On Tuesday, August 13, 1991, bids were received and opened for the
II South Leg Trunk Highway 101 Realignment Project No. 90-20. The
confirmed low bidder is Wm. Mueller & Sons, Inc. at a total
contract bid of $402,540.85. This bid was approximately 18% higher
I than the revised engineer's estimate. The primary reason for the
low bid exceeding the engineer's estimate is due to the cost of the
granular borrow which came in at approximately double the estimated
cost. It is apparent that the borrow source for this material is
I some distance away. In addition, the uncertainties with the fall
weather conditions may have also affected the overall bid prices.
II As a part of the bid proposal, each bidder was asked to submit an
alternate pricing for the postponing of the wearcourse paving until
1992. The alternate bid price from Wm. Mueller & Sons, Inc. for
this work if delayed until 1992 will add $4,000 to the total
Icontract.
As I had mentioned previously in a previous staff report, this road
I improvement will function as a temporary road segment of the future
new Trunk Highway 101. The two primary benefits for construction
of this temporary road segment are the redesignation of Trunk
II Highway 101, via Dakota Avenue, Trunk Highway 5 and Market
Boulevard south of Trunk Highway 5 out of the downtown area. This,
incidentally, is the only route for Trunk Highway 101 which MnDOT
would consider for redesignation. More importantly, however, is
I the fact that the Trunk Highway 212/Trunk Highway 101 improvement
project may not be completed for 10 years or so and delay the
redesignation accordingly. Therefore, the City has made a
1 commitment to MnDOT, Carver County and Hennepin County to do this
temporary connection thus allowing for the Trunk Highway 101 to be
redesignated by MnDOT and relieve some of the traffic burden now
IIbeing carried through the downtown roadway system.

The majority of the necessary agency permits have been applied for
and granted with the exception of MnDOT, Carver County and the DNR.
These three remaining agency permits are expected to be received
within a week or so. The present construction time schedule calls
for a project start-up of September 16, 1991 and a completion by
' December 6, 1991. Any delay in permit approval may impact the
project schedule. It is therefore recommended that the City
Council award the South Leg Trunk Highway 101 Realignment
Improvement Project No. 90-20 to Wm. Mueller & Sons, Inc. at a
contract amount of $402,540.85 with an alternate price of $4,000
for paving the wearcourse in 1992, contingent upon receiving the
remaining outstanding agency permits (MnDOT, Carver County, DNR) by
September 20, 1991.

The low bidder is William Mueller and Sons, Inc. , with a total bid
price of $402,540.85. The William Mueller and Sons bid is
approximately $62,540.00 above our Engineer's Estimate, a difference
of approximately eighteen percent (18%). Although the low bid is
substantially greater than the Engineer's Estimate, the bids appear
fairly competitive within a range of approximately ten percent (10%)
of each other.
As a part of the bid, each bidder was required to submit alternate
' pricing for the delay of the wear course paving until 1992. Bid
alternate pricing for this modification in the project schedule
ranged from an addition in the total contract amount of $850.00 to
I $4,000.00. The alternate bid price for William Mueller and Sons,
Inc. , was a total contract addition of $4,000.00.
' We have reviewed the bids to determine the reason they exceeded the
Engineer's Estimate. Based on our review, it appears that
approximately $40,000.00 of the overrun is a result of bid prices
' for granular borrow which are significantly higher than anticipated.
Our estimated unit price for the granular borrow was $4.00/cubic
yard based on pricing received for the recently constructed TH
101/Lake Drive project. Granular borrow pricing received for this
project ranged from $5.50 to $9.54/cubic yard with a median price of
$8.55/ton. It is also possible that the short schedule and late
' season construction may have affected bid prices.
William Mueller and Sons have been involved in some recent projects
in the City of Chanhassen; however, they have not recently been a
part of any projects with BRW. It is our understanding that they
have performed satisfactorily and should be capable of performing
the work required by this project. We, therefore, recommend award
of the TH 101 Realignment - South Leg Project, CP 90-20, to William
Mueller and Sons, Inc., for the low bid price of $402,540.85.
William Mueller and Sons propose to use the following subcontractors
to perform the work required by the project:

