Addition
Attached is a copy of the restrictive covenants for Lot 1, Block 3,
and Lot 1, Block 1, Chanhassen Lakes Business Park 2nd Addition.
' The City Attorney has reviewed the restrictive covenants and has
found them to be acceptable.
RECOMMENDATION
Staff recommends the City Council approve the Declaration of
Restrictive Covenants for Lot 1, Block 3, and Lot 1, Block 1,
Chanhassen Lakes Business 2nd Addition.

DECLARATION OF RESTRICTIVE COVENANT
KNOW ALL MEN BY THESE PRESENCE, that ROSEMOUNT, INC. , a
Minnesota corporation ("Rosemount") , as owner of the property
situate in Carver County, Minnesota, legally described as follows
(the "Option Parcel") :
Lot 1, Block 3, CHANHASSEN LAKES BUSINESS PARK SECOND
ADDITION, according to the recorded plat thereof, and situate
in Garver County, Minnesota;
and also the property described as ("Main Parcel") :
1 Lot 1, Block 1, CHANHASSEN LAKES BUSINESS PARK SECOND
ADDITION, according to the recorded plat thereof, and situate
1 in Carver County, Minnesota;
and also the property described on Exhibit "A" which is attached
hereto and made a part hereof ("Triangle Parcel") , (the Option
Parcel, the Main Parcel, and the Triangle Parcel are hereinafter
1 collectively referred to as "Parcels") , hereby covenants and
declares that the Parcels, and every part thereof or interest
therein, are now held and shall hereafter be haled, transferred,
sold, leased, conveyed, mortgaged, pledges, and hypothecated
subject to the covenants and conditions herein set forth and shall
' apply to and bind each successor in interest of Rosemount.
The covenants and conditions herein set forth shall run with
the Parcels and every part thereof or interest therein, and shall
be binding upon all persons, trusts, or entities having or _
acquiring any right, title, or interest in the Parcels or any part
thereof.
That the covenants and conditions are as follows:

1. No building shall be constructed on the Option Parcel or !I
the Triangle Parcel without the prior approval of the Housing and I
Redevelopment Authority in and for the City of Chanhassen ("HRA") . II in this restrictive covenant shall be deemed to restrict or
prohibit the owner of the Option Parcel and Triangle Parcel from

petitioning the City of Chanhassen for permission to install a sign
on the Option Parcel or the Triangle Parcel, provided that such

. sign may not be located as to interfere with the use or maintenance
of any easement on the Option Parcel or the Triangle Parcel.
2 . From and after the date hereof, title to the Parcels I
1. shall, at all times and for all purposes, be held in common owner-
ship and shall not be separately conveyed or encumbered, but shall I
constitute a single parcel for purposes of taxation and a single
lot under Minnesota Rules 1990 § 6120.2500, Subpart 8. II
The terms, covenants, and conditions hereof shall run with the

land and shall be binding on the present and future owners of the
Parcels and shall only inure to the benefit of the HRA and the City I
of Chanhassen and may be terminated, extended, modified, supple-
mented or amended at any time and from time to time by the sole I
combined act of the owner of the Parcels, the HRA, and the City of II Chanhassen.
