These hearings allow affected property owners Ito ask questions and publicly voice their opinions on the proposed improvement project. It is hoped that the two previously held neighborhood meetings and corresponding follow-up 1 investigations have answered many of the questions and concerns of the area residents . The following are some of the key project revisions directly resulting from discussions at the neighborhood meetings: . - MnDOT approved reduction in, the proposed roadway width from 36 feet to 32 feet I - The location of walkway/trail system has been modified to meet the needs of the residents - Presentation on the recently completed Eastern Carver County Transportation Study related to predicted future traffic demands 1 - Reduced raw land unit assessment from 3 units per acre to 1.8 . units per acre - Reduction in the proposed unit assessment rate from $2, 340 to $1 ,250 1 I have attached a copy of all resident correspondence concerning the project received by this office. • • II II Don Ashworth July 1 , 1991 Page 2 It has also been hypothesized that a bituminous overlay may be a more economical project alternative . It is apparent that this ' approach would be short-sighted and it is likely to be more costly in the long term. An investigation of the existing pavement and subsoil condition conducted by Braun Testing Company clearly recommends a reconstruction of the road section. In addition, a bituminous overlay would not improve intersection . sight lines and storm drainage problems currently being experienced. ' I had tentatively scheduled this public hearing for the June 24, 1991 City Council meeting . Due to a schedule conflict with one ' of the Councilmembers, the Public Hearing has been postponed to the July 8, 1991 meeting. Unfortunately, I will be out of town during the week of this meeting; however, the project consultant ' engineer, Bill Engelhardt, will be at the public hearing to address questions and comments on various aspects of the project and feasibility study. ' The project is considered feasible from an engineering standpoint at a total estimated cost of $2,112, 738 . The proposed project • funding utilizes Municipal State-Aid funds to account for nearly 50% of the costs with the remaining share to be divided among special assessments, general obligation bonds and trunk watermain funds . This roadway project would also complement the scheduled ' November, 1994 and February, 1995 MnDOT reconstruction and signalization at the intersections of Trunk Highway 5 and Trunk Highway 7, respectively. ' In viewing the currently revised project schedule, work on the project could begin yet this year; however, any further delays would likely push the project totally into the 1992 construction ' season. It is believed that this feasibility report has addressed the elements commonly associated with this type of roadway improvement project and, in addition, the special concerns raised by area residents . Project funding has been developed in a creative yet logical manner which is advantageous to the benefitting properties . It is therefore recommended that the feasibility study for the improvements to Minnewashta I . Parkway, Project No. 90-15, be approved and authorization be given to have the project consultant engineer, Bill Engelhardt, prepare plans and specifications for the project. ktm Attachments: 1. There are a number of inherent II problems associated with the existing Minnewashta Parkway such as; storm drainage, traffic and sight distance problems, deficient road section design, and geometric hazards at the intersection with Trunk Highway 5 and Trunk Highway 7. There II have also been a number of resident complaints raised concerning the safety of pedestrians and bikers who make use of this roadway. As a part of the data collection process for this study, two neighborhood meetings were held to provide preliminary information on the specific elements of the proposed project and II , to acquire corresponding resident input. It became obvious that there were a few common concerns shared by the residents. These concerns involved the proposed road width ( 36 feet) , the proposed Icrossover of the trail/walkway system, the speed of vehicles currently travelling the roadway, the volume of traffic that would result due to this road improvement, and the proposed assessment amount. As a result of these two meetings and II follow-up investigations, the State approved a reduction in the proposed roadway width to 32 feet, the walkway/trail system is proposed to be constructed entirely on the east side of the II roadway, information on predicted future traffic volumes from the recently completed Eastern Carver County Transportation Study was- provided and the proposed unit assesment rate has been reduced Ifrom $2, 340 to $1, 250 . An alternative raised by some residents at the neighborhood II meetings was to scale down the improvement project to only a bituminous overlay. During the feasibility