V e I o 1 0 Blanket Variance February 11, 1991 Page 2 BACKGROUND In 1986, the City Council approved the PUD for Chanhassen Vista. As part of the subdivision review, staff discovered a Class B wetland located in the northeast portion of the PUD. The applicant was required to adjust the lot configuration to accommodate protection of the Class B wetland and to verify that a house could be located on the adjacent lots while maintaining the required 75 ft. setback. A plan was provided by the applicant showing the wetland edge and showing that a 75 ft. setback could be maintained with the development of single family homes on the lots (Attachment #1) . The 8 lots located adjacent to the wetland have since been developed with single family residences. In early 1989, staff was notified by a Council member that grading activity was occurring very close to the wetland as a part of the construction of the single family residence on Lot 5, Block 3 , Chanhassen Vista 4th Addition (7251 Sierra Court, Attachment #2) . Upon inspection of the site, staff found that the erosion control required to be installed around the edge of the wetland to protect the wetland was instead installed within the wetland. Over one- half of the wetland was outside of the protection of the erosion control. Staff measured the setback of the house under construction and found it to be approximately 40 ft. from the actual wetland edge. Staff met with the builder of the home (Novak-Fleck Construction) at the site and was told that it was their understanding that the erosion control marked the edge of the wetland. Staff walked around the wetland measuring the other existing homes including additions to the homes such as decks, and found that almost none of the homes met the 75 ft. setback. Staff then reviewed all the building permits for the homes and found that what was shown on the surveys as the wetland boundary was not the correct wetland boundary, but one much smaller than the existing wetland. The surveys provided by the builder as part of the building permit application did in fact show the homes being 75 ft. from the wetland, but this setback was taken from the incorrect wetland survey. Staff signed off on the permits believing that the wetland setback was being maintained. The wetland boundary that was shown on the survey as a part of the building permit reflects the wetland boundary that was shown on the preliminary and final plat of the PUD. Staff had visited the site with the developer and with a representative from the DNR and the Fish and Wildlife Service to determine the wetland edge and the wetland type. The wetland edge was staked at that time. It was assumed that the applicant would properly reflect the wetland edge on the preliminary and final plat. It is now apparent that the wetland that was being shown on the plat as a part of the review and approval process did not reflect the correct boundary of the wetland. As a result, the homes located on the lots adjacent to 11 Blanket Variance February 11, 1991 Page 3 the wetland do not meet the 75 ft. setback and, in fact, would not have been considered buildable. I Staff again met at the site in May, 1989 with the developer, Saul and David Segal, along with a representative from the Fish and Wildlife Service to again mark off the boundary of the wetland. Staff then required the developer to have a new survey made of the property showing the correct edge of the wetland and the existing structures. Attachment #3 is a copy of this survey which shows that the correct edge of the wetland was almost equal to the area Icovered by the drainage easement. As a result of the incorrect survey, there now exists a situation I where the existing single family residences around the wetland do not meet the 75 ft. wetland setback and a new neighborhood standard has been created with setbacks as close as 36 ft. to the wetland. The single family structures are now non-conforming and unless I variances are granted, they could not be replaced or have improvements/additions made to them. On January 14, 1991, the City Council reviewed the possibility of a blanket variance to the 75 foot wetland setback to make the existing structures conform and it was unanimously approved directing staff to proceed with the blanket application (Attachment i #4) . House Setback - The closest corner of the house is located 65 , feet from the wetland edge. Deck Setback - Approximately 70 feet from wetland edge. In review of the existing structures located on the 8 affected parcels, the closest structure from the wetland edge would be 35 feet, which allows for a 14 foot deep deck to be located at 7251 Sierra Court. The remaining structures on the affected lots all exceed the 35 foot setback including existing decks. Even if Lot 2, Block 4, Chan Vista 4th Addition, 651 Conestoga Trail requests a deck to swing around to the rear of the house facing the wetland with a 14 foot depth, the setback would exceed 35 feet from the wetland edge. Therefore, if the City Council establishes a blanket variance allowing a setback of 35 feet from the wetland edge, staff is comfortable that all of the affected lots will be within the 35 foot setback. I 11 Blanket Variance February 11, 1991 Page 7 ' The wetland adjacent to the affected lots is still in comparable condition as it's pre-development state. The addition of decks as ' close as 35 feet from the edge of the wetland will not negatively affect the wetland condition. As part of the blanket variance, each affected lot will have the variance recorded against the property so that it is documented where the wetland is located, ' how close a structure can be located and any other conditions added as part of the variance to further protect the wetland. The Board of Adjustments may grant a variance only if it finds all the following: ' 1. That the literal enforcement of this chapter would cause undue hardship and practical difficulty. * The literal enforcement of the 75 foot wetland setback ' would create a situation where the existing structures are nonconforming and would not be permitted to make any additions or alterations. 2 . That the hardship is caused by special conditions and circumstances which are peculiar to the land and structure involved and which are not characteristic of or applicable to ' other lands or structures in the same district. * The hardship is caused by the existence of a wetland with ' the 75 foot setback and as a result of an incorrect survey. 3 . That the granting of the variance is necessary for the preservation and enjoyment of substantial property rights. * The granting of the variance is necessary for the existing homeowners to enjoy their substantial property rights by making their structures conforming. ' 4. That the special conditions and circumstances are not a consequence of a self-created hardship. * The special conditions and circumstances are not a consequence of self created hardship. The incorrect survey falsely showed that the homes were meeting the 75 foot setback and in conformance with the Zoning Ordinance. 5. That the variance will not be injurious to or adversely affect the health, safety or welfare of the residents of the city or the neighborhood wherein the property is situated and will be in keeping with the spirit of this chapter. Blanket Variance 11 February 11, 1991 Page 8 ' * The variance will not be injurious to or adversely affect, the health, safety or welfare of the residents of the city or the neighborhood since the proposed variance will not be damaging to the existing wetland and in fact could be used to further protect the wetland. RECOMMENDATION ' Staff recommends the City Council adopt the following motion: "The City Council approves the Blanket Variance Request #91-1 to permit structures within 35 feet of the Class B wetland edge on Lots 1-5, Block 4, Chanhassen Vista 3rd Addition and Lots 5-7, Block 3 , Chanhassen Vista 4th Addition with the following conditions: 1. The variance is recorded against each separate lot. , 2 . The wetland boundary is established at the 950' contour. 3 . No alteration beyond the 950 ' contour shall be permitted. This includes any removal of vegetation or filling. Any structure closer than 35 feet from the wetland edge shall not be permitted. " ATTACHMENTS 1. Preliminary plat with incorrect wetland boundary.
