REQUESTED ACTION (No Vote Required)
The City Council is requested to hold a public hearing on the Mn/DOT submitted
plan layout for TH 212.
BACKGROUND
On July 28, 2003, the City Council adopted a resolution supporting the
accelerated funding of new 212.
On November 10, 2003, the City Council approved a consultant contract with
Kimley-Horn and Assoc. for municipal consent services on the project.
On December 8, 2003, the City Council called a public hearing to be held January
26, 2004 on the project.
DISCUSSION
As required by State Statute, the City must hold a public hearing on the Mn/DOT
submitted layout for new TH 212. The City Council has up to 90 days from the
date of the public hearing to either approve or disapprove (by resolution) the
layout. City staff and our consultant, Kimley-Horn, have previously reviewed the
layout and cost estimate. A list of issues/concerns has also been generated and
submitted to Mn/DOT for their review. Mn/DOT's response letter to the City's
review comments is attached. Jon Horn, of Kimley-Horn, will update the Council
at the public hearing on which issues have been resolved and those that are still of
concern.
Mn/DOT's cost estimate for City participation on the project has decreased from
$3.4 million to $2.1 million. It should be noted that this cost does not include any
proposed City water or sanitary sewer cost. These utility costs will be identified
with the upcoming feasibility study for the 2005 MUSA area.

Staff has envisioned the following process for the public hearing:
1. Staff introduces Mn/DOT.
2. MnDOT will give a short project overview and touch on.key issues in
Chanhassen.
3. Staff/Consultant will then give an update on any remaining issues.
4. Council questions.
5. Mayor opens public hearing.
6. Due to time constraints, public hearing is continued during regular
Council meeting.
7. Staff/MnDOT will answer the public's questions as necessary.
8. Mayor will close public hearing.

Mn/DOT has provided responses to the various issues identified ~ our
January 6, 2004 comment lett~ for the TH 212 municipal consent process.
A copy of the January 16, 2004 Mn/DOT response letter is attached.
Mn/DOT has agreed to accept many of the layout changes requested by
the City. The following is a summary of the M.u/DOT responses to each

· Design constraints requ/re that the mdc-x-pass structure be
constructed as one arch structure rather than two as requested
by City staff. The use of one structure is acceptable to City

· Mn/DOT has agreed to provide access to the Fox property;
however, the location of the access has not yet been defined.
Future plans for TH 212 should show the location of this

Fox Property Tra/1 Connector
· Mn/DOT has stated that the construction of the future Fox
property trail connector w/il need to follow Mn/DOT's
traditional permitting process. This will require application for
a Limited Use Permit to construct and maintain the trail within
Mn/DOT right-of-way. It is recommended that the City initiate
ti'tis process ov~ rte next few months so that the Limit Use
Permit can be obtained and the trail design/construction can be
coordinated with the construction of TH 212.
TH 101 Access for Park and Ride Facility
· Mn/DOT has agreed to the City's request.
TH 101 Access for Curry Property
· Mn/DOT has agreed to the City's request; however, the City
will incur additional turn lane and signal costs for the addition
of this access. The need for this access should be discussed
with the property owner since assessments could be used to
fund some or all of these additional costs.
Lyman Boulevard (CSAH 18) Access for Curry and Klein
Properties
· MrffDOT has agreed to tiao City's request.

101 Access for Klingeihutz Property
Mn/DOT ha~ denied the City's request for a right-in/right-out
access to TH i 01 for this property. Access to this property will
be limited to 86th Street. There is some concern with limiting
access to only 86th street considering that the property is nearly
10 acres in size and, depencling upon future development,
could generate a fairly si~nificant u'affic volume.
Keconstruction of TH 101 North of Lake Susan Drive
· Mn/DOT is suggesting that the reconstruction of old TH 101
between Lake Susan Drive and 86t~' Street be addressed as a
part of the future reconstruction of TH 101 between TH 212
and Lake Drive (see Item 15 below). Mn/DOT ha~ ~tated that
they would be willing to include the reconstruction of this
section of TH 101 as a part of the TH 212 project if Mn/DOT