Subject to City Council approval, we anticipate commencing ,
construction by September 16, 1991. All work required by the
project will be completed by December 6, 1991.
It should be noted that this project has required several agency
approvals including:

o Riley-Purgatory Creek Watershed District
o Minnesota Department of Natural Resources (DNR)
o Army Corps of Engineers
o City of Chanhassen (Wetland Alteration Permit) I
We have obtained Riley-Purgatory Creek Watershed District, Corps of
Engineers and City of Chanhassen approvals. It is anticipated that
we will receive DNR approval within the next week. We are currently
working with Mn/DOT and Carver County to obtain their approval prior
to the scheduled construction start date. Any delay in permit
approvals may impact the project schedule.

The primary impetus for this project is based on the previously
approved relocation of Trunk Highway 101 around the downtown area
via Dakota Avenue/Trunk Highway 5/Market Boulevard which resulted
from a TH 101/TH 5 Alignment and Land Use Corridor Study prepared
in September of 1989 by Hoisington Group, Inc. You will recall
that the first phase of this program involved the construction of
Market Boulevard from Trunk Highway 5 south to the Rosemount
driveway (Capital Improvement Project No. 88-22A) which was
completed in 1990 . This proposed project encompasses the
extension of new Trunk Highway 101 from its present terminus at
Market Boulevard south approximately 1400 lineal feet to the
existing Trunk Highway 101. This new segment of roadway will
function as a temporary road as the ultimate alignment will
likely be constructed in concert with the Trunk Highway 212
improvement project.
The improvements associated with this project will involve
clearing and grubbing, grading, construction of a rural roadway
section, ditches, storm sewer and a realignment of the
intersection with existing Trunk Highway 101.
The side slope grading for the new roadway will necessitate a
wetland alteration permit from the City. This item is scheduled
for Planning Commission action on July 17, 1991 and City Council
action on August 12, 1991 . All of the other pertinent agency
permit applications have been made with the exception of the
MnDOT permit which will be submitted pending approval of the
project plans and specifications . The estimated total project
cost is $320, 000 which has been proposed to be funded via tax
increment/special assessments.
As I had mentioned previously, this road improvement will
function as a temporary road segment of new Trunk Highway 101. I

11 There are two primary reasons for the City to construct this
temporary road segment. First of all , MnDOT has agreed to
approve a redesignation of Trunk Highway 101 via Dakota Avenue,
Trunk Highway 5 and Market Boulevard south of Trunk Highway 5
conditioned that the new Trunk Highway 101 would connect to the
old existing Trunk Highway 101 . This also is the only route
which MnDOT would consider for redesignation . Secondly, the
Trunk Highway 212/Trunk Highway 101 improvement project may not
be completed for another 10 years or so and would hamper
redesignation of the current Trunk Highway 101 around the
downtown area . Therefore, the City has made a commitment to
MnDOT, Carver County and Hennepin County to do this temporary
connection thus allowing Trunk Highway 101 to be redesignated by
MnDOT and further relieve some of the traffic burden now being
carried through the downtown roadway system.
A tentative project schedule has been submitted by the project -
consultant engineer which, pending plans and specifications
approval on Monday night, tonight, would call for awarding the
contract at the August 12, 1991 City Council meeting and a
project completion by November 15 , 1991. A copy of the plans and
specifications for this project are available in my office for
review and inspection . I will also have a set available at the
Council meeting on Monday night.
It is therefore recommended that the plans and specifications for
the South Leg Trunk Highway 101 Improvement Project No. 90-20 be
approved and authorization by given to advertise for bids .

not far down the road right now in Eden Prairie and they're coming this way. If
he wants to wait 10 years, let's let him wait and get the city into it and do it
right instead of making everybody put in water and their wells and their septic
systems and then a couple years all of a sudden you're on city water and sewer.

