for a sign permit.
' 5. All existing free standing signage shall be removed
simultaneously with the installation of the new sign. "

Sharmin Al-Jaff presented the staff report on this item . Chairman Emmings
called the public hearing to order .
Conrad moved, Erhart seconded to close the public hearing. All voted in
favor and the motion carried. The public hearing was closed.
Emmings: Does anybody have anything to talk about on this? If not , is
there a motion?
Batzli : I 'll move that the Planning Commission recommend approval of
Conditional Use Permit Request #91-2 for one 70 square foot pylon sign with
the conditions set forth in the staff report .
Conrad: Second .
' Emmings: It says that one of the conditions is that the applicant must
submit an application for a sign permit . Now isn't that what this is?
That just sounds peculiar to me . I thought they had to give you an
' application before that issue comes up .
Krauss: Commissioner , no . Actually what they 've applied for now is the
conditional use permit between you and the City Council . They actually
need the permit to construct the sign.
Emmings: Okay . Do they ordinarily do that at one time?
' Krauss: No .
Emmings: Okay .
Krauss: They actually do that if they have approval and when they 're ready
to put the thing up .
' Emmings: Okay .
' Batzli moved, Conrad seconded that the Planning Commission recommend