101 Reconstruction (Lake Drive to TH 212)
Mn/DOT has stated that it is not feasible to include the
reconstruct[on of TH 101 between TH 212 and Lake Drive as a
part of the TH 212 project. Mn/DOT has programmed the first
phase of this project for 2005 wi-rich would include a
reali~m~mont of Riley Creek. Funding packages will need to be
established for futuro phas~ of the project before they can be
programmed. The City will need to continue to work with
Mn/DOT on this issue.

cost participation will be based upon actual construction costs. It should

any City smzitary sewer or water main utility improvements that may be

Dear Mr. Saam:
The following is a summary of city of Chanhassen issues with a
Department response. The issues revolve around the Mn/DOT municipal
consent package for the TH 212 design build project.
LAYOUT REVIEW
1. Bluff Creek Pedestrian Trail Underpass
· It needs to be determined if the pedestrian trail should be built
on the east or west side of Bluff Creek.
· The City would prefer that the underpass include two arch
structures with an open median area rather than one structure.
Response: Two arches create a hazard in the median and drainage can be
facilitated by other means. The structure will extend under the eastbound
and westbound lanes to allow for the possibility of adding a third lane in
the future. The location of the trail within the structure will be determined
during the completion of the detail design, as part of the Design Build
contact. Mn/DOT will work closely with the city of Chanhassen in
determining the final location of the trail within the structure.
2. Fox Property Access
· Access needs to be provided to the undeveloped Fox property
at the southeast comer of the Powers Boulevard (CSAH 17)
and Lyman Boulevard (CSAH 18) intersection or Mn/DOT
should acquire this property as a part of the TH 212 project.
Response: The Department does not anticipate purchasing the southeast
corner of the undeveloped Fox property as described above. Therefore, a
means of access will be provided. However, additional discussions with

Carver County will be necessary in determining the final location of
access.

Screening Berms
· Concerns have been raised regarding the need for berms to
screen existing residential development in the project area.
The number and location of these berms needs to be reviewed
as the project design is further developed.
Response: Mn/DOT has worked closely with the City of Chanhassen staff
to identify these locations. These locations have been added to the project
and will be constructed as material is available. The size of these berms
will be restricted to the availability of material and the current Right of
Way limits.

Fox Property Trail Connector
· The City is requesting that the geometric layout show a future
City trail connection in Mn/DOT right-of-way along the south
side of the southeast ramp at the Powers Boulevard (CSAH
17)/TH 212 interchange. A drawing is attached illustrating the
location of this trail connection.
·
Response: The construction of this trail will need to be pursued through
Mn/DOT's traditional permitting process.
.
TH 101 Access for Park and Ride Facility
· The City is requesting a right-in/right-out access to TH 101 for
the proposed park and ride facility in the northeast comer of
the TH 101 and Lyman Boulevard (CSAH 18) intersection.
We understand that Southwest Metro Transit has also requested
an access to TH 101 at this location.
Response: This access is acceptable to Mn/DOT. The location of this
access will need to be, at least, 50fi. from the existing right turn taper for
TH 101.

TH 101 Access for Curry Property
· The City is requesting that a full access be provided to TH 101
for the undeveloped Curry property in the northwest comer of
the TH 101 and Lyman Boulevard (CSAH 18) intersection.
The access would be at the location of the proposed southeast
ramp/loop connection to TH 101. The City understands that a

connection to TH 101 at this location would require that the
connecting roadway be dedicated as a public roadway. This
access will require the addition of a right mm lane on
southbound TH 101 and a left mm lane for northbound TH 101
at the intersection.
Response: This access is acceptable to Mn/DOT. The location of the
access shall be located at the intersection of TH 101 and the southern
ramp termini. In addition, this access shall be a public through street that
connects with Lyman Blvd. This access will require additional turn lanes
on TH 10!, a center through lane and turn lane on the exit loop and a
possible signal. Additional costs shah be addressed in accordance with
the Mn/DOT cost participation policy.
o
Lyman Boulevard (CSAH 18) Access for Curry and Klein
Properties
· The City is requesting that the proposed Lyman Boulevard
(CSAH 18) access to the Curry and Klein properties in the
northwest and southwest comers of the Lyman Boulevard
(CSAH 18) and TH 101 intersection be moved 50' further to
the east.
Response: Relocating this intersection 50fi further to the east is
acceptable to Mn/DOT.
.
TH 101 Access for Klingelhutz Property
· The City is requesting that a right-in/fight-out access be
provided to TH 101 for the undeveloped Klingelhutz property
along the east side of TH 101 south of 86th Street.
Response: A right-in/right-out from TH 101 is not acceptable to the
Department in this location.
.
Reconstruction of TH 101 North of Lake Susan Drive
· TH 101 is being realigned as a part of the proposed TH 212
project and a portion of old TH 101 north of Lake Susan Drive
is proposed to become a City street. Old TH 101 is currently in
poor condition and the TH 212 project does not currently
include the reconstruction of this portion of old TH 101. The
City is requesting that Mn/DOT reconstruct old TH 101 in this
area as a part of the tumback of the roadway to the City.