�ary Warren: As the Council may recall, we commissioned a study here to allow
us to obtain land use input as well as alignment input for TH 101. The impetus
for the study was actually the suihni.ttal by MnDot of the proposed official map
for the TH 212 corridor of which an intersection was shown with TH 101. Our
initial reaction to the area was that MnDot's plan was showing TH 101 would,
from the intersection, off load traffic onto the current alignment of TH 101
which would then abut onto all the property owners as it currently does along
Lake Susan. That did not seem to be a reasonable proposal although we have
included it in this analysis as the do nothing alternative. As a result, the
City commissioned Fred Hoi.sington and BRW to look at the alignment and land use
issues. The current information in front .of you and Mr. Hoi.si.ngton is here
tonight to go into the details as you see fit, deals primarily with the
alignment of TH 101 and the four alternates that we looked at. Although in
order to make some sense out of it, we did include some preliminary land use
input so that you could see how the alignment does impact land use options in
the corridor. There is a separate study that is going to be compiled for
approval at a future date dealing specifically with adopting the land use
alternatives. However, this is strictly to address the preferred alignment for.
TH 101 from TH 212 to TH 5. At your discretion, Mr. Hoi.si.ngton is available
with some charts to go into any details. Likewise we have some of the land
owners and interested parties here. We had a very good, I thought public
information meeting on April 17th and we got some good input there so would you
like Mr. Hoisi.ngton to go into any presentation or what's your pleasure? I
Mayor. Chmi.el: Is there anyone in the audience wishing to take another look see
at what Fred has done previously? I've sat.through this probably about 3 times
and I'm sure most of you sitting here have gone through it as many times as
I have and the rest of the Council. Have you seen it? If not hearing any,

one of those in favor of leaving the alignment where it is but I don't '
that's going to be possible. I've got neighbors to live with but I
prefer
Alternate 1. Some things about it that I don't like too well. You're going to
I have single family dwellings with a road in front and a road in back and I think
that's something that the Council never did like to see in any development. It
happens to abut and be a good portion of my land that is in that area and I know
II it's going to devalue the value of that land i.nbetween those two roads by a
considerable extent. Looking at the zoning, I see some residential medium
density right along the side of TH 212. I think with the impact of TH 212
coming in there, that maybe that should be a high density residential like
apartments or something like that. Mr. Barts who owns a piece of land just to
the north of my property, he's living down in Kentucky right now and I've been
having quite a little correspondence with him. In fact, I've got his property
II for sale and I think it would be sold if it wouldn't be for the fact that thes
road alignments were being discussed. Also I would prefer it to stay on the old
alignment down below there but he also prefers Alternate 1. The one thing he
I did talk to me about, in that little center island there where it shows
residential medium density and with the single family to the west of that spur
that comes off of TH 101 going to 86th Street, he thought it should probably be
II medium density all the way to that spur instead of that row of single family
there. That would be this piece right in here.
ill Councilman Johnson: Al? The only thing we're actually deciding on tonight is
TH 101. Where the side streets go. What's it zoned. That's a different issue.
They put it on here as an illustration only. This is a possibility. Any of the
side streets except for of course 86th and Tigua, which are already there, are
just illustrations. This is Fred's dream of what could be there in the future.
Al Klingelhutz: When would we find out about the zoning on this property then?
ICounciLman Johnson: That would be taken up with the Planning Commission, I'm

PRELIMINARY ALIGNMENT STUDY (TH 101 to TH 5)
WHEREAS, a report was prepared by The Hoisington Group and
BRW, Inc. , outlining four alternatives for the alignment of Trunk
Highway 101 between the new proposed Trunk Highway 212 and
existing Trunk Highway 5. The report includes input received
I from a public information meeting held on April 17, 1989 at which
over 23 people attended.
I WHEREAS, after inputting the results of the land use poten-
tial for each of the alternates and the roadway geometrics as it
relates to the TH 212 layout, it appears that Alternative No. 1
I offers the best compromise in geometrics, land use and property
owner concerns.
NOW, THEREFORE, BE IT RESOLVED BY THE CHANHASSEN CITY COUNCIL
II that Alternate No. 1 contained in The Hoisington Group's memo
dated April 18, 1989 is hereby selected as the preferred alter-
native. Further, that a public hearing be scheduled for May 22,
I1989 to public input.
