In your letter of October 11, 1991, you I indicated a concern that there was "approximately 300 acres" of land located outside of the MUSA line that is proposed to be assessed by the City relative to the Lake Ann Interceptor. I am II not sure where this acreage total comes from and, in fact, there was a much smaller amount of land that fell into this category. The area in question is called Ches Mar Farms and is located in a small narrow band west of Hwy. 41 and south of the Minnewashta II Regional Park. During the recent public hearing process, we eliminated this parcel from the assessment area since it is located outside of the MUSA line. There are no other parcels in the final II assessment roll located outside of the MUSA line. I hope this responds adequately to your inquiry. Thank you again I for your continued efforts on our behalf relative to the proposed contract amendments that we have submitted to the Lake Ann Interceptor Agreement. Box 147 Chanhassen, Minnesota 55317 RE: Chanhassen Sanitary Sewer Assessments 1 Dear Paul: ' I am writing to let you know that the Management Committee unanimously approved the amendment to the Lake Ann Agreement on October 8, 1991. The full Council will act on the amendment on October 24, 1991. After action by the Council, the amendment will be sent to the City for execution. In addition, as I mentioned in our recent conversation, a resident of the City of Chanhassen contacted Metropolitan Council staff regarding a proposed assessment for sanitary sewer improvements by the City. The resident's property is located outside the Metropolitan Urban Service Area ("MUSA") and therefore does not receive sanitary sewer service. Based on the assessment notice,it appears that approximately 300 acres of property located outside the MUSA were proposed to be assessed by the City. A copy of the assessment notice and a map prepared by Council staff of the assessment area is enclosed. You indicated to me that the City Council subsequently removed this property from the area assessed. I hope that upon receiving the assessment notice and map you can confirm that the area was not assessed. Metropolitan Council policies require that local governments have assessment practices which limit creation of vested development rights. Assessing property owners for sewer service which ' they do not receive may create vested development rights in that the property owners believe they have the right to demand receiving the services they have paid for. In addition, it may be unconstitutional for the City to assess for improvements which do not benefit the property assessed. ' For the protection of the City, I would request that the City insure that it does not continue to assess persons ibr sanitary sewer in areas which are outside the MUSA.