Response: Mn/DOT anticipates the turnback of the section of TH 1 O1
between Lake Susan Drive and 86th Street to be addressed independently
of the TH 212 Design Build project and as part of the TH 1 O! gap project.
However, if an agreement can be reached between the city of Chanhassen
and Mn/DOT on the scope of work and costs necessary to turnback the
section of TH 101 between Lake Susan Drive and 86th Street to the City,
before May Ist, 2004, the department would reconsider this position and
consider adding it to the TH 212 Design Build project.
10.
Lake Susan Drive Access for Curry Property
· The City is requesting that access be provided to Lake Susan
Drive for the undeveloped Curry properties along the north and
south sides of Lake Susan Drive west of TH 101.
Response: This is acceptable to Mn/DOT. However, all costs associated
with the construction of right-in~right-out intersections, including the
extended raised median, will be the responsibility of the city of
Chanhassen.
11.
Excess R.A.L.F. Right-of-Way
· The City is interested in the excess R.A.L.F. right-of-way
along the north side of TH 212 between TH 101 and the east
City border (Parcel 71 excess acquisition as shown on March
27, 2003 right-of-way map, see attached). Additional
discussions are needed to determine the best way to facilitate
City ownership of this property.
Response: Disposition of remnant Right of Way associated with this
project will offered in the following order. 1)Public Entities, 2) Previous
Owner, and 3)Open Market. Sale of these properties will not take place
until the project is complete.
12.
Delete Lyman Boulevard (CSAH 18)/Park and Ride Trail
· The City is requesting that the layout be modified to remove
the proposed 10' wide trail shown along the north side of
Lyman Boulevard (CSAH 18) east of TH 101.
Response: This is acceptable to Mn/DOT.
13.
TH 101 Trail Modifications
· The City is requesting that the layout be modified to move the
proposed 10' wide trail along TH 101 south of Lyman

Boulevard (CSAH 18) from the west side of the roadway to the
east side of the roadway.
Response: This is acceptable to Mn/DOT.
14.
TH 101 Access for Klein, Wilson and Nettesheim Properties
The City is requesting that the layout be modified to show
access locations for the Klein and Wilson properties along the
west side of TH 101 south of Lyman Boulevard (CSAH 18)
and to the Nettesheim property along the east side of TH 101
south of Lyman Boulevard (CSAH 18).
Response: This is acceptable to Mn/DOZ Access the Klien property
along the west side of TH 101 will be restricted to a right-in/right-out.
Access to the Wilson and Nettesheim properties will be full access.
15. TH
101 Reconstruction (Lake Drive to TH 212)
TH 101 from TH 5 to Lake Drive is currently a 4-lane section.
TH 101 is also proposed to be reconstructed to a 4-lane section
as a part of the TH 212 project. The remaining 0.89 mile
section of TH 101 between Lake Drive and TH 212 is currently
a 2-lane section that needs to be upgraded to a 4-lane design.
Mn/DOT has stated that this section of TH 101 is outside of the
scope of the TH 212 project. If this section of TH 101 can't be
included in the TH 212 project, the City would like to have an
understanding from Mn/DOT on the future process/schedule
for the reconstruction of this section of TH 101.
Response: The addition of this segment of roadway to the New TH212
project is not a feasible option. The Department has programmed stage
one of this project consisting ora stream realignment. This is scheduled
to be completed during the Summer of 2005. The Department will
continue to work with the city of Chanhassen to pursuefundingpackages
to complete stage 2 of the TH 101 gap project. Funding packages will
most likely include state and local participation.
COST PARTICIPATION SUMMARY REVIEW
Powers Boulevard Bridge
· The cost summary includes a Chanhassen contribution of
approximately $532,500 for the widening of the Powers
Boulevard (CSAH 17) bridge. The City was of the