study soil borings were taken by Braun Engineering and Testing Co. to determine the 1 ATTACHMENT # 1 I Mr . Don Ashworth June 5 , 1991 Page 2 • existing roadway section and subsoil- condition. The findings of - II this soil investigation are included in the Appendix B section of this report . The borings found varying depths of existing pavement thickness and numerous sections of poor subgrade soils. The soils report concluded that "Due to the condition and variability of the existing pavement section and subgrade we recommend reconstruction of the existing pavement section should be considered." • One other important aspect of this project is that the southern 1300 feet of this roadway is within the corporate limits of Victoria. Since the City of Victoria is not eligble to be on the Municipal State Aid Road System, construction costs associated with this segment of the roadway could not be funded through State Aid dollars unless the roadway was annexed by the City of Chanhassen. In April, the primary elements of this project including potential options to deal with the southern 1300 feet of the roadway were presented to the Victoria City Council. The City of Victoria has since adopted a resolution recommending a land swap in order to allow the City of Chanhassen to annex this portion of Minnewashta Parkway including the six properties imme- diately east of the roadway. However, a Joint Powers Agreement will need to be prepared to assess properties on the west side of the roadway as undeveloped units remaining within the City of Victoria corporate limits . The project is considered feasible from an engineering standpoint 1 at a total estimated cost of $2,112, 738 . Why can' t the road be repaired with maybe a slight I widening for the walkers etc. maybe g g It is not necessary to make such a wide road out of it at this time. II Our feeling is that the walkers could walk on the correct side of the road and that the bikers could ahere to a more careful track when riding. As it now stands the walkers II walk clear out into the roadway and many of them going with the traffic. The bikers are riding all over the road with no thought to the cars aware If all who use that road will be a little more4of the traffic and the people using that road we wouldn' t have I any problem at all. ' There is no need to widen, realign, reshoulder or accomplish other so called improvements to increase the volume and speed of traffic between State Highways 1/ 5 and #7. Pedestrian and bicycle lanes or trails are not required in this area which already has extensive provisions for such pursuits. The present parkway provides for a slow pleasant drive along the Western shoreline of Lake Minnewashta with sufficient access and egress to both highways for ' this strictly family oriented, single family owned residential area. Hearsay regarding the eventual closing off of the Leslee Curve road into Pleasant Acres subdivision from State Highway #7 would entail a serious -public safety problem due to limiting ready access for fire department, ambulance and police vehicles. The closure of this access would also grossly affect the congregation of Holy Cross Lutheran Church. We also join with our many neighbors and adjacent property owners in the Chanhassen-Excelsior-Victoria areas to protest the unwarranted expenditures of public funds, particularly during the current economic downturn period, for the proposed Minnewashta Parkway "improvement". The almost $3 million could be put to better use within the guidelines of present budgets without affecting assessments and taxes which are becoming prohibitive for many families - we ' request our elected representatives to act with more financial responsiblity to the desires of the citizens and cease their continual irresponsibilities. Elimination of this project altogether could assist in present overburdening ' spending locally, statewise and nationally. Excelsior , MN 55331 May 6 , 1991 r Dear Mayor Don Chmiel Not having had the opportunity to attend the open forum meeting regarding the proposal to upgrade Minnewashta Parkway, I feel compelled to write this letter to delineate my viewpoints as a 'neighborhood ' resident in the Red Cedar 1 Pt area. My understanding is that many residents are opposed to the proposal . It is also my understanding that you have recommended that all people harboring an opinion should voice their desires , also . In my case , I did not feel it necessary to do so as many had already expressed my opinion . There are many others who believe as I do - that it is unnecessary to reiterate a common position . I feel that it would be a grave and certainly inaccurate assumption on anyone's part that silence means agreement . After all , how you determine the pulse of the people should not be important . Rather , what that 'pulse' is should be what is important ; and I can assure you that the 'pulse' is violently opposed to the extent of 'renewal ' that has been proposed . Minnewashta Parkway has many homes existing right on the Parkway itself , which is in direct contrast to highway ' #41 just to the east . Creating a major thoroughfare out of Minnewashta Parkway would adversely impact many , many more homeowners than , say , expanding Highway #41 . Since that route already exists and is much more heavily used as it is a direct route to Chaska and beyond , would appear to preclude the necessity for another Highway 5 to Highway 7 connection only one mile away . Also , another 'connection ' al ready exists just west of Minnewashta Parkway - County Road 13. Additionally , both of these routes are much , much straighter and direct as the roads do not wind in and out around the lake. With two such routes within two miles, what need is there for a third? Certainly it makes little sense to 'upgrade'a road to encourage increased travel that already has two additional routes in close proximity. And that is what a substantial upgrade would do, encourage additional travel . I have seen the estimates for future use of Minnewashta Parkway . I have lived in the Minnetonka area for 30 years and there is no way these estimates would be even close unless major upgrading were effected and at least one of'the two other superior travel routes were eliminated . There is no reason to use Minnewashta Parkway other than for area residents , as it leads nowhere except to connect Highway and Highway 7 . Highway 41 , as mentioned earlier, is straight , wide and continues through to Chaska and beyond to Highway 212 . Highway 13 at least continues south from Highway 5 to other destinations , al so . Minnewashta Parr way only ser.. ices area residents , it does not continue anywhere t elEe . ItAs far as the PH s, path is concerned , that is what . Carver Park , a couple of miles down the road is for - why II subsidize a facility twice when what already exists is perfectly acceptable? Drivers have always been very considerate of joggers , roller-bladers , bikers , etc . , on I Minnewashta Parkway - there do not appear to be any problems here . Besides , people living on Highway 7 or Highway c do not have. bike paths , and those highways will always be considerably more travelled and dangerous than Minnewashta II Par[ way . (Least you think my position is biased , both my wife and I are joggers and bikers and have no complaints , whatsoever) . ItThe estimated cost , in terms of tax dollars out of residents pockets , is even more deflated than the estimated I future use of Minnewashta Parkway is inflated . From personal e;.perience , estimates for funds are always great i y under-estimated . Attempting to tack on additional taxes on top of the horrendous property tax increase beating we had I for 1q91 , I find it appalling that anyone would have the gall to request additional taxes for an unnecessary project . on top of property tax raises of 30% , 40% , 60% and more . II However , I hope that the consideration given me is significantly better than the attitude of our land asseyor, whose response to my inquiry as to the severe property ta:: II increase was , and I quote , If you cannot afford it , maybe you shoul dn 't be 1 iving there . " Nice guy , huh Perhaps what is most distressing is that a pleasant I winding , low-key residential road has been targeted for urbanization . What with all the construction and 'progress' • we have seen for Eden Prairie , one would think that some II areas should remain 'pristine' . Change and progress are inevitable , but not in of themselves and not every change or aspect of progress is good . II Please listen to the people and allow at least one quaint one and one-half mile stretch of thoroughfare retain its timeless charm . Take a drive down the Parkway, note the I twists and turns, the pine trees, the homes abiding right on the Parkway, the view of Lake Minnewashta , the bridge over the only creek: outlet for the lake , the peaceful serene 1 'pulse' of the area . Then , ask yourself this question : is this upgrade plan progress in the positive direction? I won 't even bother to ask you to pretend your house was on the Parkway. The people of Minnewashta Parkway area have been placed in an akward position of first trying to get "city hall" to reject the proposed changes to the parkway and then must come up with their concept of what should be done. How did a situation develop that we hire a consultant to make grandiose changes to our area that has been so unpopular? There has been extensive opposition to the excess width of the road, an- expensive retaining wall, and a concrete trail that requires children to cross the road at the poorest line of site on the parkway. The present image of city hall for us certainly is not one of allowing us to control the spending of our money for a convenience we have asked for, for some time. , As pointed out in the second public meeting, the Parkway itself is not dangerous. What is dangerous is the lack of a place for children