understanding that Mn/DOT would pay the cost for the bridge
widening based upon a November 25, 2003 letter from
Mn/DOT to the City (see attached).
Response: The November 25th, 2003 letter addressed items related to the
recent A UAR completed by the city of Chanhassen. The Department will
pay for bridge costs justified by the 20 year forecast. The City of
Chanhassen will be responsible for costs of roadway approaches
exceeding the 2007 volumes. Therefore, the $532,500 for bridge costs at
Powers Blvd will become the responsible of Mn/DOZ The roadway
approach costs required as a result of the A UAR will be the responsibility
of the City of Chanhassen.

County Roadway Costs
The cost summary includes a Chanhassen contribution of
approximately $788,500 for turn lane, roadway widening,
traffic signal, and/or right-of-way costs at Pioneer Trail
(CSAH 14), Powers Boulevard (CSAH 17), and Lyman
Boulevard (CSAH 18). All of these roadways are under
Carver County jurisdiction. Discussions should be initiated
with Carver County regarding their participation in these costs
based upon the current County cost participation policy.
· Additional information is needed from Mn/DOT to review the
proposed cost splits for the traffic signal installation along
Powers Boulevard (CSAH 17) at the northeast ramp/loop and
southeast ramp/loop intersections.
· The cost participation summary includes Chanhassen costs to
construct a right-turn lane on westbound Lyman Boulevard
(CSAH 18) at Lake Susan Drive. Clarification is needed from
Mn/DOT on why this is included as a Chanhassen cost when it
is a turn lane to serve an existing development.
Response: The signals and additional roadway width along Powers Blvd
was not originally planned in the 212 Design Build project. The Signals
additional roadway width became necessary as a result of the A UAR.
Therefore the Department can directly accredit the increase in scope to
the city of Chanhassen. Signals were not planned at the north or south
ramp and loop termini prior to the A UAR impacts being incorporated into
the project scope. Therefore, local costs associated with the signals and
additional roadway width has been assigned to the City of Chanhassen.
The signal costs associated with the Powers Blvd ramp and loop termini
intersections are again assigned to the city of Chanhassen as a result of

the recently completed A UAR. Prior to the A UAR, signals were not
required at the northern and southern ramp termini. The A UAR required
signalized intersections in both locations and the City was assigned the
local share of these signal systems (50% of southern intersection, 60%for
northern intersection).
Discussion regarding the Carver County cost participation policy should
be between the city of Chanhassen and Carver County.

Trail Costs
· The cost summary includes a Chanhassen contribution of
approximately $1,549,600 for trail costs along Pioneer Trail
(CSAH 14), Powers Boulevard (CSAH 17), and Lyman
Boulevard (CSAH 18). These estimated trail costs include
both construction and right-of-way acquisition costs. Carver
County cost participation policy does not include participation
in sidewalk/trail costs; however, portions of these trail
segments may have some benefit to the overall County trail
plan. Discussions should be initiated with Carver County
regarding their participation in some of these trail costs.
· The cost summary includes a Chanhassen contribution of
approximately $105,000 for trail construction within Mn/DOT
right-of-way along the north side of TH 212 between Powers
Boulevard (CSAH 17) and TH 101. Mn/DOT cost
participation policy allows Mn/DOT participation in trails
constructed within trunk highway fight-of-way. Discussions
should be initiated with Mn/DOT regarding their possible
participation in these trail costs.
Response: The unit cost per square foot has been modified. Therefore
trail costs for the City of Chanhassen have been reduced. At this time, the
costs associated with trails requested by the city of Chanhassen will
remain the responsibility of the city of Chanhassen in accordance with the
Mn/DOT cost participation policy. If the city of Chanhassen would like a
meeting between Mn/DOT, Carver County and the City to discuss this
further the Department is willing to facilitate such a meeting.
The trail located within Mn/DOT Right of Way between Powers Blvd and
TH 1 O1 will remain the responsibility of the City of Chanhassen as defined
within the Mn/DOT cost participation policy.

The cost participation summary includes fight-of-way
acquisition costs for turn lanes and trails at numerous locations.
In a majority of these locations, Mn/DOT's right-of-way
acquisition was not changed as a result of the construction of