and adults to move along the road. What I am suggesting is to scrap the proposal and rethink the problem. Why not just put a new blacktop covering on the road and give us an "adequate" trail. When I say an "adequate" trail I mean a four or six foot blacktop trail like so many of our neighboring communities have. I have talked to Eden Prairie maintenance people and they have no reservation on the use of a blacktop trail. As a person who has used various trail systems extensively I favor the blacktop, it does not breakup requiring expensive repairs and it is far easier on the body. Remember, we are expected to pay for this and cost is a major factor. Another alarming feature of the proposal was to put the trail on the lake side of the road from Pleasant Acres to about Red Cedar Point Road, (requiring an expensive retaining wall) . We do not want an expensive retaining wall. If one were to come out and look at the road, you would see there is an extremely poor line of site all along the road where children would have to cross to get to the trail. Some day my land, along with my neighbors, will be developed and there will be families. Expecting all their children to cross the road at the worst possible line of site and recross again a few hundred yards to the north is ludicrous. I have discussed this position with three of my neighbors and they are in agreement. We would be glad to discuss this issue with you in more detail if you desire. Sincerely, David R. In fact I would register my disapproval to improve this road at all except for maintenance only of irregular surfaces such as pot holes. Curb, water, sewer, and gutter and improved surfaces costing three million dollars is a matter for city living not country living. I live on Red Cedar Point and before me, my father had a cabin on Red Cedar Point since 1935. We'd. like to maintain for as long as possible the feel of country living. . We feel that if you straighten out, widen, and smooth off Minnewashta Parkway we will vastly increase the amount and speed of traffic on this road and bring the city to the country. In addition to this I realize that three million is quite a bit of money and all epople who live in this area would be assessed a portion of this money. II However, since I have been working with the project consultant engineer in developing the feasibility study, I felt I might be of help in responding to your questions concerning some of the specifics of the proposed project. I II attempted to• contact you twice on Friday, March 29, 1991 and left a message on your telephone answering machine. I regret that we were not able to make contact by phone prior to your sending a letter. In your letter you raised a question concerning the proposal for a walkway/trail II as a part of this improvement project and who would pay for it. Minnewashta Parkway is a Municipal State Aid Street which means the City receives annual II apportionments from the State for maintenance and improvements to this and other MSA streets within the city. The State Department of Transportation recognizes trails and walkways as an integral part of an urban roadway improvement project thus, this type of amenity is eligible for full State funding. II At this time, I anticipate that the feasibility study for ,this road improvement project will be canpleted by April 22, 1991. It was most informative and well done . After the 1 general meeting I discussed my specific situation with Bill Englehart. Ever since Maple Ridge was developed, the surface water has been directed down Maple Shores Drive thru the culverts and through the J.a - �er�, Jasin and Borchart properties directly into Lake Minnewashta. With the new roadway improvement system, I would like to request that the Maple Ridge surface water go under Minnewashta Parkway and ' into Lake St . Joe. This would allow settling and purification before it goes into Lake Minnewashta. This would also eliminate the large amount of silt and nitrates presently being washed into Lake Minnew- ashta. This would clean up the problem for the Borcharts, the taus and the Jasins. It would also assist the ecology by not funneling the sur- face water from Maple Shores Drive directly into Lake Minnewashta. I have discussed this with council members Wing and Workman and they also agree it is a proper solution. We should not be forced out our home because of taxes. The request by people in this area was to put in a simple walk way . Why should the City improve a road for outside traffic to use to cut across to the highways on. At the present time there are two trunk highways that can be used, Highway 41 and County Road 13. The improvements consist of the reconstruction of the road base and bituminous, concrete curb and gutter, storm sewer and and sidewalk from Trunk Highway 7 to Trunk Highway 5 . Said improvements are to be paid by a combination of Municipal State Aid Funds, General Obligation Bonds and special assessments to benefitting properties .
